פסק דין

1.בפנינו עתירה שעניינה בביטול צו מעצר מינהלי שהוצא נגד העותר.

2.העותר עצור מכוח צו מעצר מינהלי מאז תאריך 27.1.2010, לאחר שנשפט קודם לכן על פעילות-עבר בארגון החמאס והיה אף עצור ברשות הפלסטינית. צו המעצר הנוכחי שהוציא המשיב 2 האריך את מעצרו של העותר מתאריך 18.6.2010 ועד לתאריך 18.11.2010, בהתבסס על כך שהוא (ביחד עם אחרים) היה קשור בחוליה של חמאס, אשר תכננה לפגוע בבטחון איזור יהודה ושומרון. שופט צבאי, שהעותר הובא בפניו לשם ביקורת שיפוטית על מעצרו המינהלי, הורה על קיצור לא מהותי של תקופת המעצר עד לתאריך 18.10.2010. ערעור העותר על ההחלטה נדחה על-ידי בית המשפט הצבאי לערעורים בקציעות בתאריך 13.9.2010.

3.מכאן העתירה, שהוגשה רק היום (11.10.2010), ואשר בגדרה טוען העותר כי מעצרו המינהלי מונע משיקולים זרים, וכי אין בסיס ראייתי, או חוקי למעצרו. העותר מבקש לקבוע דיון דחוף בעניינו, נוכח מועד תפוגתו של צו המעצר – תאריך 18.10.2010. העותר אף מבקש לפטור אותו מהתייצבות לדיון, על מנת שלא להטריחו.

4.דין העתירה להידחות על הסף, מחמת השיהוי הכבד והמאיין בהגשתה. ההחלטה האחרונה בעניינו של העותר, המאשררת את המשך מעצרו של העותר לתקופה של ארבעה חודשים, שנמנית מתאריך 18.6.2010 – ניתנה לפני כחודש ימים. העתירה שבפנינו הוגשה כאמור רק היום, 11.10.2010, שבוע ימים בלבד לפני סיום תקופת מעצרו המינהלי של העותר. בעתירה אין התייחסות למועדים שבהם ניתנו ההחלטות השיפוטיות הקודמות בעניינו של העותר, והדברים עולים רק מעיון בנספחי העתירה. העותר אף איננו מנסה להסביר מדוע הגיש את עתירתו רק עתה.

5.אכן, כל שעה שאדם נתון במעצר (ובכלל זה, כמובן –מעצר מינהלי) – פוגע בחירותו וודאי הדבר קשה לו מאוד, וזכותו העקרונית היא כי המשך מעצרו ייבחן, אם הוא יבקש זאת, על-ידי הערכאות השיפוטיות. אלא שבמקרה דנן, כנלמד מן ההשתהות הבלתי מוסברת בהגשת העתירה, נראה כי העותר עצמו השלים עם ההחלטות השיפוטיות שכבר ניתנו בעניינו. הנה כי כן, דומה, כי מבוקשו של העותר איננו להשתחרר מעולו של צו המעצר הנוכחי, כי אם לנסות ולבחון את עמדתם הטנטטיבית של המשיבים 2 ו-3 לקראת האפשרות להוצאת צו מעצר מינהלי חדש בעניינו של העותר – החלטה שצפויה להתקבל כנראה בימים הקרובים. אולם במצב שבו טרם הוצא צו עתידי והצו הקיים אמור לפוג ממילא בימים הקרובים (כאשר העותר מבקש לפטור אותו אפילו מלהתייצב לדיון) – דין העתירה להידחות על הסף, וכך אנו מורים.
