פסק-דין

1.העותרים 3-1 (להלן: העותרים) קיבלו בשנת 1998 רישיון להפעלת בית אבות, שהתחדש מדי שנה עד לפקיעתו ביום 30.5.2010. במקביל, נחתם בין העותרת 1 לבין משרד הרווחה הסכם להפעלת מעון, המסדיר את קליטתם של קשישים הזכאים למעון במימון משרד הרווחה. לטענת המשיבים, התגלו במהלך השנים ליקויים שונים בהפעלת המוסד שהפעילו העותרים: חוסר בכוח אדם מתאים; קליטת קשישים סיעודיים מבלי אפשרות לתת להם מענה הולם; אי תקינות ברשומות הרפואיות של הקשישים השוהים במתקן; רמת תחזוקה ירודה. בנוסף, הצטברו אצל המפקחים מטעם משרד הרווחה תלונות בדבר יחס לקוי לדיירים (לרבות אלימות פיזית), וכן טענות נוספות בדבר תחזוקת המוסד ואופן הפעלתו. מעת לעת, פנו מפקחי משרד הרווחה לעותרים, והציגו את תמונת הליקויים. לאורך השנים, נתנו המשיבים לעותרים הזדמנויות לתקן את הליקויים, תוך חידוש הרישיון בתנאים. לטענת המשיבים, הליקויים חזרו ונשנו והתמונה בכללותה לא השתפרה.

2.במכתב מיום 10.8.2009, הבהירה המפקחת הארצית על המעונות (המשיבה 3) כי נוכח הליקויים שנמצאו בבית האבות, ניתנת לעותרים הזדמנות אחרונה לתקנם, וככל שהדבר לא יתבצע יפסיק המשרד את ההתקשרות עם המעון. לאחר שיג ושיח בין הצדדים, ומבלי שהליקויים תוקנו לשביעות רצונם של המשיבים, פקע רישיון העותרת ביום 30.5.2010. לאחר מכן, פעלו המשיבים להפנות לאלתר את הקשישים שהופנו מטעם משרד הרווחה למעון חלופי. ביום 1.11.2010, הודע לעותרים על הכוונה להגיש כתב אישום בגין הליקויים במעון. שלושה שבועות לאחר מכן, התבקשו העותרים לפנות את דיירי המעון בתוך 45 ימים, הואיל והפעלת בית אבות ללא רישיון מהווה עבירה פלילית. כתב אישום כאמור הוגש ביום 28.2.2011, ונקבע לדיון ליום 14.12.2011 (יוער כי בינתיים נדחה מועד הדיון ליום 3.5.2012).

3.מכאן העתירה שלפנינו, שהוגשה ביום 18.9.2011. לטענת העותרים, הליקויים שעליהם הצביעו המשיבים תוקנו, אך המשיבים מתעקשים להתנכל להם ולפעול לסגירת בית האבות שהם מפעילים. לטענת העותרים, דיירי המוסד מרוצים וממליצים עליו לאחרים. התלונה שהוגשה למשטרה בגין אלימות, כך נטען, נוגעת לדייר אלים בעל עבר פסיכיאטרי. העותרים טוענים כי ההחלטה שלא לחדש את רישיון העותרת אינה סבירה ופוגעת בחופש העיסוק של העותרים. לדברי העותרים, משלא ניתנה החלטה פוזיטיבית של שר הרווחה לבטל את הרישיון ולסגור את המעון לפי סעיף 6 לחוק הפיקוח על המעונות, התשכ"ה-1965 (להלן: חוק הפיקוח על המעונות), אין להם אלא לעתור לבית משפט זה בשבתו כבית משפט גבוה לצדק.

4.המשיבים טוענים כי דין העתירה להידחות על הסף. ראשית, נטען כי העותרים כלל לא הגישו בקשה לחידוש הרישיון, ולכן אין בנמצא החלטה מינהלית שתעמוד לביקורת בית המשפט. שנית, נטען כי נפל שיהוי ניכר בהגשת העתירה, שכן רישיון העותרת פקע כבר בחודש מאי 2010, בעוד שהעתירה שלפנינו הוגשה למעלה משנה לאחר מכן. שלישית, טוענים המשיבים כי יש לדחות את העתירה מחמת חוסר ניקיון כפיהם של העותרים, שעושים דין לעצמם וממשיכים להפעיל את המעון ללא רישיון בניגוד לחוק. לגופם של דברים, נטען כי נוכח הליקויים הקשים שפורטו לעיל, לא היה מקום לחדש את רישיון העותרים.

5.לפי הוראות סעיף 7 לחוק הפיקוח על המעונות, רשאי מנהל מעון שהשר הורה על ביטול רישיונו לפי סעיף 6 לחוק, לערור על החלטתו לפני בית משפט השלום. בענייננו, מסכימים הצדדים כי אין בנמצא החלטה בדבר ביטול הרישיון, שעליה ניתן לערור בנקודת הזמן הנוכחית. דא עקא, שככל שעולה מהתשתית העובדתית שהונחה לפנינו, נובע הדבר מכך שלא הוגשה בקשה לחידוש הרישיון על-ידי העותרים. אמנם, העותרים טענו בתשובה מיום 11.12.2011 (בניגוד לאמור בתגובת המשיבים) כי הם הגישו בקשה לחידוש הרישיון, אלא שהם לא שמרו העתק ממנה, ואינם יכולים להציגה לפנינו. המשיבים מסכימים כי גם בנקודת הזמן הנוכחית פתוחה לפני העותרים הדרך להגיש בקשה לחידוש הרישיון (סעיף 41 לתגובת המשיבים). ככל שיעשו כן, ותתקבל תשובה שלילית, יוכלו הם לערור על ההחלטה לפני בית משפט השלום בהתאם להוראות סעיף 7 לחוק הפיקוח על המעונות. בית משפט זה בשבתו כבית משפט גבוה לצדק אינו האכסניה המתאימה לבירור טענות הצדדים, בהינתן קיומו של סעד חלופי כאמור.

לאחר כתיבת הדברים, הוגשה בקשה מטעם העותרים למחיקת העתירה. לדברי העותרים, הנהלת המעון התחלפה ומתנהל משא ומתן בין הצדדים לתיקון הליקויים וחידוש הרישיון. לבקשת העותרים אנו מוחקים אפוא את העתירה. מודגש, עם זאת, כי ככל שהצדדים לא יגיעו לידי הסכמה, על העותרים לפעול במתווה הדיוני שעליו עמדנו, ככל שיסברו כי קיימת עילה לכך.
