המשנה לנשיאה א' ריבלין:

בשנת 1999 חתמו עיריית באר-שבע (להלן: העירייה) והעמותה לקידום מורשת עולי אתיופיה – באר-שבע (להלן: העמותה), על הסכם לפיו תוקצה לעמותה קרקע לצורך ניהול מועדון לחברי הקהילה האתיופית בעיר. המועדון הקהילתי "י.ע.ל." (להלן: המועדון) אכן הוקם. בתחילת חודש אוגוסט 2005 הודיע ראש העיר כי לאור פניות של תושבים הגרים בשכנות למועדון בדבר מטרד רעש והימצאות של פסולת מרובה במתחם, ובשל תופעה של שתיית אלכוהול במקום, הוחלט כי במועדון תוכלנה להתקיים פעילויות תרבות, אך הוא ייסגר, ככל שהדבר נוגע לקיום אירועים. לאור טענות לפיהן העמותה אינה פועלת כאמור, החליטה העירייה ביום 21.9.05 כי ניהול המועדון יועבר לידיה של חברה שתפעל מטעם העירייה. היות שהעמותה לא העבירה את מפתחות המועדון לעירייה, החליפה העירייה את המנעול במקום ונעלה את המועדון.

בית-המשפט לעניינים מינהליים בבאר-שבע (כבוד השופט נ' הנדל) דחה את עתירתה של העמותה מהטעם שאין להיעתר לה באפיק המינהלי. נמצא לבית-המשפט כי הסכסוך נוגע לתנאי ההסכם בין העמותה לעירייה, ולמשמעות המשפטית של הפרת תנאי זה או אחר בהסכם. לפיכך, קבע בית-המשפט כי "סלע המחלוקת בין הצדדים מצוי בנתיב של דיני החוזים ולא בנתיב של המשפט המינהלי", ולכן "יש לבחון את התנהגות העירייה על-פי אמות-המידה של ההסכם הפרטני ביניהם ולא על-פי מקור עצמאי שבדין". עוד העיר בית-המשפט כי ממילא לוקה העתירה בשיהוי.

בערעורה מלינה המערערת על שני הטעמים שעמדו ביסוד החלטת בית-המשפט המחוזי. היא טוענת כי דין הסוגיה להתברר כעתירה מינהלית, שכן העירייה פעלה בכובעה כרשות מינהלית, וכי לעניין זה, לא השתהתה בהגשת העתירה. העירייה מצידה גורסת כי אין מקום להתערב בפסק-הדין.

דין הערעור להידחות.

לא מצאנו כי יש לשנות מהחלטתו של בית-המשפט קמא לסווג את ביטול הקצאת המקום על-ידי העירייה לעמותה כפעולה מתחום המשפט הפרטי, שדינה להתברר כמחלוקת חוזית. משכך, בדין דחה בית-המשפט את העתירה בהיעדר סמכות. עם זאת, בשים לב לנסיבות ולאור נכונותה של העירייה לסייע במציאת פתרון לקיום פעילויותיה התרבותיות של העדה האתיופית בעיר, נתבקשה העירייה להגיש הודעה מעדכנת בעניין זה.

כבר בדיון שהתקיים בפנינו ביום 11.7.07, עדכנה העירייה כי המועדון מופעל כיום על-ידי חברת "כיוונים" בפיקוח העירייה ובשיתוף נציגים בני הקהילה האתיופית בעיר. בהודעה מעדכנת שהוגשה ביום 6.9.07 ציינה העירייה כי המועדון ממשיך לפעול במתכונת זו, וכי במקביל היא סייעה לנציגי הקהילה האתיופית – שאינם חלק מהעמותה המערערת – להתקשר עם בעל מקום פרטי שבו יוכלו לקיים את אירועי השמחות של בני הקהילה. בהודעתה הדגישה העירייה כי המ דובר במחווה של רצון טוב, וכי המקום ינוהל על-ידי נציגי הקהילה, וללא התערבותה של העירייה "בעניין פרטי זה".

יש לברך על פעולותיה של העירייה למציאת מענה לצרכי חברי הקהילה האתיופית בעיר, ואנו תקווה כי מגמה זו תימשך. עם זאת, כאמור, בדין קבע בית-המשפט קמא כי אין מקום לברר את הסכסוך בין העמותה לבין העירייה בערכאה זו, ועל-כן, דין הערעור להידחות. אין באמור כדי לקבוע דבר לעניין בירורה של המחלוקת במישור החוזי. בנסיבות העניין, אין צו להוצאות.
