הסעד המבוקש בעתירה שלפנינו הינו כי נורה למופקדים על הנושא במשרד הרווחה להעביר לשירותי הרווחה ברשויות המקומיות את חלקו בתקציב הנדרש למימון הסעת אנשים מעל גיל 21, אשר נקבע בוועדת האיבחון ביחס אליהם כי הם לוקים בפיגור שכלי וזכאים לסידור יומי.

בהודעת המדינה נמסר כי המשיבים אכן מודעים לצורך לאפשר את ההסעות לאותם זכאים, ומטעם זה הוחלט כי התקציב המיועד להסעות הללו, יוגדל ולמעשה יוכפל בשנת 2009, כאשר לשנת תקציב זו תתווסף תוספת של 4 מיליון ₪ מעבר לתקציב 2008, וסכום זה יוקצה אף אם בשל האילוצים השונים יחולו עיכובים באישור תקציב המדינה במועד.

החלטה זו להגדלת התקציב על פי הערכה המבוססת על הנחות עבודה ונתונים שבידי המשיבים, נראית על פניה כהיעתרות לעתירה ובכך קיבלו העותרים את הסעד המבוקש על ידם.

רשמנו לפנינו את הודעת המדינה כי אם בתום השנה יתברר כי ההערכה התקציבית אינה מספקת בשל גידול בצרכים, הנושא ייבחן מחדש לקראת שנת התקציב שלאחריה.

אנו חוזרים ומדגישים בפסק דיננו זה כי בצד תקציב המדינה שיינתן לרשויות המקומיות, מוטלת על הרשויות החובה להקצות את חלקן בשיעור 25% מהתקציב המיועד להסעות; וכן כי עליהן להקפיד שהתקציב שניתן להן לצורך ההסעות יישמר כתקציב מיועד; עוד על הרשויות המקומיות לקיים את אחריותן לביצוע אותן הסעות על פי הסדרים שייקבעו בהתאם לאחריותם זו.

באמור לעיל מוצתה העתירה ונוכח קבלת הסעד המבוקש מטעם המדינה, אין עוד מקום להתערבות נוספת של בית המשפט.

לפיכך בכפיפות לאמור העתירה נמחקת.
