פסק-דין

השופט י' עמית:

1.העותר, תושב כפר קאסם, כיום כבן 54, נעצר בחודש יולי 1986 והועמד לדין בפני בית הדין הצבאי בשכם בגין השתייכות לארגון הפת"ח, חטיפה וסיוע לגרימת מותו של חייל צה"ל עקיבא שאלתיאל. בגין עבירות אלה נדון העותר למאסר עולם.

2.העותר, המייצג את עצמו, מבקש בעתירתו שלושה סעדים.

ביטול גזר הדין: לטענת העותר, העמדתו לדין בפני בית הדין הצבאי בשכם ולא במערכת האזרחית בישראל, הינה בלתי חוקית, פסולה ומפלה בהשוואה למקרים אחרים בהם נדונו אזרחים ישראלים, ערבים ויהודים, על פשעים שביצעו, גם על רקע לאומני.

אי קציבת עונש המאסר: העותר לא נכלל בקבוצות האסירים ששוחררו על ידי המדינה כמחווה לבקשות הרשות הפלסטינית, כאזרח ישראלי הוא לא נכלל בין האסירים ששוחררו על ידי ישראל במסגרת "עסקת שליט", ולטענתו, הוחרג לרעה ממקרים דומים אחרים, ואף ראש החוליה במסגרתה פעל שוחרר זה מכבר. לטענת העותר, הוא "נופל בין הכסאות" – כאסיר בטחוני אינו זכאי לחנינה, וכאסיר ישראלי לא נכלל במחוות של שחרור לרשות הפלסטינית. מכאן עתירתו לקצוב את עונשו לאחר 27 שנות מאסר.

תנאי המאסר: העותר טען כי הוא זכאי לתנאי מאסר הניתנים לאסירים רגילים כמו תוכניות שיקום וטיפול סוציאלי, תעסוקה וחינוך, ביקורים פתוחים, קשר טלפוני וחופשות. לטענתו, תנאיו המגבילים לא מאפשרים לו להפגש עם נכדיו החדשים והוריו המזדקנים אשר מצבם הרפואי קשה.

3.דין העתירה להידחות על הסף על שלושת ראשיה.

א. טענות העותר לגבי מותב השיפוט והפגם הנטען בהעמדתו לדין באיו"ש הועלו בשיהוי קיצוני של למעלה מ-25 שנים מאז ניתן גזר דינו של העותר בבית הדין הצבאי (וראו, על דרך של קל וחומר, בסעיף 4 לפסק דינו של השופט (כתוארו אז) גרוניס בבג"ץ 4765/11 ג'רדאת נ' היועץ המשפטי לממשלה (30.8.2011) (להלן: עניין ג'רדאת), שם נדחתה עתירה בה הועלתה טענה דומה, בגין שיהוי של ארבעה חודשים). די בכך כדי לדחות טענת העותר על הסף, אף מבלי להידרש לסוגית סמכות בית הדין הצבאי לגופה (לעניין זה, ראו בפסקה 2 בעניין ג'רדאת).

ב. אשר לקציבת העונש, מתשובת המשיבים נמצאנו למדים כי ביום 30.12.2012 (קרי, למעלה מחודשיים לאחר הגשת העתירה דכאן) הועברה בקשה מפורטת לקציבת עונשו של העותר ללשכת היועץ המשפטי של מפקד כוחות צה"ל באיו"ש. הטיפול בבקשה טרם הסתיים, ומכאן שהעתירה מוקדמת באשר הוגשה טרם מיצוי ההליכים.
