המשנה לנשיאה א' ריבלין:

שני הערעורים מכוונים נגד פסק-דין של בית המשפט המחוזי בתל-אביב-יפו (כבוד סגנית הנשיא ד' פלפל) שבו חויבה קרנית לפצות את המערער 1 בע"א 7527/07 (להלן: המערער), יליד 1964, בגין נזקי גוף שנגרמו לו בתאונת דרכים שארעה בתאריך 10.6.1997 (מ דובר בתאונת "פגע וברח" שהוכרה גם כתאונת עבודה). המערער משיג על מיעוט הפיצויים שנפסקו לו, ומתמקד בנושא הפיצוי בגין הפסד ההשתכרות, בגין צרכי הניידות בעתיד ובגין עזרת צד ג'. קרנית מלינה על הפיצוי שנפסק בראש הנזק של דיור. לאחר שבחנו את טענות הצדדים ושמענו את הטענות בעל-פה החלטנו להתייחס למספר נקודות כדלקמן.

בעקבות התאונה נפגע המערער בכל חלקי גופו, והנכות הצמיתה שנקבעה לו מתבטאת בפגיעה בקרסול. הנכות הרפואית היא בשיעור של 20%, ובית המשפט המחוזי קבע, לאור הנתונים שהובאו לפניו לגבי המערער ולאור קביעות המוסד לביטוח לאומי, כי הנכות התפקודית היא בשיעור של 30%. בית המשפט נדרש בהרחבה לסוגיית בסיס השכר לצורך החישוב, ובחן אחד-לאחד את מרכיבי השכר השונים, אך המערער סבור כי בית המשפט צריך היה להגדיל את בסיס השכר לאור הטבות מסוימות שניתנו לו כחלק מעבודתו. לא מצאתי בטענות המערער בעניין זה עילה להתערבותה של ערכאת הערעור.

עם זאת, המערער מעלה בצדק טענה לעניין פסיקת הפיצוי עבור הפסד השתכרות בעבר. במסגרת הדיון בשאלת הקטנת הנזק קבע בית המשפט המחוזי שהמערער לא היה מסוגל לעבוד, ובוודאי לא למצוא עבודה חדשה, עד תחילת שנת 2002; זאת, לאור אישורי המחלה שהציג ולאור הניתוחים שעבר במהלך התקופה (המערער עבר סדרת ניתוחים בין השנים 1997 ו- 2003). עם זאת, בחישוב הפיצוי עבור הפסדי העבר נסמך בית המשפט המחוזי על אחוזי הנכות הרפואית שנקבעו לאורך התקופה, שהשתנו מעת-לעת (במועדים מסוימים נקבעה נכות של 100% ובמועדים אחרים נקבעו שיעורי נכות אחרים). יצוין עוד כי המערער לא יכול היה לחזור לעבודתו הקודמת כמנהל עבודה, ולאחר התאונה – עד לשנת 2001 – הוא למד הנדסאות בניין כחלק מתהליך השיקום (המוסד לביטוח לאומי השתתף במימון הלימודים). נראה לי כי בנסיבות העניין היה מקום לחשב את הפיצוי, ביחס לתקופה זו (מיום התאונה ועד תחילת שנת 2002), לפי ההנחה שהמערער לא היה מסוגל לעבוד. משמעות הדבר היא שיש לתקן את החישוב כך שהפיצוי עד לחודש פברואר 2002 (כולל) ייקבע לפי 100% הפסד השתכרות, ולאחר מכן – לפי דרך החישוב של בית המשפט המחוזי.

המערער צודק גם בטענתו כי לא היה מקום לנכות מן הפיצוי שנפסק לו לפי הפסד השתכרות של 30%, את הסכומים שהשתכר מעבודות מסוימות לאחר התאונה; שהרי עצם החישוב לפי 30% מניח את יכולתו לעבוד ולהשתכר. יובהר: כאשר קיימים נתונים לגבי השתכרותו האקטואלית של הנפגע עקב התאונה, ונתונים אלה משקפים לפי התרשמותו של בית-המשפט את יכולת ההשתכרות האמיתית שלו, ניתן לחשב את סכום הפיצוי על-ידי הפחתת סכום ההשתכרות עקב התאונה מבסיס השכר המבטא את יכולת ההשתכרות, אלמלא התאונה. לעומת זאת, כאשר לא קיימים נתונים לגבי השתכרות אקטואלית של הניזוק עקב התאונה, או שבית-המשפט לא רואה בנתונים שמוצגים לו כמבטאים את יכולת ההשתכרות לאשורה, הדרך לחשב את הפיצוי היא להיעזר באחוזי הפגיעה ביכולת ההשתכרות – כפי שהם נקבעים לפי חוות-הדעת והראיות הרלבנטיות. ברור שכאשר ננקטת הדרך השנייה, אין להפחית, בנוסף, גם סכומים שהרוויח הניזוק בפועל מעבודתו לאחר התאונה, שכן יהא בכך משום הפחתה כפולה, עד כדי מצב אפשרי שבו לא יוותר לניזוק כל פיצוי בגין הפסד השתכרות (כך, למשל, אם נקבע הפסד השתכרות של 50% מבסיס שכר של 5,000 ש"ח, ותופחת בנוסף משכורתו האקטואלית של הניזוק לאחר התאונה בשיעור של 3,000 ש"ח – לא יינתן פיצוי חרף העובדה שכושר ההשתכרות שלה ניזוק נפגע לפי כל אמת מידה).

בנסיבות העניין יש אפוא לבטל את ניכוי הסכומים שהשתכר בחברת "דרכים", בחברת הטלמרקטינג "טלאול" ובחברת "ישראבטון" (עמ' 21 לפסק-הדין של בית המשפט המחוזי).

לא מצאנו מקום להתערבות נוספת בפסק-הדין של בית המשפט המחוזי. אמנם הפיצוי בראש הנזק של הוצאות דיור מופרז בנסיבות העניין, אולם מנגד מצאנו שבראשי נזק מסוימים (ובמיוחד הפגיעה בניידות וההיזקקות לעזרת הזולת) בחר בית המשפט בדרך הצמצום, והתוצאה הכוללת אינה מצדיקה התערבות.

התוצאה היא שע"א 7527/06 מתקבל בחלקו, כמפורט לעיל, וע"א 8267/06 נדחה. קרנית תישא בהוצאות המשפט של המערערים וכן בשכר טרחת עורך-דין בסכום של 15,000 ש"ח.
