פסק-דין

1.לפנינו ערעור על פסק דינו של בית המשפט המחוזי בתל אבי ב-יפו (השופטת א' נחליאלי חיאט) בת"א 1882-09 מיום 19.6.2013, במסגרתו התקבלה תביעה כספית של המשיב נגד המערערים בגין חובות שנטלו ולא נפרעו, ואלה חויבו בסך כולל של 7,847,009 ש"ח.

2.לאחר שבחנו את טענות הצדדים בכתב ובעל-פה, ואת פסק דינו של בית המשפט המחוזי, הגענו לכלל מסקנה כי דין הערעור להידחות.

3.בעיקרו של דבר, אנו מאמצים את מכלול הממצאים העובדתיים והמשפטיים בפסק דינו של בית המשפט המחוזי מכוח הסמכות הנתונה לנו ב תקנה 460(ב) ל תקנות סדר הדין האזרחי, התשמ"ד-1984. לפי תקנה זו, בית המשפט ר שאי לדחות ערעור על סמך שמצא שלא נפלה טעות עובדתית ומשפטית בפסק דינה של הערכאה הדיונית.

1.במקרה שלפנינו, פסק דינו של בית המשפט המחוזי הוא פסק דין מפורט אשר בחן אחת לאחת את הטענות שנטענו בפניו, קבע ממצאים וביסס את מסקנותיו על-פי הדין. טענותיהם של המערערים מכוונות כולן כנגד עניינים עובדתיים ומשפטיים שנבחנו באופן מלא ומדוקדק בפסק דינו של בית המשפט המחוזי שעליו אנו סומכים את ידינו במלואו.

2.אשר על כן, הערעור נדחה. המערערים ישאו בשכר טרחת עורכי דינו של המשיב בסך של 50,000 שקל.
