פסק דין

1.בקשת רשות ערעור ולצִדה בקשה לעיכוב ביצוע החלטת בית המשפט המחוזי בחיפה (השופט ד"ר מ' רניאל) בת.א. 5606-06-12 מיום 2.7.2013 בגִדרה נקבע כי ראיות התביעה העיקרית בת.א. 5606-06-12 יִשמעו בנפרד מהתביעה שכנגד ומהתביעה בת.א. 44128-06-13 וכי ינתן פסק דין נפרד בתביעה העיקרית בת.א. 5606-06-12.

2.ביום 4.2.2004 נחתם הסכם בין המשיבים 2-1 לבין המבקשים למכירת מגרש בגוש 10041 בחלקה 44 בחדרה. עם חתימת ההסכם, הועבר למשיב 3 יפוי כוח לרישום עסקת המקרקעין. ביום 4.6.2012 הגישו המשיבים 2-1 תביעה לבית המשפט המחוזי בחיפה לביטול הסכם המכר (להלן: ת.א. 5606-06-12), במסגרתה נטען כי המבקשים לא שילמו את מלוא התמורה המוסכמת. ביום 9.7.2012 הגישו המבקשים כתב הגנה בד בבד עם תביעה שכנגד לאכיפת הסכם המכר. ביום 11.10.2012 נקבעה ישיבת קדם-משפט ליום 27.1.2013. ביום 27.1.2013 התקיים דיון במעמד הצדדים, נקבעה ישיבת קדם-משפט נוספת ליום 17.3.2013, וזו התקיימה במועדה; בית המשפט המחוזי הורה על קביעת התיק להוכחות ליום 2.7.2013. ביום 20.6.2013 הגישו 41 רוכשים נוספים תביעה כספית נגד המשיבים 2-1 בקשר להפרת הסכמים דומים למכירת מגרשים בחלקות 44 ו-49 בעיר חדרה, וביקשו לאוכפם על המשיבים 2-1 (להלן: ת.א. 44128-06-13). ביום 24.6.2013 הגישו המבקשים "בקשה דחופה לאיחוד הדיון בתובענה דנא עם התובענה בת.א. 5606-06-12" בגדרה נטען בין היתר כי "עניינן של שתי התובענות בהסכם, פרשנותו ובאכיפתו על הנתבעים (המשיבים 2-1 – נ' ס')". ביום 25.6.2013 הורתה השופטת ב' גילאור כך: "לאור נימוקי הבקשה ובהסכמת השופט רניאל יאוחד הדיון בתובענה עם התביעה בתיק אז' 5606-06-12. החלטה בבקשה לדחיית הדיון הקבוע ל-2/7/13 תינתן ע"י השופט רניאל...". ביום 26.6.2013 הגישה ב"כ המבקשים "בקשה למתן החלטה בבקשה לדחיית מועד הדיון". בו ביום, הורה בית המשפט המחוזי כי "הדיון בבקשה יערך בתחילת ישיבת ההוכחות, אז יוחלט אם יקויים מועד ההוכחות במלואו, או ידחה במלואו, או אחליט על הפרדת שמיעת הראיות כך שישמעו רק ראיות התביעה העיקרית, ואילו ראיות התביעה שכנגד ידחו למועד אחר. הצדדים יערכו בהתאם". ביום 27.6.2013 הוגשה "בקשה להבהרת החלטה מיום 26/6/13", ובית המשפט המחוזי קבע כך: "ההחלטה ברורה. אני דוחה את הבקשה".

3.בהחלטת בית המשפט המחוזי מיום 2.7.2013 נקבע, כי "על פי תקנות 52 ו-53, בדרך כלל יידונו תביעה ותביעה שכנגד ביחד. במקרה זה זו היתה הכוונה, ועל כן נקבע שהראיות יישמעו בתביעה ובתביעה שכנגד היום. לפני 12 יום הוגשה תביעה בתיק אזרחי 44128-06-13 על ידי 41 רוכשים נוספים שב"כ הנתבעים הודיעה על תביעתם בישיבת יום 27.1.13, ביחד עם בקשה לאיחוד הדיון ודחיית מועד ההוכחות. הבקשה לאיחוד הדיון התקבלה, אבל למעשה זהו איחוד הדיון בין התביעה החדשה לבין התביעה שכנגד. עתה עומדת להכרעה השאלה של שמיעת הראיות היום... דיון בתביעה ובתביעה שכנגד ביחד יגרום לסרבול גדול ונוסף של ההליכים ולדחיית הדיון לפרק זמן ניכר, יתר על המידה. לפיכך אני קובע שהיום לא יישמעו הראיות בתביעה שכנגד אבל יישמעו כל הראיות בתביעה העיקרית, וראיות התביעה שכנגד יישמעו ביחד עם ראיות התביעה בתיק 44128-06-13 במועד נוסף שייקבע... ". בגמר שמיעת הראיות באותו יום, החליט בית המשפט המחוזי על מועדים להגשת סיכומים, והורה על הבאת התיק לפניו לכתיבת פסק דין (בתביעה העיקרית).

4.מכאן בקשת הרשות לערער שלפנַי. לטענת המבקשים, שגה בית המשפט המחוזי כשקבע כי יש לפרש את החלטת השופטת ב' גילאור מיום 25.6.2013, אשר ניתנה בהסכמת השופט מ' רניאל, כהחלטה שלכאורה מאחדת את הדיון בתביעה בת.א. 44128-06-13 עם התביעה שכנגד בלבד בת.א. 5606-06-12, ולא גם עם התביעה העיקרית באותו תיק. לדידם, החלטת בית המשפט המחוזי על הגשת הסיכומים בתביעה העיקרית בת.א. 5606-06-12, אשר על סמכם ינתן פסק דין בטרם תידון התביעה שכנגד ביחד עם התביעה השניה בת.א. 44128-06-13, מאיינת הלכה למעשה את החלטת השופטת ב' גילאור בדבר איחוד הדיון. המבקשים מוסיפים ומציינים כי קיים חשש ולפיו הפרדת הדיון ומתן פסק דין בתביעה העיקרית בת.א. 5606-06-12 בנפרד מהתביעה שכנגד ומהתביעה בת.א. 44128-06-13 יתפרש כמעשה בית דין שיקים מחסום דיוני ומהותי, הן ביחס למבקשים, הן ביחס ליתר הרוכשים בת.א. 44128-06-13. לפי עמדת המבקשים, שגה בית המשפט המחוזי כשקבע כי דיון מאוחד בתביעה העיקרית בת.א. 5606-06-12 ובתביעה שכנגד יגרום לסרבול גדול ונוסף של ההליכים, ולדחיית הדיון לפרק זמן ארוך. עוד כהנה וכהנה טענו המבקשים, אך אין צורך לפרט.

5.מנגד, טוענים המשיבים 2-1 כי משנשמעו ראיות התביעה העיקרית והוגשו הסיכומים מטעמם, נוצר "מעשה עשוי". לדידם, המבקשים השתהו בכך שהגישו את בקשת הרשות לערער "43 ימים לאחר שמיעת הראיות ו-14 ימים לאחר הגשת הסיכומים" מטעמם. זאת ועוד, לפי עמדת המשיבים 2-1, מדובר ב "החלטה דיונית מובהקת" אשר ערכאת הערעור אינה נוטה להתערב בה. לדבריהם, על פי תקנה 53(ב) לתקנות סדר הדין האזרחי, מוסמך בית המשפט להורות על הפרדת הדיון בין תביעה ותביעה שכנגד. המשיב 3 הודיע ביום 28.8.2013 כי "יכבד כל החלטה" שתינתן.

6.לאחר עיון בבקשת רשות הערעור, בתגובה ובהחלטת בית המשפט המחוזי, ולאחר שקילת הטענות מזה ומזה, החלטתי לדון בבקשת הרשות לערער כאילו ניתנה הרשות והוגש ערעור על-פי הרשות שניתנה – באין התנגדות לכך – בהתאם לתקנה 410 לתקנות סדר הדין האזרחי. לגופו של עניין, הגעתי למסקנה כי דין הערעור להתקבל. אכן, שוכנעתי כי החלטת בית המשפט המחוזי מיום 2.7.2013 סותרת – לשונית ומהותית – את החלטת השופטת ב' גילאור מיום 25.6.2013. משמעותה של ההחלטה בדבר איחוד הדיון היא איחוד בין התביעה העיקרית והתביעה שכנגד גם יחד בת.א. 5606-06-12, עם התביעה בת.א. 44128-06-13; משמעותה איננה איחוד הדיון בתביעה החדשה (ת.א. 44128-06-13) רק עם התביעה שכנגד בתביעה הראשונה (ת.א. 5606-06-12). כיוצא בדברים הללו, מתן פסק דין סופי בתביעה העיקרית בת.א. 5606-06-12 בלבד יוכל להתפרש כמעשה בית דין ובכך לחסום את בירור התביעה שכנגד, וכן להציב קושי של ממש בפני בירור התביעה בת.א. 44128-06-13. היעילות חשובה, המגמה שלא לדחות את שמיעת הראיות בישיבה מיום 2.7.2013 ברורה, אך בנסיבות העניין הדבר יכול לפגוע בזכויות התובעים שכנגד (בת.א. 5606-06-12) והתובעים בתביעה החדשה (ת.א. 44128-06-13). את הנעשה אין להשיב, אך ניתן לתקן עתה את הטעון תיקון על מנת למנוע פגיעה בזכויות המבקשים.

7.החלטתי אפוא לקבל את הערעור ולהורות על החזרת המתווה הדיוני למתכונת המקורית כפי שנקבעה בהחלטת השופטת ב' גילאור מיום 25.6.2013 לפיה ישמעו שני התיקים (ת.א. 5606-06-12; ת.א. 44128-06-13) במאוחד. הראיות שנשמעו בתביעה העיקרית בת.א. 5606-06-12 במהלך הדיון שהתקיים ביום 2.7.2013 לא ירדו לטמיון, וניתן יהיה כמובן להתבסס עליהם לצורך פסק הדין, אך זה לא ינתן עתה אלא רק לאחר השלמת הדיון גם בתביעה שכנגד ובתביעה החדשה.

המשיבים ישלמו למבקשים שכ"ט עו"ד בסך כולל של 10,000 ₪ (למשיבים 2-1 סך של 7,500 ₪; למשיב 3 סך של 2,500 ₪).
