פסק-דין

1.בפנינו שני ערעורים על פסק-דין של בית המשפט המחוזי בתל-אביב-יפו (כבוד השופט י' אטדגי). שתי סוגיות עלו בפסק-הדין וזאת לעניין מס רווח הון לגבי פיצויים המשולמים בגין פגיעה על ידי תוכנית, לפי סעיף 197 לחוק התכנון והבנייה, התשכ"ה-1965.

2.בית המשפט המחוזי קבע בפסק-הדין שתי קביעות עליהן חולקים הצדדים, מזה ומזה. בית המשפט קבע כי המערער בע"א 9433/12, שקיבל את הפיצויים, אינו זכאי להטבה שלפי סעיף 91(ז) לפקודת מס הכנסה. על פי ההטבה, החיוב במס רווח הון במקרה של הפקעת נכס יהא מחצית מסכום המס. כלומר, בעניין זה פסק בית משפט קמא לחובת הנישום. הקביעה הנוספת של בית המשפט, והפעם לחובת רשות המס, הייתה כי בחישוב רווח ההון יש להתיר ניכוי חלקי של עלות רכישת המקרקעין (ובמקרה זה מ דובר במקרקעין גובלים).

3.אנו סבורים שצדק בית משפט קמא בשתי קביעותיו. ברי כי ההטבה שבסעיף 91(ז) לפקודה חלה לגבי פיצויי הפקעה ואין היא חלה כאשר עסקינן, כמו במקרה דנא, בפיצויים על פי סעיף 197 לחוק, המדבר במפורש על פגיעה "שלא בדרך הפקעה".

4.בסוגיה הנוספת חזר בו הפרקליט המייצג את פקיד השומה מן הערעור. זאת, בכפוף לכך שתינתן התחייבות של הנישום כי בעת שיחול מס שבח לעניין המקרקעין הגובלים הוא לא ידרוש לנכות את הסכום של המחיר המקורי שנוכה בעת חישוב רווח ההון. נוסיף, כי לא יעלה על הדעת שתהא אפשרות של ניכוי כפול. פרקליטו של הנישום הצהיר כי שולחו לא יבקש בעתיד לנכות את הסכום שבית משפט קמא הורה על ניכויו.

5.אשר על כן, אנו מחליטים לדחות את הערעור בע"א 9433/12 ולמחוק את ע"א 1656/13. לא ייעשה צו להוצאות.
