השופט ס' ג'ובראן:

1.עניינה של העתירה שלפנינו בבקשת העותר, כי נורה למשיב ליתן טעם מדוע קיים פער של מחצית השעה בין הזמן המוקצב לפתרון השאלון בבחינת הבגרות בהיסטוריה במגזר הכללי ובמגזר הממלכתי הדתי.

2.העותר הינו מורה להיסטוריה במגזר הממלכתי הדתי, המלמד תלמידים הניגשים לבחינת הבגרות במקצוע זה. לטענתו, הזמן המוקצב לפתרון השאלון בבחינת הבגרות במגזר הכללי הינו 120 דקות, ואילו הזמן המוקצב לשם כך במגזר הממלכתי דתי היננו 90 דקות בלבד. לטענתו, הפרש זה מהווה הפליה פסולה, משאין הבדל מהותי בין שאלוני הבחינה בשני המגזרים. העותר מפרט בעתירתו כי החל משנת 2004 פנה מספר פעמים לגורמים שונים אצל המשיב בדרישה לתיקון המצב, אך לא נענה או נענה בשלילה.

3.מנגד, טוען המשיב בתגובתו לעתירה כי הפרש בין הזמנים המוקצבים לפתרון השאלונים נובע משוני בשאלונים עצמם, ועל כן מ דובר בהבחנה מוצדקת, ולא בהפליה פסולה. לטענת המשיב, קביעת הזמן המוקצב לפתרון שאלוני בחינות הבגרות הינו עניין המסור לשיקול דעתם הבלעדי של הגורמים המקצועיים, ואין מקום להתערבותו של בית משפט זה בהחלטותיהם בעניין זה.

לאחר שבחנו את העתירה ואת תגובות המשיב, ולאחר ששמענו את טיעוני הצדדים, שוכנענו כי דין העתירה להידחות.

4.עיקרה של העתירה נובע כאמור מההפרש בין הזמן המוקצב לתלמיד במערכת החינוך הממלכתית לפתרון השאלון בבחינת הבגרות בהיסטוריה ובין הזמן המוקצב לשם כך לתלמיד בחינוך הממלכתי הדתי. אלא שהעותר לא הראה מדוע הפרש זה מהווה הפלייה פסולה ולא אך הבחנה מוצדקת. השאלונים המשמשים לבחינות הבגרות בשני המגזרים שונים זה מזה הן במספר השאלות הכלולות בהם והן באופי ובסוג השאלות. אף אם החומר שנדרש לשם לימוד לבחינה הינו זהה, הרי שהנתונים אותם הציג המשיב – והעותר לא הראה מדוע אין בידינו לקבל את טענותיו בעניין זה – שהשאלון במגזר הכללי דורש יותר זמן לפתרונו, ועל כן השוני בין המגזרים אינו פסול לכשעצמו. יתרה מכך, ההבדל בין השאלונים דורש שנראה כל אחד מהם כמכלול העומד בפני עצמו, אף ביחס לפרק הזמן המוקצב לפתרונו.

5.אף בנוגע לפרק הזמן המוקצב לפתרון השאלון במגזר הממלכתי דתי, כשלעצמו, אין כמובן כל מקום להתערבותנו. עניין זה מסור לשיקול דעתם של הגורמים המקצועיים במשרד החינוך, ולא לנו להחליף את שיקול דעתם בשלנו. כפי שמציין המשיב בתגובתו, סוגיה זו נדונה בעבר על ידי מנהלת המרכז לבחינות בגרות במכון סאלד, אשר עוסק בחיבורם של השאלונים לבגרות, ובשנית על ידי יושבת ראש המזכירות הפדגוגית, כאשר שני הגורמים אישרו את מתכונת הזמן שהוקצבה למבחן. בהמשך נדרשה לדבר ועדת המעקב לעניין בחינות הבגרות, אשר מונתה ביום 19.6.2007 בהתאם להוראות חוזר מנכ"ל משרד החינוך. הוועדה דנה בפנייתו של העותר ביום 22.5.2008, והחליטה לאמץ את החלטותיהם של בעלי המקצוע.

6.לנוכח האמור, לא מצאנו בעתירתה כל עילה להתערבותנו בעמדת המשיב.

אשר על כן, העתירה נדחית.
