1.העותר הוא התובע ב-תא"ק 10965-09-09 המתנהל בבית משפט השלום בתל אביב-יפו (להלן: ההליך האזרחי). ככל שניתן להבין מן העתירה, שנוסחה בידי העותר שאיננו מיוצג, היא מכוונת כנגד החלטות שונות שקיבל כב' השופט משה סובל, במסגרת ההליך האזרחי, וביניהן החלטה שלא איפשרה לעותר להגיש כתב תביעה מתוקן. בעתירה מתבקש גם צו-על-תנאי כנגד הנהלת בתי המשפט וזאת בשל השגות על אופן הטיפול של אגף הביקורת הפנימית ותלונות הציבור בתלונה שהגיש העותר בנוגע למזכירה בבית משפט השלום בתל אביב-יפו והכרוכה אף היא בעניין כתב התביעה המתוקן. העותר גם מבקש צו ביניים שיאפשר לו להגיש את כתב התביעה המתוקן, לקראת דיון קדם משפט בהליך האזרחי, הקבוע לעת הזו לתאריך 14.11.2010.

2.לאחר שעיינו בחומר הרב שצירף העותר, בתגובה המקדמית מטעם הנהלת בתי המשפט ובתגובות הנוספות שהגיש העותר – נחה דעתנו כי דין העתירה להידחות על הסף. כידוע, נוכח הוראת סעיף 15(ד)(3) ל חוק יסוד: השפיטה, בית המשפט הגבוה צדק איננו נדרש, ככלל, לעתירות המופנות כנגד בתי משפט בהקשר לתפקידיהם השיפוטיים, הנתונים ממילא לערעור במסגרת המערכת השיפוטית (ראו: בג"ץ 583/87 הלפרין נ' בית המשפט המחוזי בירושלים פ"ד מא(4) 683,702 (1987)). בעתירה שבפנינו הסעד המבוקש הוא כלפי בית משפט השלום, המוסמך לדון בתביעתו של העותר.

3.ייתכנו אמנם מקרים נדירים וחריגים לכלל הנ"ל, בגדרם יידרש סעד למען הצדק על פי סעיף 15(ג) ל חוק יסוד: השפיטה ואולם אלה מוגבלים לסיטואציות של חוסר סמכות בולטת, או פגיעה בולטת בעיקרי הצדק הטבעי (ראו: בג"ץ 8117/05 אזולאי נ' בית המשפט העליון בירושלים (לא פורסם, 28.9.2005); בג"ץ 1530/ 08 גנור נ' בית המשפט העליון (לא פורסם, 25.2.2008)). המקרה שלפנינו איננו בא בגדר אותם מקרים יוצאי דופן.

זאת ועוד, ממילא פתוחה בפני העותר הדרך להעלות את טענותיו במסגרת ישיבת קדם המשפט הקבועה בתיק וכן במסגרת הליכי הערעור המקובלים בסדר הדין האזרחי.

4.אשר לטענות העותר ביחס להנהלת בתי המשפט, רשמנו לפנינו את הודעת המדינה כי בימים הקרובים תימסר לעותר תשובה לגבי תלונתו, לאחר השלמת הבדיקות הנדרשות. במובן זה העתירה היא גם מוקדמת, שכן הוגשה עוד טרם שהתקבלה כל החלטה בנושא.

5.נוכח כל האמור לעיל – העתירה נדחית איפוא על הסף, שכן על פניה אין היא מגלה עילה. העותר יישא בשכר-טירחת עו"ד המשיבה 2 בסך של 3,000 ש"ח.
