פסק-דין

1.זהו ערעור על פסק דינו של בית המשפט המחוזי בתל-אביב-יפו (כבוד השופטת ה' גרסטל), מיום 17.3.05, בה"פ 790/02. בפסק הדין נדחתה תביעת המערערים להצהיר כי הם בעלי זכות חכירה לדורות בחלק המקרקעין, הידועים כחלקה 226 בגוש 3636 המסומנים על גבי התשריט (נספח ג לתובענה) במספר 126א (להלן - הנכס).

2.לאחר שעיינו בכל החומר שבתיק ושקלנו את טענות הצדדים לפנינו, באנו למסקנה כי דין הערעור להידחות.

3.המערערים סמכו, למעשה, את תביעתם על התשריט (שנערך שלא לצרכי -רישום) שצירפו כנספח ג' לתובענה. לטענתם, תשריט זה נשלח אליהם על ידי המינהל (המשיב 1) בשנת 1964 (לבקשת בא כוחם דאז, עו"ד הררי), והוא מעיד, לטענתם, כי הם בעלי זכות החכירה לדורות בנכס נשוא התובענה. גודל השטח שבתשריט הוא כדונם, והוא כפול מהשטח אותו רכשו המערערים קודם לכן, ביום 12.3.64, מדוד ורוזטה רחמים.

4.עיון בשטר החכירה שנחתם בשנת 1963 בין הקרן הקיימת לישראל לבין רחמים, מראה כי הוא מתייחס לדירה בבית משותף, הממוקמת על מחצית חלקה 126 בגוש 3637 (להלן גם – מגרש 126). בסעיף 3 לתצהירה של גב' ביבי ליאנה מטעם המינהל, שלא נסתר, צוין כי גודלו של מגרש 126 כולו – בטרם שינוי מספרו בעקבות פיצול החלקה – היה כדונם. גב' ביבי הסתמכה בעניין זה על תב"ע נס/5, שפורסמה למתן תוקף בשנת 1955, ועל תשריט שהוכן ע"י מחלקת המיפוי של המינהל. מכאן, שהשטח שרכשו המערערים מרחמים, חצי המגרש, היה כחצי דונם. על כן, אין בתשריט משנת 1964 (נספח ג') שהמינהל המציא להם, לטענתם, כדי לקבל את גירסתם לפיה המינהל ביקש להקנות להם זכויות בשטח גדול יותר משרכשו הם מרחמים, החוכרים המקוריים של השטח (ואין טענה כי שילמו למינהל סכום נוסף על זה ששילמו לרחמים).

5.לאור האמור, הערעור נדחה.

המערערים ישלמו למשיב 1 הוצאות בסך 10,000 ש"ח.
