פסק-דין

השופטת א' חיות:

זהו ערעור על פסק-דינו של בית המשפט לענינים מנהליים בנצרת לפיו נדחתה עתירתה של המערערת לבטל היתר בניה להקמת מתקן פוטו-וולטאי שניתן על-ידי המשיבה 1 בטענה כי הוצא שלא כדין נוכח גובהו העולה על המותר לפי תכנית מתאר ארצית.

בפסק-הדין נדרש בית המשפט לשורה של טענות-סף שהעלו המשיבים ובהן - השתק עילה, שיהוי, אי-צירוף משיבים רלוונטיים והיעדר זכות עמידה, וקיבל אותן אחת לאחת.

בסעיף 19 לפסק הדין ציין בית המשפט כי די בכך על מנת לסלק את העתירה על הסף אך למעלה מן הדרוש נתן דעתו גם לטענת אי-החוקיות לגופה ודחה אותה בקובעו, בין היתר, כי הטענות שהועלו בענין זה על ידי המערערת לוקות בקטנוניות ובקנטרנות וכי מדובר בזוטי-דברים, בהינתן העובדה כי מדובר בסטיה של 1 ס"מ מן הגובה הקבוע בתוכנית או לכל היותר בסטיה של 6 ס"מ.

לא ראינו צורך להתייחס לטענות שהעלתה המערערת בערעורה לגופם של דברים אליהן, כאמור, התייחס בית-המשפט קמא למעלה מן הדרוש. זאת בלא להביע דעה בהקשר זה, לרבות לגבי השאלה מה משמעה של חריגת סנטימטר או סנטימטרים ספורים מן התמ"א.

כבית המשפט קמא אף אנו סבורים כי די היה בקבלת כל אחת מן הטענות המקדמיות על מנת לדחות את העתירה על הסף. מטעם זה הערעור נדחה. המערערת תשלם לכל אחד מהמשיבים שכר טרחת עורך-דין בערעור בסך 10,000 ש"ח.
