עתירה להפסקת כהונתו של המשיב 2 (להלן: המשיב) כיו"ר ועד האגודה השיתופית של מושב דלתון (להלן: המושב), ולהפעלת סמכויות המשיב 1 (להלן: רשם האגודות) לחקירת אופן מינויו של המשיב לכהונתו.

1.המשיב נבחר לכהונתו כיו"ר ועד האגודה השיתופית של המושב ביום 28.3.2012. כשנתיים וחצי לפני כן, הורשע המשיב (ביחד עם אחרים) על פי הודאתו בעבירות של סיוע לקבלת דבר במרמה, ומרמה והפרת אמונים – עבירות לפי סעיפים 415 רישא ו–284 לחוק העונשין, התשל"ז-1977. על פי כתב האישום בו הורשע, בתקופה בה כיהן כראש מועצת מרום גליל אישר המשיב ל קבלן פרטי להטמין אשפה באתר ייעודי בתעריף מוזל המיועד לרשויות האזור. על המשיב נגזרו שמונה חודשי מאסר על תנאי למשך שלוש שנים, וכן 20,000 ₪ קנס (או לחילופין ארבעה חודשי מאסר) (הכרעת וגזר הדין של השופט אזולאי בבית משפט השלום בנצרת מיום 16.7.2009, ת"פ 2387/07).

2.ביום 28.10.2012, כשבעה חודשים לאחר שנבחר המשיב לכהונתו כיו"ר ועד המושב, שלח בא כוח העותרים מכתב לרשם האגודות בדרישה להפסיק את כהונתו של המשיב בגין הרשעתו בעבירות דלעיל. עוד טרם נענתה הפניה שהגיעה לרשם האגודות ביום 4.11.2012, הגישו העותרים ביום 4.12.2012 את העתירה דכאן. לטענת העותרים, יש בעבירות בהן הורשע המשיב קלון, ועל רשם האגודות להפעיל סמכותו ולהפסיק את כהונתו.

3.דין העתירה להידחות על הסף בשל אי מיצוי הליכים והקדמת זמנה.

העותרים הזדרזו ופנו ל בית משפט זה, עוד טרם היה סיפק בידי רשם האגודות להגיב לפנייתם, וכפי שעולה מתגובתו המקדמית של הרשם, בכוונתו לפתוח בחקירה בנושא שהועלה על ידי העותרים. זאת, על פי סמכותו לפי תקנה 26 לתקנות האגודות השיתופיות (רשויות האגודה), התשל"ה-1975 הקובעת כלהלן:

26. (א) אלה פסולים להיבחר לועד או להמשיך לכהן בו:

(1) מי שהורשע בפסק דין סופי על עבירה שיש עמה קלון – תוך שלוש שנים מיום מתן פסק הדין ואם הוטל עליו מאסר, מיום גמר ריצוי העונש, לפי המועד המאוחר יותר;....

(ד) (1) ראה הרשם שנתקיימה לכאורה אחת או יותר מהעילות לפסילת חבר המנויות בתקנה זו או בתקנון האגודה לענין פקיעת חברותו של חבר בועד או להמשך כהונתו בועד – יהא הרשם רשאי, לאחר עריכת חקירה לפי סעיף 43 לפקודה ולאחר שנתן לצדדים הזדמנות נאותה להשמיע את טענותיהם, להחליט שחברותו בועד של אותו חבר תפקע, או כהונתו לא תימשך, אם קבע שאמנם נתקיימה בו אחת העילות האמורות.

על מנת להורות על הפסקת כהונתו של המשיב, על רשם האגודות להקדים אפוא ולקיים חקירה מתאימה, כך שדין העתירה להידחות הן בשל אי מיצוי הליכים והן מאחר שהעתירה הקדימה את זמנה, באשר היה על העותרים להמתין פרק זמן סביר עד לקבלת תשובת רשם האגודות טרם יגישו את עתירתם (בג"ץ 6394/04 ארגון האמבולנסים הפרטיים בישראל נ' מגן דוד אדום (לא פורסם, 10.2.2005); בג"ץ 9403/05 מסוף העברת מסמכי מחשבים בע"מ נ' שר האוצר (לא פורסם, 6.10.2005)). לא נעלמה מעיני תגובתו של העותר 1, בה טען כי פנה לרשם האגודות במכתב אנונימי כבר בחודש מרץ 2012, אולם טענה זו לא בא זכרה בעתירה ומשכך נבצר מהרשם להתייחס אליה. מכל מקום, לא למותר לציין כי המכתב שצורף כעת על ידי העותר, נושא חותמת "נתקבל" מיום 13.5.2012 של "האגף לאיגוד שיתופי נהריה" ולא ברור אם הגיע בסופו של יום אל הרשם.

4.אשר על כן, ומבלי להביע כל עמדה לגבי העתירה גופא, אנו דוחים את העתירה, ולפנים משורת הדין, אין צו להוצאות.
