באי כוח הצדדים:

אנו טוענים בקצרה על דרך של סעיף 79 א' לאחר שבהמלצת ביהמ"ש הגענו להסכמה כדלהלן:

1.פסק הדין בערכאה קמא יבוטל על תוצאותיו (תשלומים ששולמו על פי פסק הדין, אם שולמו, יוחזרו תוך 120 יום).

2.חלף פסק דינה של ערכאה קמא יפסוק בית המשפט על דרך הפשרה כי הנתבעים והתובעים שכנגד (ה"ה לאטי וברקוביץ) ישלמו לתובעת והנתבעת שכנגד (א.פ. נחום חברה לבנין והשקעות בע"מ) הסך של 317,000 ₪ בצירוף הפרשי הצמדה וריבית מיום 1.2.09. מסכום זה יופחת הסך של 100,000 עד 250,000 ₪ נכון לתאריך הנ"ל בהתאם לפסק דין שינתן כאמור על דרך הפשרה לפי סעיף 79א' לחוק בתי המשפט [נוסח משולב] התשמ"ד 1984, לאחר שהצדדים יטענו בקצרה ובאופן פתוח בעניין ההפחתה. התשלום שיפסק ע"י בית משפט זה ישולם ע"י הנתבעים והתובעים שכנגד לתובעת תוך 120 יום.

3.מובהר בזה, כי בכפוף לביצוע הסכם זה, הסכם זה נועד לסילוק סופי ומלא של כל טענות ותביעות שיש לצדדים האחד כלפי משנהו. למען הסר ספק המשמעות היא כי הסכם מכירת הדירה תקף. הנתבעים והתובעים שכנגד ישיבו לתובעת את הערבויות הבנקאיות שברשותם מיד לאחר פסק דינו של בית משפט זה ובד בבד וכנגד החזרת הערבויות הבנקאיות, התובעת תמציא לנתבעים והתובעים שכנגד אישור המופנה לעירייה להעברת הדירה על שמם. כמו כן תמציא התובעת מכתב החרגה או הצהרה כי הדירה ממילא לא משועבדת לבנק מלווה ו/או כי השעבוד על המקרקעין הוסר.

4.איסור הדיספוזיציה שנקבע בהחלטת עיכוב הביצוע, יישאר על כנו עד לביצוע סופי ומלא של הסכם זה.

במסגרת הסמכות שניתנה לי על ידי הצדדים לפסוק על דרך הפשרה, ולאחר ששמעתי את טיעוני הצדדים, אני פוסק כי מהסכום של 317,000 ש"ח יופחת הסך של 160,000 ש"ח (מאה ושישים אלף).
