פסק-דין

א. עתירה זו מסבה עצמה על הסדר טיעון שנכרת בין הפרקליטות לנאשמים בתיק שהחל באישומי רצח וניסיון לרצח, אך בתחום ישיבות הוכחות רבות הומר, בנימוק של קשיים ראייתיים, להריגה וחבלה חמורה. גזרי הדין שהוסכמו הם שבע ומחצה שנות מאסר (לארבעה משיבים) ושלוש שנות מאסר (לאחד המשיבים), וכן פיצוי עונשי של 250,000 ₪ לכל אחת ממשפחות הקרבנות. משיב אחד אמור להימחק מכתב האישום. בא כוח העותר – שהוא אחיו של המנוח, הקרבן בפרשה – טען בפנינו כי גם אם הומר התיק מרצח להריגה, העונשים קלים מדי בנסיבות. משיבי המדינה טוענים, כי הדברים נשקלו בהרחבה בדרג פרקליט המחוז, וגם הוסברו למשפחות הקרבנות. בא כוח המשיבים, הנאשמים בתיק סקר את הקשיים הראייתיים בפירוט.

ב. אין בידינו להיעתר לעתירה. עם כל הצער שבדבר על אבדן חיים ועל קרבן נוסף שנפצע קשה, לא מצאנו כשלעצמנו פגם בתהליך; הפרקליטות עשתה כמיטב יכולתה באישום של רצח ונסיון לרצח, אך משהגיעה לכלל מסקנה, בשלב מתקדם בראיות, כי אין מנוס משינוי הסעיפים, והדבר אושר בדרג פרקליט המחוז, איננו רואים להתערב בכך. הוא הדין לעניין העונש, שאמנם על פניו אינו נראה גבוה, אך אין לנו סיבה להטיל ספק בנקיון שיקול הדעת שהופעל.

ג. אנו מביעים השתתפותנו בצער משפחת ההרוג ובצער הפצוע. ואולם, נוכח כל אלה לא נוכל – כאמור – להיעתר לעתירה והיא נמחקת.
