השופטת א' פרוקצ'יה:

1.עתירה כנגד החלטת המשיבה לבטל את מעמדו של העותר כתושב קבע בישראל.

2.ביום 8.6.95 נישא העותר לאזרחית ישראלית. על בסיס קשר זה, ובהתאם לנוהל שהיה מקובל באותה תקופה, קיבל העותר מעמד של תושב קבע בישראל. כתשעה חודשים לאחר קבלת המעמד בישראל, התגרשו העותר ואשתו זה מזו. בבואו לחדש את תעודת הזהות שבידו, נמסר לעותר כי מעמדו בישראל בוטל, וזאת מן הטעם שנישואיו לאזרחית הישראלית היו נישואים פיקטיביים. באותו מעמד, נלקחה מן העותר תעודת הזהות שהיתה בידו.

3.לטענת העותר, נישואיו לא היו נישואין פיקטיביים. לטענתו, לא הוא שביקש להתגרש מאשתו, אלא היא זו שהגישה את תביעת הגירושין, והוא נאלץ לגרשה לפי החלטת בית הדין השרעי. כן טוען העותר כי החלטת המשיבה ניתנה מבלי שהוא הוזמן לשימוע ומבלי שניתנה לו אפשרות להשמיע את טיעוניו.

4.לטענת המשיבה, דין העתירה להידחות על הסף, באשר היא לוקה בשיהוי ניכר ובשל קיומו של סעד חלופי. לטענתה, נודע לעותר על ביטול מעמדו בישראל בשנת 2004, עת נלקחה ממנו תעודת הזהות שהייתה ברשותו, ואילו העתירה שלפנינו הוגשה רק בשנת 2007. המשיבה מוסיפה כי יש לדחות את העתירה על הסף, גם מן הטעם שהערכאה המתאימה לדון בעתירות בעניין מעמד של תושב קבע הינה בית המשפט לעניינים מינהליים, בהתאם לסעיף 12 לתוספת ראשונה ל חוק בתי משפט לעניינים מינהליים, התש"ס - 2000.

עוד מציינת המשיבה בתגובתה כי מעמדו של העותר נשלל לאחר שגרושתו הישראלית פנתה במכתב למשרד הפנים ומסרה כי התגרשה מן העותר, וכי מטרת הנישואין שלו עימה הייתה קבלת תעודת זהות ישראלית. המשיבה מפרטת כי לאחר קבלת המכתב מגרושתו של העותר, נשלח אל העותר מכתב ממשרד הפנים, שבו נמסר לו כי משרד הפנים שוקל לבטל את תושבות הקבע שניתנה לו, לאחר שהובא לידיעת המשרד כי נישואיו נערכו לצורך קבלת תעודת זהות ישראלית וכי הם כלל לא מומשו. כן נמסר לעותר במכתב זה כי במידה ולא תתקבל תגובתו תוך 30 יום, יראו זאת כהודאה בכל הכתוב ומעמדו יבוטל. כשלושה חודשים לאחר מכן החליט מינהל האוכלוסין לבטל את מעמדו של העותר, והודעה על כך נשלחה לעורכת הדין אשר ייצגה את העותר.

5.דין העתירה להידחות על הסף מחמת קיומו של סעד חלופי ובשל שיהוי כבד בהגשת העתירה.

אשר לסעד חלופי, המ דובר בענייננו בעתירה הנוגעת לרשיון ישיבה בישראל. מקומה להידון בבית המשפט לעניינים מינהליים (סעיף 12 לתוספת ראשונה ל חוק בתי משפט לעניינים מינהליים, התש"ס - 2000. בג"צ 10463/06 סלימה מחמד אחמד עג'ולי נ' שר הפנים, תק-על 2006(4), 4993; בג"ץ 2208/02 סלאמה נ' שר הפנים, פד"י נו(5) 950); עע"ם 8844/04 שעבאן נ' משרד הפנים תק-על 2006(1) 1927). משקיים סעד חלופי, אין מקום כי בית משפט זה יזקק לעתירה.

6.מעבר לכך העתירה נגועה בשיהוי כבד. כשלוש שנים חלפו מאז נלקחה מן העותר תעודת הזהות הישראלית שלו ועד למועד הגשת עתירה זו. זמן רב עוד יותר, כחמש שנים, חלף מאז נשלחה אל העותר ההודעה הראשונה מהרשות המוסמכת על הכוונה לשלול את מעמדו בישראל. אף אם נניח כי העותר לא קיבל אף אחת מן ההודעות שנשלחו לו ולעורכת הדין שטיפלה בעניינו, הרי שללא ספק נודע לו על שלילת מעמדו בעת שניגש לחדש את תעודת הזהות שהייתה בידו, וזו נלקחה ממנו. מאז חלפו, כאמור, שלוש שנים, ובמהלכן, ככל העולה מן העתירה ומן התגובה לה, לא פעל העותר בענין החלטת המשיבה. בנסיבות הענין, משך הזמן שעבר כאמור עולה כדי שיהוי, שדי בו כדי לדחות את העתירה על הסף (בג"צ 2002/05 בכר מרים זיאדאת נ' שר הפנים, תק-על 2005(2), 4503; בג"צ 6476/04 מוחמד סעיד אלחין נ' שר הפנים, תק-על 2004(4), 355; בג"צ 8567/04 עודה הואשלה נ' שר הפנים, תק-על 2005(2), 4507; בג"ץ 6814/01 חולה מוסא עודה נ' שר הפנים - משרד הפנים, תק-על 2001(3), 1670); בג"צ 6476/04 אלחין נ' שר הפנים, תק-על 2004(4) 355; בג"צ 275/04 כבהא נ' משרד הפנים, תק-על 2004(1) 438. משני הטעמים האמורים, דין העתירה להידחות על הסף.
