עניינה של עתירה זו נוגע לשתי קבוצות שחבריהן נכנסו שלא כדין לישראל – מי שממתינים להכרעה בבקשות להכרה בהם כמבקשי מקלט בישראל ומי שנמנים, כהגדרת העותרים, כמי שזכאים להגנה קולקטיבית מפני הרחקתם למדינות אזרחותם (ולכן, ככל העולה מטענות הצדדים, לא נדונות בעניינם בקשות מקלט פרטניות). השאלות שמעלים העותרים, הנוגעות לאכיפת איסור העסקתם של מי שנמנים על קבוצות אלה ולהסדרה חוקית של העסקתם – נכבדות וחשובות. עם זאת, במוקד העתירה מצויה החלטת ממשלה מספר 2104 מיום 19.7.10, לפיה יוקם צוות שיציע לממשלה צעדים שיאפשרו תחילת אכיפה כנגד מעסיקי מסתננים. תאריך היעד שצוין בהחלטה לתחילת האכיפה בפועל – 1.9.10, חלף ואינו רלבנטי עוד. החלטת ממשלה נוספת, החלטה מספר 2507 מיום 28.11.10, קבעה כי תחילת אכיפת איסור העסקתם של מסתננים תחל עם הפעלת מרכז השהייה למסתננים מגבול מצרים. מתגובות המדינה לבקשה לצו הביניים ומדברי באת-כוחה בדיון שנערך לפנינו עולה כי הקמת המרכז צפויה להימשך לכל הפחות 6 חודשים מיום קבלת ההחלטה. כן צוין במפורש בתגובתם המקדמית של המשיבים כי המדינה לא תבצע פעולות אכיפה כלפי מסתננים שלא ניתן לגרשם למדינות מוצאם בטרם תחל פעולת המרכז. על כך יש להוסיף כי באת כוח המדינה ציינה בדיון שנערך לפנינו כי תימסר הודעה לעותרים 30 ימים בטרם תחל באכיפה שכזו.

הנה כי כן, ככל שנוגעת העתירה לאכיפת איסור העסקתם של יוצאי מדינות אלה, הרי שבשל דחיית מועד תחילת האכיפה – הפכה העתירה למוקדמת. בהקשר זה יצוין כי רשמנו לפנינו את דברי המדינה כי תעדכן 30 ימים בטרם תחל בפעולות האכיפה ויודגש כי אין בפסק דין זה כדי למנוע מהעותרים לשוב ולהעלות טענותיהם כנגד אכיפת איסור ההעסקה, לכשיתחילו פעולות האכיפה והסוגיה לא תהיה עוד תיאורטית. ככל שנוגעת העתירה לקבוצות אחרות של מסתננים, הרי שאנו יוצאים מנקודת הנחה כי לא תתבצע אכיפה כלפי מעסיקים של מי שבקשת המקלט שלו תלויה ועומדת.

באשר לטענותיהם הכלליות של העותרים הנוגעות לזכותם של "מבקשי מקלט הממתינים להכרעה בבקשות המקלט שלהם ו/או אנשים המוחלת עליהם הגנה קולקטיבית מפני הרחקה למדינות אזרחותם" לעבוד בישראל – הרי שעל אף הקושי שמעלה סוגיה זו, הגענו לכלל מסקנה כי דינן להידחות גם כן. מהדיון שנערך לפנינו עלה כי לאחרונה קוצר פרק הזמן שחולף בטרם מוזמנים מבקשי מקלט לבדיקה אינדיבידואלית של בקשתם, אשר בסופה מקבל מי שהוכר כפליט מעמד תושב. לאור שיפור זה בהליך הטיפול בבקשות המקלט, נראה כי הצטמצם החשש לפגיעה בזכותו של מי שאכן זכאי בסופו של תהליך להכרה כפליט. כפי שהובהר לעיל, ניתן להבין מדברי המדינה בדבר זירוז הליך הטיפול בבקשות האינדיבידואליות, כי לא תתבצע אכיפה כלפי מעסיקיהם של מי שהגישו בקשה כאמור בטרם יסתיים הליך הטיפול בבקשה. באשר לטענות העותרים ביחס לזכותם של חברי אותה קבוצה הזכאית כהגדרתם להגנה קולקטיבית ומשכך הגנתם אינה נדונה במסגרת בקשות פרטניות, קרי, מי שמגיעים ממדינות אריתריאה וסודן – הרי שכאמור, הובהר על-ידי המדינה כי בשלב זה לא ננקטות פעולות הנוגעות לאיסור העסקתם. נוסף על כך, ציינה ב"כ המדינה כי נעשים מאמצים למצוא "מדינות יעד" שניתן יהיה, בהתאם למחויבויות המדינה במישור הבינלאומי, להרחיק אליהן את מי שנמנים על קבוצה זו. במצב העניינים הנתון, בו לצד הרגישות לרקע הקשה של רבים מחברי קבוצות אלה, יש לתת את הדעת אף לאינטרס המדינה למנוע "הגירת עבודה" החורגת כמובן מאותם מקרים בהם קיים חשש מבוסס לרדיפה – נראה כי עמדת המדינה שפורטה לעיל, לפיה אין להעניק אישורי עבודה, לצד האמירה כי בשלב זה לא ינקטו פעולות כנגד מעסיקים, יש בה משום איזון ראוי בהתחשב במציאות הקשה והרגישה שנוצרה. אף בקביעה זו אין כדי למנוע מהעותרים לשוב ולעתור כנגד מדיניות המשיבים, ככל שיחול שינוי נסיבות שיהיה בו כדי להקרין על איזון זה.

העתירה איפוא נדחית, בכפוף לאמור לעיל, ללא צו להוצאות.
