הנשיאה ד' ביניש:

העתירה שלפנינו מופנית כנגד אישור תכנית לתשתית לאומית שמספרה תת"ל 2, 13/6 הנוגעת לרכבת העמק, מסילת הברזל המתוכננת מחיפה לבית שאן, בקטע המסילה העוקף את העיר עפולה מצפון בקירבת המושב בלפוריה. במקום זה מתוכננת תחנת רכבת ועיקר טענתם של העותרים כי אושרה תכנית הסוטה מתכנית המתאר הארצית תמ"א 23 (תיקון מס' 15) המסדירה את תוואי מסילת הרכבת. העותרים ביקשו בהתנגדותם בפני הות"ל כי התחנה תמוקם בצמידות לכביש 65 ובכך תימנע פגיעה בשטחים חקלאיים המעובדים על-ידי העותרים. טענותיהם המשפטיות של העותרים, בכל הנוגע ליחס בין התכנית הארצית תמ"א 23 ולשינויים שאושרו על-ידי הות"ל, אינן מקובלות עלינו. על-פי ההלכה שיצאה מלפני בית משפט זה בבג"ץ 8425/04, 8470/04 אדם טבע ודין - אגודה ישראלית להגנה על הסביבה נ' הוועדה הארצית לתכנון ובניה של תשתיות לאומיות (טרם פורסם), מוסמכת היתה הות"ל לסטות מהתמ"א כפי שעשתה ובפועל היתה הסטייה במידה מסוימת בלבד, סטייה של כ- 1000 מ' מהתוואי שנקבע בתמ"א. התכנית שאושרה על-ידי הות"ל היא ברמה של תכנית תשתית מפורטת, שהוא הליך שהתחייב לשם התאמת התמ"א לאפשרויות הביצוע. שמענו את הנימוקים התכנוניים של המשיבים לאותה סטייה שאושרה ושוכנענו כי מדובר בשיקולים הנדסיים מקצועיים שאין בידינו להתערב בהם. עם זאת נתנו דעתנו לעובדה שמימוש התכנית מתעכב משיקולים מעשיים ותקציביים שונים.

בנסיבות אלה אנו ממליצים כי לקראת ביצוע התכנית המאושרת תיבחן פעם נוספת האפשרות לצמצם את הנזק שייגרם לשטחים החקלאיים ומכל מקום, להשתדל שלא לחרוג מהמרחק של 1000 מ' עליו הצהירה רכבת ישראל בדיון בפנינו, אם וככל שהדבר ניתן מבלי לפגוע בשיקולים התכנוניים של מיקום התחנה ביחס לעיר עפולה ובשיקולים הנוגעים לאפשרויות כניסת הרכבות לתחנה.

בכפיפות לאמור העתירה נדחית.
