לאחר שמיעת הערתנו ועמדתנו המשפטית, הסכים בא כוח המשיבה לקבלת הערעור במובן זה שהקביעה לפיה התביעה התיישנה, תבוטל, וההוצאות שנקבעו בערכאה הדיונית יבוטלו. התיק יוחזר לבית המשפט המחוזי לבירור התביעה לגופה, תוך שמירת כל טענות הצדדים למעט בנושא ההתיישנות.
