כל הדיון ואני מסכים והסברתי גם לילדים ולאמא.

ולאור ייחודיותו של המקרה דנן ומבלי שהדבר יהווה תקדים, הוסכם כי כנגד הפחתה של 400,000 ש"ח מפסק דינו של בית משפט קמא - מתוך הסכום שנפסק לאלמנה אביבה יקוטי - וכסכום כולל וסופי נכון להיום, שיוחזרו לחברת הביטוח אישי ישיר תוך 30 יום, יסולקו בזה שני הערעורים הדדית ללא צו להוצאות, וכן יסולקו כל טענות הצדדים לגבי הפרשים כאלה ואחרים.

הסר ספק, עם החזר הסך של 400,000 ₪ מסתיימים בזה ההתחשבנויות ההדדיות בין הצדדים.

אין צו להוצאות.

שיופקדו יוחזרו למפקידים.
