פסק-דין

הנשיא א' גרוניס:

1.בית המשפט המחוזי בתל-אביב-יפו (כבוד השופט הבכיר י' פרגו) דחה תובענה שהוגשה על ידי המערערת נגד המשיבות. בתובענה נטען, בין היתר, כי המשיבות ייבאו ארצה מוצרים מזויפים, שנשאו שלא כדין סימני מסחר רשומים של המערערת. התובענה נדחתה לאחר שבית המשפט קבע כי הוכח שהיצרן בסין, ששלח את המוצרים למשיבה 1, טעה כאשר כלל במשלוח מוצרים שכלל לא הוזמנו על ידי המשיבה 1.

2.אין מחלוקת בין בעלות הדין כי על היבואן הישראלי מוטל היה הנטל להוכיח כי המוצרים המזויפים נשלחו אליו בטעות, על אף שלא הזמינם מן היצרן בסין. דעתנו היא כי בנסיבות העניין אכן הנטל היה מוטל על היבואן. ברם, בניגוד לקביעתו של בית משפט קמא, אנו סבורים שהנטל לא הורם. הטעמים לכך הם אלה:

א) היבואן, היינו המשיבה 1, לא הציג כלל בפני בית המשפט את מסמכי ההזמנה. אילו מסמכים אלה הוצגו ניתן היה לוודא מה בדיוק הזמינה המשיבה 1 מסין.

ב) המשיבה 1 לא העידה את העד שהיה מעורב מטעמה בהזמנה מסין. מ דובר בבעלה של המשיבה 2. זו האחרונה הייתה המנהלת של המשיבה 1. היא הובאה כעדה מטעם המשיבים, אף שלא הייתה מעורבת ביבוא המסוים.

ג) בית המשפט המחוזי סמך על מסמך ששלח היצרן הסיני בו הוא כתב שנפלה אצלו טעות, כאשר כלל במשלוח את המוצרים המזויפים, על אף שאלה לא הוזמנו על ידי המשיבה 1. לא היה מקום לקבל את הראיה האמורה, היא המסמך של היצרן. זאת, משום שעורך המסמך לא הובא לעדות.

מכאן, שהיה מקום לקבל את התובענה ולקבוע כי המשיבה 1 הפרה את זכויותיה של המערערת.

3.עם זאת, אין מקום להשית חיוב על המשיבה 2, ששימשה כמנהלת של המשיבה 1. כאמור, המשיבה 2 לא הייתה מעורבת ביבוא מסין, אלא בעלה היה המעורב בעניין.

4.סיכומו של דבר שיש לקבל את הערעור, הן בנוגע לעילה והן בנוגע להשתת חיוב כספי על המשיבה 1.

הערעור מתקבל איפוא. המשיבה 1 תשלם למערערת סכום של 100,000 ש"ח בצירוף הפרשי הצמדה וריבית מיום הגשת התביעה – 25.11.2004 – ועד לתשלום בפועל. כמו כן ניתן בזה צו מניעה האוסר על המשיבה 1 לייבא, לשווק או לייצר מוצרים המפרים את סימני המסחר של המערערת. בנוסף, תישא המשיבה 1 בשכר טרחה בשתי הערכאות בסכום של 30,000 ש"ח.

ניתן היום, ו' בטבת התשע"ד (9.12.2013), בנוכחות באי כוח בעלות הדין.
