לאחר העיון ושמיעת הצדדים לא ראינו מקום להתערבות בפסק דינו של בית המשפט קמא, אך המ דינה בהגינותה הסכימה בהמלצתנו לוותר על ההוצאות גם בבית המשפט קמא נוכח מצבו של המערער, ועל כן יוחזר הסכום ששולם עד כה (30,000 ₪) בצירוף פירות כדין מיום פסק הדין. אין צו להוצאות בבית משפט זה. בכפוף לאמור איננו נעתרים לערעור.
