עניינה של העתירה בפנינו הוא בבקשת העותר כי בית משפט זה יעניק לו סעד מן הצדק, ויתן פסק דין סופי בנוגע להליכים שהתקיימו בעניינו לפני ערכאותיו השונות של בית הדין לעבודה.

כפי שעולה מן העתירה, העותר נפגע במסגרת עבודתו בשלושה אירועים שונים לגרסתו, בגינם הגיש תביעות כנגד המשיב 1. במסגרת העתירה טוען העותר כי המוסד לביטוח לאומי, הוא המשיב 1, הוועדות הרפואיות הפועלות מטעמו, ובית הדין האזורי לעבודה בירושלים, הוא המשיב 2, פגעו כולם כאחד בזכויותיו. בעיקר מלין העותר כי המשיבים הפרו, לטענתו, הפרה בוטה את הסכמת העותר והמשיב 1, אשר קיבלה תוקף של פסק דין (ב"ל 1943/99) ביום 7.9.2000 על ידי בית הדין האזורי לעבודה בירושלים (כבוד השופטת ר' רוזנפלד). לפי נוסח ההסכמה, הסכים המשיב 1 להעמיד את העותר לפני ועדה רפואית לצורך בחינת החמרת מצבו הרפואי כתוצאה מהתאונה שעבר ביום 2.11.1992. הוסכם גם כי "המועד ממנו ניתן יהיה לקבוע את החמרת המצב יהיה 2.2.98". לאחר שהתנהלו מספר הליכים לקביעת היקף ומועד החמרת מצבו, קבעה ועדה רפואית של המשיב 1 ביום 27.2.2006 כי לעותר 10% נכות רפואית כתוצאה מפגיעה בעבודה החל מיום 1.6.1999. לטענת העותר, בכך חרגה הועדה הרפואית מהסכמת הצדדים אשר לפיה הוחמר מצבו של העותר החל מיום 2.2.1998. עוד טוען העותר כי על המשיבים לקבוע כי נכותו הרפואית כתוצאה מפגיעת עבודה מגיעה לכדי 15%, בזהה לנכות הרפואית הכללית שנפסקה לו בעבר. לבסוף טוען העותר כנגד ניכויים שונים שקיזז המשיב 1 מקצבתו בגין חובות שונים שצבר כלפי זה האחרון.

מנגד טוען המשיב 1 כי כל טענותיו של העותר כנגד אחוזי הנכות אשר נפסקו לו ומועד חישובם, נידונו לגופם על ידי הועדות הרפואיות של המשיב 1 ובתי הדין לעבודה, אשר פסקו לעותר את כל אשר מגיע לו. באשר לטענות כנגד הקיזוז שנעשה בקצבתו, הרי שקיזוז זה נעשה על סמך חוות דעת מקצועית של רואה חשבון, אשר לעותר פתוחה דרך להשיג עליה בפני בית הדין לעבודה.

דין העתירה להידחות על הסף. כידוע, הלכה היא, כי בית משפט זה, בשבתו כבית משפט גבוה לצדק, אינו מתערב בפסקי דין של בית הדין לעבודה, אלא במקרים חריגים, כאשר פסק הדין לוקה בטעות משפטית מהותית, שהצדק מחייב את תיקונה (ראו בג"ץ 525/84 חטיב נ' בית הדין הארצי לעבודה, פ"ד מ (1) 673, 693 (1986); בג"ץ 5618/01 יצחק צויזנר נ' בית-הדין הארצי לעבודה, (לא פורסם)(2001); בג"ץ 840/03 ארגון הכבאים המקצועיים בישראל – ועד כבאים ואח' נ' בית-הדין הארצי לעבודה, פ"ד נז (6) 810)(2003)).

בענייננו, אין מ דובר בשאלה משפטית בעלת השלכה כללית או במקרה חריג. מ דובר במחלוקות נקודתיות, אשר אינן מצדיקות את התערבותו של בית משפט זה. בית הדין האזורי לעבודה בירושלים דחה זה מכבר את פרשנותו של העותר להסכם שהושג בין הצדדים ביום 7.9.2000, בפסק דינו בתיק ב"ל 2025/01 מיום 12.6.2002 (כבוד השופט א' אברהמי), ובפסק דינו בתיק ב"ל 10998/07, מיום 20.9.2007 (כבוד סגנית הנשיא ד' פרוז'ינין, נציג העובדים מר מחלב ונציג המעבידים מר קליינר)). לא מצאתי פגם בהחלטות אלו וממילא אין מ דובר בסוגיות שיצדיקו את התערבותו של בית משפט זה בהחלטותיו של בית הדין לעבודה.

בנוסף, טענותיו השונות של העותר כנגד הקיזוז שנעשה מקצבתו על ידי המשיב 1 דינן להידחות על הסף, וזאת בשל קיומו של סעד חלופי. אמנם, בקשתו של העותר בבש"א 1557/08 לסעד זמני כנגד קיזוז שנעשה בקצבתו, נדחתה על ידי בית הדין האזורי לעבודה בירושלים ביום 17.6.2008 (כבוד השופט א' אברהמי). בקשת רשות ערעור (בר"ע 390/08) שהוגשה על החלטה זו נדחתה אף היא בהחלטתו של בית הדין הארצי לעבודה (כבוד הנשיא ס' אדלר) מיום 18.6.2008. עם זאת, בהחלטות אלו נאמר מפורשות כי דרך המלך העומדת לעותר לטעון כנגד קיזוז בקצבתו היא בהגשת תביעה בעניין לבית הדין האזורי לעבודה בירושלים. לפיכך, משקיימת ערכאה שיפוטית המוסמכת לדון בעניינו של העותר, לא ייעתר בית משפט זה לבקשתו למתן סעד (ראו בג"צ 3649/08 שמנובה נ' משרד הפנים (לא פורסם, 20.5.2008); רשף נ' משרד התעשיה המסחר והתעסוקה- יחידת הסמך לעובדים זרים (לא פורסם, 28.12.2008)).

אשר על כן, דין העתירה להידחות על הסף.
