שתי טענות מרכזיות עמדו בבסיס המרצת הפתיחה שהגישה המערערת. האחת, הלכת השיתוף בנכסים חלה על המשיבה והמשיב 2, ועל כן נכסי המשיבה וחובות המשיב 2 משותפים לשניהם בחלקים שווים. השנייה, כי בית המשיבה הינו נכס שהוברח על ידי המשיב 2 למשיבה על מנת להעלימו מנושיו, על כן יש להכיר בו כנכס של המשיב 2.

בית המשפט המחוזי בתל אביב-יפו (כב' השופט י' אטדגי) ב פסק דין מפורט ומנומק דחה את טענות המערערת, בכל ראשי הטיעון. נקבע – בין היתר – כי המשיבים ניהלו בהפרדה מוחלטת את חייהם האישיים והכלכליים בעת רכישת הבית. נקבע בנוסף כי המשיבה הראתה בצורה ברורה, מפורטת ומדוקדקת כי כל כספי הרכישה של הבית היו ממקורותיה וכי המערערת לא סתרה ולא הפריכה כל נתון מהנתונים הרבים שהובאו בתצהירי המשיבה. משכך, נדחתה התובענה שהגישה המערערת.

בא כוחה המלומד של המערערת תקף, בחזית רחבה, את ממצאיו ומסקנותיו של בית המשפט המחוזי.

שקלנו את טיעוני הצדדים המפורטים בכתב ובעל פה. המחלוקת בין הצדדים היא עובדתית גרידא. פסק הדין של בית המשפט המחוזי התייחס לעיקרן של השאלות השנויות במחלוקת, והכריע בהן, אגב ניתוח מפורט. לא מצאנו – על פי אמות המידה הנהוגות בבית משפט זה –עילה להתערבותנו בהכרעותיו העובדתיות של בית המשפט המחוזי ובמסקנות המשפטיות הנגזרות מהן.

משכך אנו דוחים את הערעור, מטעמיו של בית המשפט המחוזי.

המערערת תישא בהוצאות המשיבה ובשכ"ט עו"ד בסכום כולל של 20,000 ₪.

המשיבה חזרה בה מן הערעור שכנגד בנושא ההוצאות והוא נדחה גם כן, ללא צו להוצאות.
