המשנה לנשיאה א' ריבלין:

1.המשיב (המערער שכנגד), יליד שנת 1957, עבר בשנת 1996 ניתוח אלקטיבי בבית החולים המערער (המשיב שכנגד), שבמהלכו נעשתה כריתה חלקית של ראש הרדיוס במרפק של היד הימנית. זאת, עקב כאבים באזור שמהם סבל על רקע העובדה שבילדותו שבר את המרפק. לאחר הניתוח חלה הידרדרות במצבה של היד עד שבשנת 2001 לא נותר בה כושר תפקודי והיה צורך לקטוע אותה. המשיב הגיש תביעה בגין הנזק שנגרם לו, כשעיקר טענותיו נסב על רשלנות בביצוע ההרדמה לקראת הניתוח ולחלופין, על אי-מסירת המידע הדרוש לצורך הסכמה מדעת.

2.בית המשפט המחוזי דחה את הטענות בדבר רשלנות בביצוע ההרדמה והניתוח. המשיב משיג על כך בערעור שכנגד אך לא מצאתי מקום להיעתר לערעורו בעניין זה. מסקנתו של בית המשפט המחוזי נתמכת, בין השאר, בחוות-הדעת של המומחית הרפואית שמונתה על-ידו. יש לציין כי בנסיבותיו של המקרה הנדון אין וודאות לגבי הסיבה הברורה לנזק שנגרם למשיב. המומחה מטעם המשיב ייחס את ההידרדרות במצב היד לנזק עצבי שנגרם במהלך ההרדמה, ואילו המומחה מטעם בית החולים שלל קשר בין הניתוח או ההרדמה לבין הנזק, והציע סיבות אפשריות שונות לנזק העצבי. בית המשפט המחוזי לא ראה לקבל את טענות המשיב בנושא ההרדמה, וקבע לפי החומר שבא לפניו כי ההרדמה נעשתה לפי השיטה המכונה IV BLOCK. בית המשפט קבע עוד, לאחר שבחן את חווֹת-דעת המומחים, כי ההסבר למהלך הקליני במקרה זה הוא שהמשיב סבל מסיבוך הקרוי RSD (או CRPS). מ דובר בתגובת-יתר של מערכת העצבים לטראומה, המתרחשת אצל 0.3 עד 0.5 אחוז מהמנותחים. לתסמונת זו, כך צוין, יש מספר גורמים אפשריים, והיא תלויה בין היתר במבנה האישיות של החולה. המומחית מטעם בית המשפט סברה כי סיבוך זה הוא ההסבר המסתבר לנזקו של המשיב, בית המשפט המחוזי אימץ עמדה זו, ואנו לא שוכנענו כי קמה עילה להתערב בכך.

3.הממצא בדבר התקיימותה של תסמונת ה- RSD במקרה זה, והקביעה כי טענות שונות שהעלה המשיב לא הוכחו, הובילו את בית המשפט המחוזי לדחות את עיקר גרסת-הרשלנות של המשיב. יצוין כי במקרה זה לא הוכח מהו המקור לתסמונת ה- RSD, והועלו בהקשר זה אפשרויות שונות (ובהן: פגיעה עצבית שנגרמה בניתוח, החתך, הדקירה של מחט ההרדמה, השימוש בחסם עורקים במהלך ההרדמה או התפרים שגירו את העור). העמימות בעניין זה הותירה את עילת התביעה – בלתי-מוכחת. בית המשפט המחוזי פסק בסופו של יום, לאור תשתית הראיות והעדויות שבאה לפניו, כי אירוע-הנזק הוא תוצאה של סיבוך נדיר שלא ניתן היה לצפותו או למנעו. המשיב מעלה שורה של טענות החוזרות למעשה על גרסת-הרשלנות שהציג בערכאה המבררת, וכן הוא שב וטוען לגבי תחולתן של חזקות הרשלנות (מכוח סעיפים 38 ו- 41 לפקודת הנזיקין או מכוח נזק ראייתי). ואולם כאמור לא שוכנענו בקיום עילה להתערבות בסוגיה זו.

4.עם זאת, בית המשפט המחוזי נעתר לתביעה בעילה של היעדר הסכמה מדעת. על כך מלין בית החולים בערעורו ולאחר שבחנתי את טענותיו ראיתי לנכון לדחותן חרף קושי מסוים שמצאתי לגבי הקשר הסיבתי. במקרה זה חתם המשיב על טופס הסכמה לניתוח אך במשפט התברר – מדבריו של הרופא-המטפל עצמו – כי לא נאמר למשיב דבר באשר לסיכון של RSD. עוד התברר מדבריו כי לא נהוג להעלות את האפשרות הזו לפני המטופלים עובר לביצוע ניתוח. לדברי הרופא-המטפל, ההימנעות הזו נובעת מן הפן הנפשי שכרוך בתסמונת ומן החשש כי "הדיבור על זה יכול לגרום לתופעה עצמה". עוד נטען על-ידי בית החולים כי נדירותה של התסמונת, כלליותה והעובדה שהמשיב עבר קודם לכן טיפולים מורכבים נוספים והתאושש באורח תקין, מובילים למסקנה כי לא היה מקום לדווח למשיב על הסיכון של RSD. בית המשפט המחוזי לא קיבל טענות אלה בהתייחסו לעובדה כי מ דובר במקרה זה בניתוח אלקטיבי וכי הסיבוך אמנם מתרחש לעיתים רחוקות אך הוא חמור ועלול לשלול מן הגפה כל יכולת תפקוד.

לא שוכנעתי כי נפלה טעות במסקנה זו של בית המשפט בנסיבות העניין, ויודגש כי די לעיין בטענותיו של הרופא-המטפל כדי להבין שתופעת ה- RSD היא סיכון בעל-משמעות דווקא בניתוח שאינו מסובך ואינו חיוני: "הניתוח הזה הוא ניתוח פשוט ואני לא חושב שיש איזושהי סיבה או גורם כלשהו פרט לנושא של RSD שהיה מונע לבצע ניתוח כזה שוב". מדבריה של המומחית מטעם בית המשפט עולה כי תופעת ה- RSD, שאמנם אינה שכיחה אך גם אין לומר שהיא מאד נדירה, עלולה להפוך פרוצדורה פשוטה יחסית לאסון מבחינתו של המטופל. לכן לא מצאתי להתערב בקביעתו של בית המשפט המחוזי שלפיה היה מקום לספר על סיכון זה למטופל, וברור כי בהקשר זה נבחן כל מקרה לפי נסיבותיו ולפי המידע שמונח לפני בית המשפט (השוו ע"א 718/06 סתחי נ' מדינת ישראל (טרם פורסם, 30.10.2007)). יודגש: עצם העובדה שבמקרה זה לא ניתן לזהות באופן מדויק את ה"טריגר" לתסמונת ה- RSD אין בה כדי לגרוע מן העובדה הברורה שמ דובר בסיבוך של הניתוח שבא בעקבות הניתוח. כדברי המומחית מטעם בית המשפט: ""מעולם לא אמרתי שאר.אס.די. מופיע ככה פתאום, אלא זו תוצאה של פעולה כירורגית". ברי כי חוסר היכולת לצפות את התרחשות הסיבוך אצל חולה מסוים, או חוסר היכולת לאתר במדויק את החלק בניתוח שעורר את התגובה, אין בהם כדי ללמד על היעדר חובה ליידע את החולה על הסיבוך, כפי שניסה בית החולים לשכנענו.

5.גם קביעותיו הנוספות של בית המשפט המחוזי בהקשר זה, לרבות בקשר לפן הנפשי של התסמונת, מקובלות עלי, אולם בעניין אחד התעורר בליבי ספק, והוא קביעתו של בית המשפט המחוזי שלפיה הוכח קיומו של קשר סיבתי בין אי-מתן ההסבר על סיכון ה- RSD לבין הסכמתו של המשיב לקיומו של הניתוח. בית המשפט המחוזי הסתמך בהקשר זה על עדותו של המשיב אולם בנסיבות העניין נוצר הרושם שמ דובר יותר במסקנה של "בדיעבד" מאשר בהערכה ריאלית של ההתנהגות בזמן-אמת. בהקשר זה ניתן להביא בחשבון, בין השאר, את השתלשלות העניינים (והכאבים) שהובילו את המשיב אל חדר הניתוח (כשבית המשפט המחוזי קבע כממצא ש"הייתה אינדיקציה לביצוע הניתוח להוצאת ראש הרדיוס הימני"), וכן את האופי הבלתי-שכיח והכללי של סיבוך ה- RSD. ואולם לא ראינו צורך להכריע בעניין זה כיוון שבית החולים לא העלה כל טענה בעניין זה בכתב הערעור או בסיכומי הערעור. לא נותר אפוא אלא לאשר את מסקנתו של בית המשפט המחוזי אף בעניין הקשר הסיבתי.

6.הצדדים העלו, מכאן ומכאן, השגות לעניין גובה הפיצויים שנפסקו. טענות אלה לא מצביעות על טעות בפסיקתה של הערכאה המבררת המצדיקה התערבות. נכותו הרפואית של המשיב היא בשיעור של 79% ובית המשפט העריך את הפסד כושר ההשתכרות בשיעור של 80% (לאחר תקופה מסוימת של אובדן מלא), כאשר בסיס השכר נקבע לפי ממוצע ההשתכרות בשנים שקדמו לתאונה. כל אלה הן קביעות סבירות בנסיבות העניין, והפיצוי המתקבל – 376,376 ש"ח לעבר ו- 506,459 ש"ח לעתיד, אינו מצדיק התערבות. גם הפיצוי בגין עזרת הזולת (91,200 ש"ח לעבר ו- 170,000 ש"ח לעתיד) ובגין כאב וסבל (600,000 ש"ח, כולל ריבית), אינן חורגים ממתחם הסבירות לאור התשתית הראייתית שהובאה.

התוצאה היא שהערעורים הנדחים. לאור זאת ישא כל צד בהוצאותיו.
