בית המשפט המחוזי בתל אביב-יפו (השופטת א' נחליאלי-חיאט) נעתר לבקשת המשיב והורה על סילוק תביעת המערער על הסף, תביעה שבה תבע מן המשיב סך של 7,885,480 ₪.

שנים ארוכות מתדיינים המערער והמשיב בכל הערכאות. המערער הוא פושט רגל, ולטענת המשיב הוא חייב לו ולנושים אחרים עשרות מיליוני שקלים.

בית המשפט המחוזי ציין את ההלכה הפסוקה הנוהגת באשר לסילוק על הסף, שהוא כידוע סעד קיצוני שבית המשפט יעשה בו שימוש רק במצב חריג ויוצא מן הכלל, כאשר ברור לחלוטין שגם אם יוכיח התובע את כל טענותיו, לא יוכל לזכות בסעד המבוקש. בית המשפט המחוזי נפנה לבחון את טענות המערער בכתב התביעה, והראה כי טענותיו חוזרות להתנהלות המשיב מעת פתיחת חשבונו של המערער אצלו, לפני כ-15 שנה, עד למועד הגשת תביעת המשיב נגדו. המערער סקר בתביעתו בפרוט רב את כל ההליכים המשפטיים בין הצדדים ומגעים שניהלו ביניהם. בית המשפט המחוזי בדק ומצא שכל טענות המערער בכתב התביעה הועלו פעם אחר פעם במשך שנים בהליכים משפטיים שונים, טענות שנדונו והוכרעו בעבר בבית המשפט המחוזי ואושרו ב פסק דין של בית המשפט העליון. פסקי הדין שניתנו בהליכים שבין הצדדים הם חלוטים, ולדברי בית המשפט המחוזי אין לאפשר פעם נוספת דיון באותן טענות ממש על בסיס תשתית עובדתית זהה, על סמך פרוטוקולים שהיו לפני בתי המשפט עובר למתן פסקי הדין. לאחר דיון ממצה קבע בית המשפט המחוזי כי כל טענותיו של המערער בכתב התביעה נדונו ונדחו בעבר, בהחלטות שיפוטיות ובפסקי דין חלוטים, וכי אינו יכול לשוב ולתבוע את המשיב בגין אותן עילות פעם נוספת, מחמת מעשה בית-דין.

למקרא פסק הדין של בית המשפט המחוזי, סיכומי המערער והמשיב בערעור לפנינו, ולמשמע השלמת טיעוניהם בעל-פה, באנו לכלל דעה כי אין מקום לדחות את הממצאים העובדתיים שנקבעו בפסק הדין. ממצאים שקבע בית המשפט המחוזי תומכים במסקנתו המשפטית על אודות קיומו של מעשה בית-דין, ואין לגלות בפסק הדין טעות שבחוק. לפיכך החלטנו, בהתאם לתקנה 460(ב) לתקנות סדר הדין האזרחי, התשמ"ד-1984, לדחות את הערעור. המערער ישלם למשיב הוצאות בסך של 10,000 ₪.
