המשנה לנשיאה א' ריבלין:

שתי סוגיות מרכזיות עולות בבקשת רשות ערעור זו, שהיא בבחינת "גלגול שלישי" לאחר ששתי ערכאות קודמות נדרשו לסכסוך בין הצדדים-הניצים. סוגיה אחת עניינה הכרעת בית המשפט המחוזי בטענות ההדדיות שהפנו זה-כנגד-זה המבקש והמשיב בגין התבטאויות דיבתיות שהשמיעו האחד כלפי השני. מסקנתו של בית המשפט המחוזי כי בסופו של יום התביעות מקזזות זו את זו סבירה בהחלט בנסיבות המקרה. לאור זאת, לא הייתי רואה בעניין זה משום עילה למתן רשות ערעור ב"גלגול שלישי", וזאת מבלי צורך להידרש לכל קביעותיו של בית המשפט קמא בדרכו למסקנה זו.

לא כך לגבי הסוגיה השנייה שהועלתה בבקשה – זכות הערעור של המבקש לפני בית המשפט המחוזי על החלטת ביניים שנתן בית משפט השלום. לגבי סוגיה זו מצאתי לנכון, לאחר שבחנתי את התייחסות הצדדים לעניין זה, ליתן רשות ערעור ולדון בבקשה כאילו הוגש ערעור על-פי הרשות שניתנה.

וזו הסוגיה: באחת הישיבות שהתקיימו בבית משפט השלום החליט השופט לדחות את תביעתו של המשיב, זאת לאחר שזה האחרון לא התייצב ובא-כוחו-שלו ביקש למחוק את התביעה. כעבור חמישה חודשים ביטל בית משפט השלום החלטה זו לבקשתו של המשיב. המשפט נמשך בהתאם ובית המשפט הכריע לגוף העניין בשתי התביעות שעמדו לפניו (זו של המבקש וזו של המשיב). במסגרת הערעור שהוגש לבית המשפט המחוזי על פסק-הדין הסופי השיג המבקש גם על החלטת הביניים שבה ביטל בית משפט השלום את החלטתו לדחות את תביעתו של המשיב.

בית המשפט המחוזי קיבל את טענתו של המבקש כי בית משפט השלום לא היה רשאי ליתן את החלטת הביניים האמורה, כיוון שההחלטה הקודמת, לדחות את התביעה, ניתנה לפי בקשת בא-כוחו של המשיב. כלומר, נמצא כי לא מ דובר בסיטואציה שבה מוגשת בקשה לביטול החלטה שניתנה על-פי צד אחד – שאז נתונה הסמכות לבית המשפט שנתן את ההחלטה (סעיף 201 לתקנות סדר הדין האזרחי, התשמ"ד-1984) – אלא בסיטואציה שבה הדרך לביטול ההחלטה הייתה הגשת ערעור.

עם זאת, בית המשפט המחוזי מיאן לקבל את ערעורו של המבקש על החלטת הביניים של בית משפט השלום, וזאת כיוון שהמבקש לא הגיש, בסמוך לאחר שניתנה החלטה זו, בקשת רשות ערעור. בית המשפט ציין כי אמנם לכאורה הייתה נתונה למבקש האפשרות להגיש בקשת רשות ערעור או להמתין ולהשיג על ההחלטה במסגרת הערעור על פסק-הדין הסופי; אולם משלא הגיש המבקש בקשת רשות ערעור יש לראות בו כמי שויתר על הזכות להשיג על ההחלטה או כמי שנוהג בחוסר תום-לב בהעלותו את הטענה במסגרת הערעור על פסק-הדין.

אינני סבור שהנמקה זו של בית המשפט המחוזי יכולה לעמוד. כפי שציין בית המשפט המחוזי, כאשר ניתנת החלטת ביניים (שהיא בגדר "החלטה אחרת") יכול בעל-הדין הרואה את עצמו נפגע ממנה להשיג עליה בשתי דרכים: להגיש בתוך 30 ימים בקשת רשות ערעור או להמתין לפסק-הדין הסופי שאז ניתן, במסגרת הערעור אם יוגש, לערער בזכות גם על החלטת הביניים. מבנה משפטי זה אינו אידיאלי ובעת האחרונה נקבעו הוראות-דין המגבילות את הזכות להגיש בקשת רשות ערעור על "החלטה אחרת". אולם לענייננו אין ספק שכאשר ניתנה החלטת הביניים של בית משפט השלום, בדבר ביטול ההחלטה הקודמת לדחות את תביעתו של המשיב, רשאי היה המבקש לנקוט באחת מבין שתי הדרכים: להגיש בקשת רשות ערעור או להמתין לערעור על פסק-הדין הסופי (אם יוגש) (ראו: תק' 411 לתקנות סדר הדין האזרחי, התשמ"ד-1984). הבחירה בכל אחת מן הדרכים הללו כרוכה ביתרונות וחסרונות, הן מבחינתו של בעל-הדין עצמו הן מבחינות נוספות ומערכתיות (ראו רע"א 7682/06 אליהו חברה לביטוח בע"מ נ' אלוש (לא פורסם, 25.6.2007)). המבקש בחר בדרך השנייה, כלומר החליט שלא להגיש בקשת רשות ערעור ולפצל את ההליך בערכאה הדיונית, אלא לערער בזכות, אם יראה צורך בכך, במסגרת הערעור על פסק-הדין הסופי לכשיינתן. בחירה זו כשלעצמה אין בה חוסר תום-לב, וכך גם העובדה שבחירה זו לעיתים מצריכה "חזרה לאחור" במסגרת הערעור על פסק-הדין הסופי. בנסיבות העניין ולאור האמור גם אין מקום לראות במבקש כמי שויתר על זכותו להשיג על ההחלטה במסגרת הערעור על פסק-הדין. יצוין בהקשר זה כי באת-כוח המבקש הודיעה בבית משפט השלום שבכוונתה לערער על החלטת הביניים וכך עשתה – במסגרת הערעור על פסק-הדין הסופי.

לפיכך, דין הערעור בנקודה זו להתקבל. לאחר ששקלתי בדבר החלטתי להחזיר את התיק לבית משפט המחוזי על-מנת שיבחן את הנפקויות של מסקנתי-זו במקרה הספציפי.

המשיב יישא בהוצאות הבקשה וכן בשכר טרחת עורך הדין של המבקש בסכום של 10,000 ש"ח.
