המשנה לנשיאה א' ריבלין:

המערער, יליד שנת 1945, נפגע בתאונת-דרכים לפני שנים רבות, בהיותו בן 42 שנים. בבית-המשפט נתעוררה מחלוקת בשאלה אם הפגיעה שממנה סבל המערער אירעה כתוצאה מתאונת-דרכים, כמשמעותה בחוק פיצויים לנפגעי תאונות-דרכים, התשל"ה-1975. בית-המשפט המחוזי מצא, כי אכן מ דובר בתאונת-דרכים. התאונה הוכרה גם על-ידי המוסד לביטוח לאומי כתאונת עבודה, ונכותו הרפואית של המערער הועמדה שם על 44% לצמיתות.

מספר שנים לאחר התאונה, וללא קשר אליה, אובחנה אצל המערער מחלת לב איסכמית. מומחה רפואי בתחום הקרדיולוגיה, שהתמנה מטעם בית-המשפט, העריך כי נכותו הנוספת של המערער, שאינה קשורה לתאונה, היא בשיעור של 25%. בחודש ינואר 2002 עבר המערער אירוע מוחי והמומחה הרפואי מצא כי קיימת החמרה במצבו הנוירולוגי של המערער, וכי הנכות הקרדיאלית נותרה בעינה. בית-המשפט המחוזי פסק למערער פיצויים בגין נזקי התאונה ומצא כי הפיצוי, כך נראה, "נבלע" בכל מקרה בתגמולי המוסד לביטוח לאומי.

המערער מלין על מיעוט הפיצויים שנפסקו לו. בערעורו הוא משיג כנגד שומת הפגיעה התפקודית, כנגד הבחירה בבסיס השכר ששימש לחישוב הפיצויים, כנגד מיעוט הפיצויים בראשי נזק אחרים וכנגד טעויות חישוב שנפלו, לדבריו, בפסק-הדין.

אכן, בפסק-הדין נפלו טעויות חישוב בכל הנוגע להפסדי השכר של המערער ויש לערוך אותם מחדש. אלא, שבכך לא תם הקושי. במהלך הערעור ביקש המערער להתיר לו לצרף ראיות חדשות הנוגעות לשיעור הנכות כפי שנקבע על-ידי המוסד לביטוח לאומי. היססנו אם להתיר לו לצרף את הראיות בשלב זה של ההליכים, במיוחד לאור התקופה הארוכה שחלפה מאז התאונה ועד לסיום המשפט. אולם, נראה לנו, כי בנסיבות המיוחדות של המקרה, יהיה זה ראוי לעשות כך, שכן ברור היום לצדדים כי שיעור הנכות כפי שנקבע בפסק-הדין של בית-המשפט קמא שונה משיעור הנכות כפי שהתברר בדיעבד. שינוי זה עשוי להשפיע על חישוב הפיצוי בראשי נזק שונים, בהם הנזק הלא-ממוני; הוא עשוי גם להשפיע על גובה הגמלאות הצריכות ניכוי. כיוון שממילא יש צורך לערוך מחדש את חישוב הנזק, וכיוון שהצדדים חלוקים ביניהם באשר לנפקות השינוי בשיעורי הנכות הרפואית, אנו מקבלים את הערעור ומחזירים את הדיון לבית-המשפט המחוזי, על-מנת שיקבל את הראיות שהמערער מציג היום ועל-מנת שיפסוק מהי נפקותן של הראיות האלה, ועל-מנת שיערוך מחדש את החישוב בראשי הנזק הרלבנטיים ובמיוחד ראשי הנזק של אבדן השתכרות, ויכמת את שיעורי הניכויים כנדרש.

במובן זה מתקבל הערעור. בהליך זה אין צו להוצאות.
