פסק-דין

הערעור שבפנינו נסב על פסק דינו של בית המשפט המחוזי, שדחה תביעת לשון הרע שהגיש המערער כנגד כל המשיבים בגין שתי כתבות שפורסמו בעיתון "ידיעות אחרונות" ו"הארץ".

לאחר ששמענו את טיעוני הצדדים ועיינו בחומר שהונח לפנינו,לא מצאנו להתערב בפסק דינו של בית משפט קמא ואנו מאמצים אותו מכוח סמכותנו לפי תקנה 460(ב) לתקנות סדר הדין האזרחי, התשמ"ד-1984.

נוסיף ונאמר, כי לטעמנו לא היה מקום מלכתחילה להגשת התביעה ולנהלה בדרך בו התנהלה, ובווודאי שלא היה מקום להגשת הערעור.

אשר על כן, אנו דוחים את הערעור.

המערער ישא בשכר טרחת המשיבים 6-1 והמשיבים 4-1 (בת"א 759/97) בסך 11,600 ש"ח, בשכר טרחת המשיבים 8-7 בסך 5,800 ש"ח וכן בשכר טרחת המשיבים 11-10 בסך 5,800 ש"ח.
