פסק-דין

1.בית המשפט המחוזי בתל-אביב (כבוד השופטת ד' גנות) חייב את המבקשת-הנתבעת לגלות מסמכים עוד טרם הגשתו של כתב תשובה על ידי המשיבים-התובעים. על כך מוסבת בקשת רשות הערעור שבפניי.

2.המשטרה ניהלה חקירה של רצח שנתבצע בחודש דצמבר 1996. המשיבים 2-1, שהינם אחים, נעצרו ונחקרו בחשד למעורבות ברצח. המשיבים 4-3 הינם הוריהם של האחים. בסופו של דבר הורשעו אחרים ברצח. המשיבים הגישו תובענה כספית לבית המשפט המחוזי בתל-אביב בה טענו כי פעולותיה של המשטרה בחקירת הרצח גרמו להם נזקי גוף ונפש. התובענה משתרעת על פני 30 עמודים (ומצורפים לה נספחים). המבקשת הגישה כתב הגנה המחזיק 31 עמודים (ואף לו מצורפים נספחים). המשיבים לא הגישו כתב תשובה אלא עתרו לגילוי מסמכים ולהארכת מועד להגשת כתב תשובה. בית המשפט נעתר לבקשה ונתן צו גילוי מקיף. מכאן בקשת רשות הערעור.

3.דומה שהעניין הסתבך שלא לצורך תוך בזבוז של אנרגיה ומשאבים של בית המשפט ובעלי הדין. ייאמר מיד כי המבקשת לא קיימה את הדרישה שבתקנה 75 לתקנות סדר הדין האזרחי, התשמ"ד-1984 (להלן - תקנות סד"א) לפיה חובה על בעל דין לרשום בכתב טענות את המסמכים עליהם הוא מסתמך וכן עליו לצרפם לכתב הטענות. הדרישה שבתקנה 75 בנוסחה דהיום (בעקבות תיקונה בשנת 2006: ק"ת 6490, תשס"ו (14.6.2006) עמ' 834) מטילה חובה מקיפה יותר מאשר בעבר על בעל דין. לא רק שחובה לצרף כל מסמך מהותי, כפי שהיה בעבר, אלא חובה לצרף כל מסמך שבעל הדין מסתמך עליו בכתב הטענות. כידוע, הדרישה לצירוף מסמך מהותי משמעה חובה לצרף מסמך שמהווה בעצמו חלק מעילת התביעה המובאת בכתב התביעה (לגבי החובה שהוטלה בעבר והשאלה מהו מסמך מהותי, ראו יואל זוסמן סדרי הדין האזרחי 174 (מהדורה שביעית, 1995)). התיקון של תקנה 75 גרם לכך שבמידה מסוימת נשתבשה ההפרדה בין שלב כתבי הטענות לבין השלב של הליכים מקדמיים וקדם משפט (ראו, דודי שוורץ סדר דין אזרחי 323 (2007)). מכל מקום, ברור שאין חפיפה בין החובה שבתקנה 75 לצרף כל מסמך עליו מסתמך בעל דין בכתב הטענות לבין הליכי הגילוי והעיון שבתקנות 118-112 לתקנות סד"א. אף אם נפרש את החובה לצרף מסמכים שבתקנה 75 בצורה מרחיבה, הרי אין בעל הדין שהגיש את כתב הטענות חייב כיום לצרף לכתב הטענות מסמכים שברשותו ובשליטתו ואשר עשויים לסייע לצד שכנגד. לעומת זאת, חובת הגילוי כאשר ניתן צו גילוי לפי תקנה 112 לתקנות סד"א משתרעת לא רק על מסמכים שעשויים לסייע לבעל הדין שהצו ניתן נגדו, אלא גם על מסמכים שעשויים לעזור לצד שכנגד (ראו, למשל, ע"א 27/91 קבלו נ' ק' שמעון, עבודות מתכת בע"מ, פ"ד מט(1) 450, 458 (1995)). ההבדל בין חובת הצירוף שבתקנה 75 לבין חובת הגילוי מכוח צו שיפוטי לפי תקנה 112 מביא לכך שגם אם בעל דין מקיים במלואה את הדרישה שבתקנה 75, לא ייתר הדבר את הצורך בהליכי גילוי ועיון.

4.במקרה הנוכחי אף המשיבים לא פעלו על פי הסדר והנוהג המקובלים. המשיבים לא פנו למבקשת לפני הגשתה של בקשתם לבית המשפט. ראוי היה לעשות כן. יתרה מזו, בקשתם לגילוי ועיון לא צומצמה לעניין החובה שבתקנה 75 אלא הייתה מקיפה יותר. בית המשפט נעתר לבקשה ונתן צו גילוי שהיקפו רחב מן הנדרש בתקנה 75, וזאת עוד לפני שהוגש כתב תשובה. הגשתו של כתב תשובה הייתה יכולה להביא לראייה מדויקת יותר של גדר המחלוקת.

5.כאמור שני בעלי הדין לא נהגו בדרך הנכונה. דומני שבמקרה כגון המקרה דנא ראוי לשמור עד כמה שניתן על ההפרדה בין השלב של כתבי טענות לזה של הליכים מקדמיים וקדם משפט. ייתכן שיהיו מצבים קיצוניים בהם תהא הצדקה להתערבות שיפוטית לשם אכיפה של החיוב שבתקנה 75 לפני הגשתו של כתב תשובה. אולם, בוודאי שאין להרחיק לכת וליתן צו גילוי ועיון מקיף לפני שבעלי הדין השלימו את הגשתם של כתבי הטענות.

6.החלטתי לדון בבקשה כאילו ניתנה רשות ערעור וזה הוגש על פיה. הערעור מתקבל ותחת החלטתו של בית המשפט המחוזי נקבע שעל המבקשת לפעול על פי תקנה 75 לתקנות סד"א תוך 45 ימים מעת המצאת פסק דין זה. כתב תשובה יוגש תוך 30 ימים נוספים. לאחר מכן ניתן יהיה, כמובן, לנקוט הליכי גילוי ועיון על פי התקנות. אעיר, כי דומה שמיותר להקדיש משאבים לשאלה מה בדיוק היקף החובה לפי תקנה 75 במקרה זה (ובמקרים רבים אחרים) כאשר ממילא תידרש המבקשת (וכן המשיבים) לגילוי מקיף (כפוף לטענת חיסיון) לאחר שיושלם השלב של הגשת כתבי טענות.
