1.לפנינו עתירה לתיקון פסק הדין של בית הדין הארצי לעבודה (עב"ל 78-10) לפיו נדחה ערעורו של העותר על פסק דינו של בית הדין האזורי לעבודה (ב"ל 460/08), בגדרו נדחתה תביעתו נגד החלטת המשיב בנוגע לבסיס ההכנסה ששימש לצורך חישוב הגמלה, לה זכאי העותר, בגין תאונת עבודה שעבר בשנת 1980.

2.העותר נפגע בתאריך 23.11.80 בתאונה שהוכרה על ידי המשיב כתאונת עבודה. בגין התאונה נקבעו לעותר 100% נכות החל מיום 24.1.81. בהתאם, שולמו לו דמי פגיעה וגמלת נכות. בשנת 1985 ובשנת 2001 פנה העותר אל המוסד לביטוח לאומי והלין על אופן חישוב בסיס השכר שנקבע לו לתשלום הגמלאות. המשיב דחה את טענותיו וקבע כי הבסיס שנקבע בשנת 1980 הינו נכון. העותר הגיש תביעה לבית הדין האזורי לעבודה, בה הלין על השומה הסופית שנקבעה. בית הדין האזורי לעבודה ניתח את הוראות הדין שהיו רלוונטיות באותה תקופה וקבע כי לא נפלה טעות בחישוב הגמלאות על ידי המשיב. ערעור שהוגש לבית הדין הארצי לעבודה נדחה. נקבע כי פסק דינו של בית הדין האזורי לעבודה מבוסס היטב בממצאיו העובדתיים ובמסקנותיו המשפטיות. בית הדין הארצי לעבודה ניתח בפסק דינו את הוראות הדין וקבע כי היה על המוסד לביטוח לאומי לערוך את בסיס החישוב על פי השומה הסופית לשנת המס 1979-1980 ולא על בסיס השומה הזמנית של שנת 1980. על אף שהמשיב ביצע את התחשיב על פי השומה הזמנית לשנת 1980 ולא על פי השומה הסופית, נקבע כי בכך דווקא הוטב מצבו של העותר. הודגש כי אף ניתנה לעותר הזדמנות להביא ראיות במועד בו נקבעה השומה, אולם הוא לא הציג ראיות שכאלו לא בפני המשיב ואף לא בפני בית הדין האזורי ובית הדין הארצי לעבודה. מכאן הוגשה העתירה שלפנינו.

לטענת העותר בית הדין לעבודה טעה בפירוש החוק, התקנות וההלכה הפסוקה. לטענתו, זכותו קופחה שכן הוא מקבל גמלה בסך 2, 800 ₪ לחודש בעוד שעל פי החוק הוא אמור לקבל סכום גבוה יותר. לטענתו, המשיב טעה באופן בו חישב את בסיס השכר הקובע לקבלת הגמלה. העותר פירט את הוראות הדין הרלוונטיות ואת גובה שכרו באותה תקופה, בהתחשב גם בשומה של מס הכנסה. לשיטתו הטעות באופן בו חושבה זכאותו לגמלאות מצדיקה את התערבותו של בית משפט זה.

3.בית משפט זה, בשבתו כבית משפט גבוה לצדק אינו יושב כערכאת ערעור על בית הדין הארצי לעבודה. כלל מושרש הוא כי בית המשפט הגבוה לצדק יתערב בפסק דין של בית הדין הארצי לעבודה רק כאשר מתקיימים שני תנאים מצטברים – האחד, קיומה של טעות משפטית מהותית בפסק הדין; השני, הצדק מחייב את התערבות בית המשפט בנסיבות העניין (ראו: בג"ץ 5168/93 מור נ' בית הדין הארצי לעבודה, פ"ד נ (4) 628, 634 (1996); בג"ץ 525/84 חטיב נ' בית הדין הארצי לעבודה, פ"ד מ (1) 673, 693 (1986)). באשר לתנאי הראשון – קיומה של טעות משפטית מהותית, לא בכל טעות משפטית יתערב בית המשפט, כפי שנפסק "השיקול המנחה לבחינתה של "טעות משפטית מהותית" נוגע"לאופייה של הבעיה, היינו, לחשיבותה הציבורית הכללית או למשקלה המשפטי הסגולי או לכלליותה ונפוצותה כתופעה במסגרת יחסי העבודה או להשפעתה הכללית על הליכים חברתיים ולשיקולים כיוצא באלה" (בג"צ 5666/03 - עמותת קו לעובד ואח' נ' בית הדין הארצי לעבודה בירושלים ואח', תק-על 2007(4), 109, 123).

בראייה זו, העותר לא הצביע על כל עילה משפטית המאפשרת התערבות בפסיקת בתי הדין לעבודה ודי בכך כדי לדחות את העתירה. בית הדין הארצי לעבודה בפסק דין מנומק התייחס בהרחבה לטענותיו של העותר ודחה אותן לגופן. העותר לא הוכיח כי אכן נפלה טעות משפטית באופן בו בתי הדין לעבודה יישמו את הוראות הדין על נסיבות המקרה. בהקשר זה חשוב להדגיש, כפי שקבע בית הדין הארצי לעבודה, כי העותר לא הציג ראיות שבכוחן לבסס את טענותיו כנדרש.

4.מן המקובץ עולה כי דין העתירה להדחות על הסף. אין צו להוצאות.
