בקשה למחיקת עתירה ולפסיקת הוצאות

פסק-דין

1.לפני בקשה מטעם העותר לפסיקת הוצאות, שהתבקשה בד בבד עם מחיקת העתירה. בעתירה, שהוגשה ביום 27.7.2009, ביקש העותר כי המשיב יבצע תשלום דמי מענק חד פעמי המגיע לעותר בגין תאונת עבודה בה נפגע בשנת 2006 ומכח קביעת ועדה רפואית לעררים מיום 20.1.2009. על פי החלטת כב' השופטת א' חיות מיום 2.8.2009 התבקש המשיב להגיש תגובה מקדמית לעתירה. ביום 30.8.2009 מסר העותר כי בשלב זה שילם המשיב את המענק החד פעמי. מכאן בקשתו למחוק את העתירה. יחד עם זאת, עמד העותר על פסיקת הוצאות, על יסוד הטענה כי רק בעקבות העתירה בוצע התשלום. מחדלו של המשיב הוביל, כך נטען, להליך משפטי יקר אותו ניתן היה לחסוך. הוצאות המשפט שהתבקשו הן בגובה 15,000 ₪, סכום המהווה לטענת העותר הוצאות ריאליות.

2.המשיב, מנגד, סבור כי אין מקום לחייבו בהוצאות, שכן לא הייתה הצדקה להגשת העתירה. לטענתו, דינה היה דחייה על הסף בשל אי מיצוי הליכים, מה גם שהיה באפשרותו של העותר לפנות לבית הדין לעבודה, בהתאם לסעיף 391 לחוק הביטוח הלאומי [נוסח משולב], התשנ"ה-1995. המשיב מוסיף וטוען כי שיעור ההוצאות המבוקש אינו סביר, הכרחי או מידתי, הן לאור היקף העובדה שהושקע בעתירה והן לאור היקף הסעד שהתבקש, העומד על כ- 12,000 ₪.

3.לאחר עיון בעמדות הצדדים ובחומר המצוי בתיק, נחה דעתי כי יש בסיס מספיק לחיוב המשיב בהוצאות העותר. הסעד שהתבקש בעתירה – תשלום המענק החד פעמי - נתקבל לאחר הגשת העתירה. המשיב עצמו לא התכחש לזיקה הקיימת לכאורה בין הגשת העתירה לבין ביצוע התשלום במועד בו בוצע. המשיב לא הניח בסיס מספיק לטענות בעניין דחיית העתירה על הסף, טענות שנטענו בצורה כללית ביותר. כך למשל, הוא לא פירט אילו הליכים נוספים נדרש העותר לנקוט שהם בבחינת מיצוי הליכים. במצב דברים זה אין בידי לקבוע כי הגשת העתירה לא הייתה מוצדקת מלכתחילה.

4.מכאן לשיעור החיוב בהוצאות. לעניין זה יש להתחשב בכך שהעתירה אינה מורכבת, בכך שהמשיב טיפל בעניין במהירות לאחר הגשת העתירה ובכך שהסעד ניתן לעותר ללא צורך בהתייצבות לדיון וללא צורך בהגשת כתבי בי דין נוספים. אשר לדרישת העותר להוצאות ריאליות, אמנם נקודת מוצא בפסיקת הוצאות הינה הוצאות ריאליות, אך על מבקש ההוצאות מוטל הנטל להראות כי הוציא הוצאות בהיקף המבוקש וכי ההוצאות שהוציא היו הכרחיות, סבירות ומידתיות ביחס להליך שנוהל (בג"ץ 891/05 תנובה נ' הרשות המוסמכת (טרם פורסם, 30.6.2005)). במקרה דנן העותר לא הציג שום אסמכתא בדבר תשלום הוצאות בסכום שהתבקש. הוא לא הציג הסכם שכר טרחה, קבלות או חשבוניות. אף לא ניתן פירוט של העבודה שהושקעה ולא הוסבר בסיס החיוב בשכר הטרחה. לנתונים אלה חשיבות במסגרת הערכת הנחיצות והסבירות של הייצוג המשפטי, במיוחד נוכח השווי המשפטי של העתירה וסכום ההוצאות שביקש העותר. בשים לב לכלל נסיבות העניין, יעמדו ההוצאות על 3,000 ₪.

סיכומו של דבר, העתירה נמחקת. המשיב ישלם לעותר שכר טרחת עורך דין בסך 3,000 ₪. הסכום ישא הפרשי ריבית והצמדה כדין מיום ההחלטה ועד מועד התשלום בפועל.
