עתירה כנגד החלטת בית המשפט הצבאי לערעורים, בגדרה נדחה ערר העותר על החלטת בית המשפט הצבאי ביהודה להותיר אותו במעצר עד תום ההליכים.

1.העותר, יליד 1969, נעצר ביום 31.10.2012 לאחר שבחיפוש שנערך בביתו נמצאו חמישה מנועי רכב גנובים. בעקבות זאת, הוגש נגדו כתב אישום ל בית המשפט הצבאי ביהודה בו הואשם כי עסק בקנייה, פירוק ומכירת חלקי כלי רכב, ובנוסף אחסן מנועי כלי רכב גנובים, עבירות לפי סעיף 407יא לחוק הפלילי הירדני (מספר 16).

2.בד בבד עם הגשת כתב האישום, הוגשה לבית המשפט הצבאי ביהודה בקשה לעצור את העותר עד לתום ההליכים (תיק מספר 4520/12). בהחלטתו מיום 6.11.2012 קבע השופט קידר, כי קיימות ראיות ישירות ונסיבתיות הקושרות את העורר לעבירות המיוחסות לו בכתב האישום, וכי קמה עילת מעצר בהתאם להלכה בבש"פ 5431/98 רוסלן פרנקל נ' מדינת ישראל, פ"ד נב(4) 268 (1998) (להלן: הלכת רוסלן), בין היתר, לאור העובדה כי מקור המנועים הוא במעשי גניבה שונים, ממקומות שונים בארץ, במועדים שונים ועל פני מספר שנים.

העותר ערר ל בית המשפט הצבאי לערעורים בטענה, כי כתב האישום לא מבוסס כדבעי, כי העובדות מוכיחות שלא נשקפת ממנו סכנה לציבור ולא קמה עילת מעצר. בית המשפט (השופט עצמון ב ע"מ 2640/12) דחה את הערר, ומכאן העתירה דכאן לביטול ההחלטה למעצרו של העורר עד לתום ההליכים. בעתירתו חזר העורר על הטענות שהעלה בפני בית המשפט הצבאי לערעורים וטען, בין היתר, ליישום מוטעה של הלכת רוסל ן בעניינו.

3. בית משפט זה חזר והדגיש כי אינו יושב כערכאת ערעור על החלטותיהם של בתי המשפט הצבאיים בעניין מעצרם של נאשמים בשטחים עד תום ההליכים נגדם (ראו אך לאחרונה פסק דינו של השופט א' שהם בבג"ץ 7925/12 שאדי ג'ברין נ' המשנה לנשיא בית המשפט הצבאי לערעורים באיו"ש (לא פורסם, 18.12.2012) והאסמכתאות שם). על אף המחלצות העקרוניות שניסה העותר לעטות על עתירתו, הרי שלפנינו ערעור המבקש להיחזות כעתירה. הלכה למעשה, מלין העותר במישור הראייתי באשר למעורבותו בגניבת הרכבים או בפירוק המנועים, ועל יישום הלכת רוסלן בעניינו, נושאים שאינם חורגים מעניינו הפרטני של העותר ולא נכללים בגדרי המקרים החריגים המצדיקים התערבות בית משפט זה.

5.אשר על כן, דין העתירה להידחות על הסף. משלא נתבקשה תגובה אין צו להוצאות.
