פסק דין

1.תביעה כספית שהוגשה מכוח זכויות שנקבעו בפסק בוררות – האם הערעור על פסק הדין שניתן במסגרתה הוא בזכות או ברשות? זו השאלה שעולה בבקשה דנן לסילוק על הסף של הערעור שבכותרת. בקשה זו הועברה לטיפולי לאחרונה עקב חילופים בלשכת הרשמים.

2.הערעור נסב על פסק דינו של בית המשפט המחוזי בירושלים מיום 5.11.2017 (ת"א 57016-11-16, כבוד השופט מ' בר-עם). פסק הדין ניתן בהמשך להליך בוררות שהתקיים בין הצדדים בעקבות טענה של המערערת כי המשיב פלש לנכס מקרקעין שבבעלותה. ביום 10.11.2014 ניתן פסק בוררות בגדרו נקבע כי למשיב אין זכויות במקרקעין וכי עליו לשלם למערערת דמי שכירות בגין השימוש בהם "לפי הערכת שמאי שימנו הבוררים". פסק הבוררות אושר בבית המשפט המחוזי ביום 1.7.2016 (הפ"ב 43483-12-14, כבוד השופט ב' גרינברג).

3.בהמשך לכך, הגישה המערערת לבית המשפט המחוזי תביעה לתשלום דמי שכירות ראויים בגין המקרקעין בסך של 10,361,186 ש"ח "על יסוד עילת פסק בוררות", כהגדרתה. בית המשפט המחוזי דחה את התביעה על הסף בקבעו כי פסק הבוררות הוא למעשה "פסק ביניים" וכי הליך הבוררות טרם הסתיים. המערערת הגישה כאמור ערעור על פסק דינו של בית המשפט המחוזי.

4.לטענת המשיב יש לסלק את הערעור על הסף נוכח הוראת סעיף 38 לחוק הבוררות, התשכ"ה-1969 (להלן: חוק הבוררות) ופרשנותו של סעיף זה בפסיקתו של בית המשפט העליון אשר החילה אותו בהרחבה על ענייני בוררות אף אם הם אינם מוגדרים מפורשות במסגרת חוק הבוררות.

5.המערערת מצידה מתנגדת לבקשה. לטענתה, התביעה שהגישה היא חיצונית להליך הבוררות והוגשה מכוח סעיף 39 לחוק הבוררות הקובע כי "אין בהוראות חוק זה כדי למנוע הגשת תובענה לבית המשפט על פי הזכויות והחיובים שנקבעו בפסק בוררות לפי חוק זה או בהכרעה שניתנה על יסוד הסכם בעל-פה". משכך, לטענתה, הליך הבוררות אינו נושא ההליך המשפטי שנדון בבית המשפט המחוזי ולכן קיימת לה זכות ערעור.

6.לאחר שעיינתי בבקשה, בתגובה לה ובשאר החומרים שהונחו בפני, הגעתי לכלל דעה כי הוראת סעיף 38 לחוק הבוררות אכן חלה בענייננו, ולפיכך יש לדחות את הערעור שהוגש.

7.כידוע, הוראת סעיף 38 לחוק הבוררות קיבלה פרשנות רחבה בפסיקתו של בית משפט זה (ראו: ע"א 4886/00 גרוס נ' קידר, פ"ד נז (5) 933 (2003) (להלן: עניין גרוס)). בהקשר זה נפסק כי סעיף 38 לחוק הבוררות חל לא רק על החלטות בענייני בוררות המנויים במפורש בחוק הבוררות, אלא גם על "החלטות חיצוניות" שבמרכזן עומדים ענייני בוררות. עוד נפסק, וזה חשוב לענייננו, כי סעיף 38 לחוק הבוררות יחול גם על הליך הנסב על ביצועו ומי מוש ו של פסק בוררות (ראו: ע"א 1196/11 בן שמן, מוש ב עובדים להתיישבות חקלאית שיתופית בע"מ נ' פישלר (4.5.2011) (להלן: עניין בן שמן); בש"א 3960/11 בן שמן, מוש ב עובדים להתיישבות חקלאית שיתופית בע"מ נ' פישלר (11.7.2011); ע"א 7739/11 קרמיטל אי.אל בע"מ נ' וילאר נכסים (1985) בע"מ (11.3.2012)). פרשנות זו מחזקת את התכליות המונחות ביסודו של סעיף 38 לחוק הבוררות, ובהן ייעול ההליכים, החשתם וצמצום ההתערבות של בתי המשפט בענייני בוררות. יש בה גם למנוע הבחנה לא מוצדקת בנוגע לאופן הערעור על החלטות הקשורות להליך הבוררות, ובענייננו למנוע מצב בו החלטה המאשרת פסק בוררות הייתה ניתנת לערעור ברשות בלבד ואילו החלטה העוסקת במימושו הייתה ניתנת לערעור בזכות (ראו: עניין גרוס, בפסקה 12; עניין בן שמן, בפסקה 5).

8.במקרה דנן, עניינה של התביעה שהגישה המערערת הוא בביצועו ומימושו של פסק הבוררות, היינו בתשלום דמי השכירות בהתאם לחיובים בפסק הבוררות. בהתאם לכך, בית המשפט המחוזי התייחס לפסק הבוררות כנקודת המוצא למחלוקת ואף ציין בפסק דינו כי הסוגיה הטעונה הכרעה היא פרשנותו של פסק הבוררות. בנסיבות אלה הרי שקיים קשר ענייני הדוק בין פסק הבוררות לבין פסק דינו של בית המשפט המחוזי ומשכך סעיף 38 לחוק הבוררות חל בעניינו. נוכח האמור, ערעור על פסק הדין טעון רשות, ומשבחרה המערערת להגיש ערעור בזכות תחת הגשת בקשת רשות ערעור, אין מנוס מלהורות על דחיית ההליך על הסף.

9.יצוין כי המערערת לא עתרה למתן הארכת מועד להגשת בקשת רשות ערעור, ומכל מקום אין בהחלטתי זו כדי למנוע ממנה להגיש בקשה כזו. ככל שתוגש בקשת ארכה כאמור, היא תידון בהתאם לאמות המידה המקובלות.

10.אשר על כן, אני מורה על דחייתו של הערעור. המערערת תישא בשכר טרחת המשיב בבקשה שבפניי בסך של 3,500 ש"ח.
