ערעור על החלטתו של בית משפט השלום בנתניה (כב' השופטת ס' קולנדר-אברמוביץ) מיום 22.10.2006, שלא לפסול עצמו מלדון בת.א. 9266/02.

1.בין הצדדים מתנהלת תביעה שהגישו המערערים כנגד המשיב וחברת נאווטיגו בע"מ לבית משפט השלום בנתניה. משלב מסוים של ההליך החל מערער 1 (להלן: המערער) לייצג את המערערים. התיק היה קבוע להוכחות ליום 23.10.2006. ביום 22.10.2006 הגישו המערערים בקשה לדחיית מועד הדיון, בטענה כי המערער אינו בקו הבריאות. בית המשפט דחה את הבקשה בקובעו כי "הדיון נקבע זה מכבר ולא ברור אם התובע יהיה חולה". בעקבות החלטה זו הגישו המערערים בקשה לפסילת בית המשפט. בבקשתם טענו המערערים כי בית המשפט חותר בכל דרך ליתן פסק דין כנגדם. נטען כי לא יעלה על הדעת שבית המשפט יורה למערער להופיע עם חום גבוה, שאינו מאפשר לו לחקור את עדי הנתבעים. לט ענת המערערים בית המשפט שם לו למטרה ליתן פסק דין בהעדרם ולחייבם בהוצאות, וכוונה זו עולה בברור לא רק מההחלטה בבקשה לדחיית מועד דיון, אלא משרשרת החלטות שניתנו בתיק.

2.בית המשפט, בהחלטתו מיום 22.10.2006, דחה את בקשת הפסלות. הובהר כי כפי שנקבע בהחלטה נשוא בקשת הפסלות, כלל לא ברור כי ביום הדיון עדיין יסבול המערער מחום גבוה, וכי הדיון נקבע זמן רב מראש. בכל מקרה, כך נקבע, אין בהחלטה כדי לקבוע מסמרות לעניין קביעת דעתו של בית המשפט לעניין התיק עצמו. ביום הדיון התבקש בית המשפט פעם נוספת לדחות את מועד הדיון מחמת מחלת המערער. הבקשה נדחתה, בנימוק שלא הוצג אישור רפואי הקובע שבאותו יום המערער אינו מסוגל להופיע. הדיון התקיים בהעדרם של המערערים, ועל כן החליט בית המשפט לקבל את התצהירים שהוגשו ללא חקירה, אולם מלפנים משורת הדין קבע כי הדיון ידחה למועד אחר. בנסיבות העניין הוחלט לחייב את המערערים בהוצאות הדיון בסך 1,500 ₪ ועוד 750 ₪ עבור כל אחד משלושת העדים שהתייצבו לדיון.

3.על החלטת בית המשפט בבקשת הפסלות הוגש הערעור שבפני. בערעור חוזרים המערערים על טענותיהם בבקשת הפסלות, ומוסיפים כי מקביעות בית המשפט, לפיהן הצהרות המערער כי הוא חולה אינן אמינות עליו, משתמעת קביעת עמדה נחרצת טרם עת באשר לאמינותו של המערער, שיש לה השלכה ישירה על ההליך המשפטי, המבוסס כולו על שיקול דעת ואמינות הגרסאות. לכן, סבורים המערערים, כי אין טעם להמשיך בהליך המשפטי בפני אותו מותב. עוד טוענים המערערים, כי גם החלטות קודמות של בית המשפט מעידות על מדיניות של איפה ואיפה מצד בית המשפט, כאשר בעוד בקשות המשיבים התקבלו כמות שהן, בקשות המערערים התקבלו בכפוף לחיוב בהוצאות. המערערים סבורים כי יש לפסול את בית המשפט ולו מפאת מראית פני הצדק, שאם לא כן, נחרץ גורל התביעה כנגדם.

4.לאחר שעיינתי בחומר שבפני, הגעתי לכלל מסקנה כי דין הערעור להידחות. טענות המערערים מכוונות רובן ככולן כנגד החלטות דיוניות שניתנו על ידי בית המשפט במסגרת ניהול ההליך. אפילו אתעלם מהשיהוי המונע העלאת חלק מן הטענות כיום, הרי שנפסק לא פעם כי אי שביעות רצונו של צד להליך מהחלטות שנתקבלו בעניינו אינה מקימה עילת פסלות, וכי הדרך לתקיפת החלטות אלה היא באמצעות הגשת ערעור או בקשת רשות ערעור-על פי סדרי הדין, כפי שעשו המערערים בחלק מהמקרים (יגאל מרזל דיני פסלות שופט (תשס"ו-2006) 178-174; ע"א 7186/98 מלול נ' ג'אן (לא פורסם); ע"א 10619/02 בן עמי נ' קידר (לא פורסם)). זאת ועוד, גם אם מדובר ברצף החלטות לרעת בעל דין, אין בכך כדי להקים עילת פסלות (מרזל, בעמ' 175; ע"א 6822/00 משלי נ' משלי (לא פורסם); ע"א 8681/03 בורשטיין נ' סטולמן (לא פורסם); ע"א 5803/04 מצדה חברה להנדסה בע"מ נ' בנק לאומי לישראל בע"מ (לא פורסם)). על מנת לפסול את בית המשפט, יש להראות כי יש בהחלטות משום "משחק מכור", המעיד כי בית המשפט אינו פתוח לשכנוע (מרזל, בעמ' 175)). במקרה הנוכחי לא מצאתי יסוד לטענה כי ההחלטות שקיבל בית המשפט בעניינם של המערערים, בין אם הן צודקות ובין אם הן מוטעות לגופן (ולעניין זה אין אני נצרכת), הינן חד צדדיות באופן שקיים חשש ממשי אובייקטיבי לכך שבית המשפט גיבש לעצמו עמדה סופית בעניין נשוא הדיון השיפוטי, ואין עוד טעם בהמשך רגיל של המשפט (ע"א 5792/02 גרבש נ' כונס הנכסים הרשמי (לא פורסם); ע"א 11871/05 חט'יב נ' בדארנה (לא פורסם)). כפי שציין בית המשפט בהחלטתו בבקשת הפסלות, דחיית בקשה לדחיית מועד דיון אין בה כדי להעיד על קביעת דעתו של בית המשפט לעניין התיק עצמו, והיא אינה חורצת את גורל התיק בכל הנוגע למהימנות המערערים. כך גם בכל הנוגע להחלטות הדיוניות האחרות בגינן מתבקשת פסילת בית המשפט.

5.אפשר שבראייתם של המערערים נוצר חשש, כי ההחלטות שקיבל בית המשפט בעניינם מצביעות על קיום משוא פנים כלפיהם. עם זאת, חשש זה אינו יוצא מכלל חשש סובייקטיבי גרידא, שאינו מקים עילת פסלות (מרזל, בעמ' 115-114; ע"א 3484/01 באן נ' באן (לא פורסם); ע"א 7857/04 צ'רטוק נ' וינקלר (לא פורסם)). לבסוף, יש לדחות את טענתם של המערערים בדבר פסילה מכוח מראית פני הצדק. לא אחת נפסק, כי אין מקום להרחיב את השימוש בט ענת מראית פני הצדק, אם וככל שיש לה מקום, לכל מקרה בו נטענת ט ענת פסלות שאין לה ביסוס אובייקטיבי ממשי, שאם לא כן, נמצאנו מרוקנים מתוכן את הלכות הפסלות שפותחו בבית משפט זה (ע"פ 28/98 אסרף נ' בן דורי (לא פורסם); ע"א 4518/99 אורלוב נ' בנק הפועלים בע"מ (סניף הקריה) (לא פורסם)).

אשר על כן, הערעור נדחה.
