פסק-דין

לפניי ערעור על החלטת כבוד הרשמת ד' כהן-לקח (בש"א 1862/11) מיום 1.5.2011 לפיה נדחתה בקשת המערער להארכת מועד להגשת ערעור על החלטת כבוד השופטת ז' קאודרס-בנר, מיום, 20.1.2011, שלא לפסול את עצמה (ת"ק 6337-02-10, בית המשפט לתביעות קטנות עכו).

בהחלטה מיום 20.1.2011 נדחתה בקשת המערער לפסילת כבוד השופטת ז' קאודרס-בנר. המערער לא הגיש את הערעור על החלטת הפסילה במועדו, קרי, עד תאריך 30.1.2011, וביום 7.3.2011 נקלטה בבית משפט זה בקשת הארכת המועד להגשת הערעור, בגדרה נטען כי בית המשפט דיבר "בשני קולות", מחד סירב לפסול את עצמו ומאידך ערך "דיון בלתי פורמלי" בו ניתן, לטענת המערער, מקום "לרפא את זכויותיו". בהמשך הגיש המערער בקשות שונות לבית המשפט לתביעות קטנות, ולטענתו מהתנהלותה של כבוד השופטת נראה כי היא ניסתה לחסום את דרכו לערער לבית משפט זה. בבקשתו ציין המערער, בשפה בוטה שאין לה מקום בבקשה לבית משפט, טענות נוספות כנגד כבוד השופטת ז' קאודרס-בנר. על כן, ביקש כי המועד יוארך.

כאמור, כבוד הרשמת דחתה את בקשתו, וקבעה כי לא עלה בידי המערער לשכנע כי התקיים "טעם מיוחד" המצדיק איחור של למעלה מחודש ימים בהגשת ההליך, בבחינת נסיבה שהייתה מחוץ לתחוּם צפייתו או שליטתו. עוד נקבע כי חזקה כי המערער, עורך דין במקצועו, היה מודע לסד הזמנים שעמד לרשותו לפי דין להגשת ערעור פסלות – דין שהינו ידוע ו מוש רש. בנוסף לכך צוין כי אם המערער היה בדעה כי ראוי להמתין להכרעת בית המשפט בבקשות השונות שהגיש, כי אז היה עליו להגיש לבית משפט זה בקשה להארכת מועד בתוך התקופה הקבועה בדין, ולא להמתין למעלה מחודש ימים לצורך הגשת ההליך. באשר לסיכויי ההליך העיקרי נקבע כי סיכוייו הלכאוריים אינם נחזים להיות טובים במידה המטה את הכף לטובת היעתרות לבקשה. כל זאת נקבע בשים לב לגישה הקפדנית הנוהגת ביחס לבקשות להארכת מועד להגשת ערעור פסלות. על כן, הבקשה נדחתה ונקבע כי המערער יישא בהוצאות המשיב בסך 2,500 ש"ח.

המערער טוען כי שגתה הרשמת בהחלטה ויש הצדקה להיעתר לבקשת הארכת המועד. הוא טוען כי בקשתו להארכת המועד הוגשה כבר ביום 27.2.2011, ולא כפי שנקבע על ידי הרשמת. עוד הוא טוען כי לא היה מנוס מאיחור בהגשת ההליך, לאור התנהלותו של בית המשפט לתביעות קטנות ורצונו לברר "לאן פני כבוד השופטת מועדות". לגופם של דברים נטען כי קיימת הצדקה לפסילת השופטת וכי סיכויי ההליך הינם גבוהים, בניגוד לקביעתה של הרשמת. המערער מעלה בערעורו טיעונים נוספים כנגד התנהלותה של הרשמת, אשר לטענתו "חרגה מסמכותה". על כן, מבקש המערער כי החלטתה של הרשמת תבוטל ותינתן לו הארכת המועד המבוקשת.

לאחר שעיינתי בהחלטת הרשמת, בערעור הפסלות, בבקשת הארכת המועד ובהודעת הערעור הגעתי לכלל מסקנה, כי דין הערעור להידחות.

במקרה דנן, נקודת המוצא היא שהמערער איחר, זמן לא מבוטל, בהגשת הערעור, בין אם הבקשה הוגשה, כטענתו, ביום 27.2.2011 או במועד אחר מאוחר יותר. תקנה 471ג(ב) לתקנות סדר הדין האזרחי, תשמ"ד-1984 קובעת כי ערעור על החלטת שופט בטענת פסלות יש להגיש תוך עשרה ימים מהיום שבו הודעה לבעל הדין החלטת השופט. כלמור במקרה דנן, אין מחלוקת כי המועד האחרון להגשת ההליך חל ביום 30.1.2011. השאלה היא האם הצליח המערער להצביע על "טעם מיוחד" להארכתו של המועד שהוחמץ. כבוד הרשמת הצביעה על השיקולים השונים המטים את הכף כנגד הארכת המועד המבוקשת, ובכללם הגישה הקפדנית הנוהגת ביחס לבקשות להארכת מועד להגשת ערעור פסלות; בשים לב למשכו המשמעותי של האיחור במקרה דנן, להעדרו של "טעם מיוחד" לכך, ולסיכוייו הלכאוריים הלא גבוהים של ההליך העיקרי; וכן בהתחשב בצפיית המשיב לסופיות הדיון ולאינטרס הציבורי לכך שהליך הפסלות יסתיים במהירות האפשרית. חרף טענות המערער, לא מצאתי כל בסיס להתערב בהחלטה של הרשמת, אשר לטעמי הינה בהתאם לדין ולהלכה הפסוקה.

יש לשוב ולהדגיש כי "ככלל, בחלוף המועד להגשת ערעור, נוצרת לצד השני להליך ציפיה ראויה להגנה כי לא יוטרד עוד בהליכי ערעור. הצד השני להליך רוכש מעין חסינות דיונית מפני הגשת ערעור בעניינו. הדרישה לטעמים מיוחדים לצורך מתן ארכה משקפת מצב עניינים זה. הדברים אמורים באופן מיוחד בהליכי פסלות, בהם נקבעה תקופה קצרה לצורך הגשת ערעור פסלות" (בש"א 9054/01 הרמן נ' היועץ המשפטי לממשלה (לא פורסם, 6.1.2002)). אכן, לא בכדי נקבעה תקופה קצרה ביותר להגשת ערעור על החלטה בטענת פסלות, ובנושא זה יש חשיבות מיוחדת להקפדה על המועדים הקבועים בתקנות, כפי שציין הנשיא א' ברק בבש"א 2049/97 האזרחי נ' השופט צבן (לא פורסם,6.4.1997):

"תקנה 471ג לתקנות סדר הדין האזרחי, התשמ"ד- 1984 קוצבת 10ימים בלבד להגשת ערעור על החלטת שופט לדחות בקשה לפסילתו. לא בכדי נקבעה תקופה קצרה זו, שכן אין זה ראוי, כי טענת בעל דין כי השופט היושב בדינו פסול מלדון תרחף בחלל האוויר ללא התייחסות שיפוטית הולמת, לכאן או לכאן".

על כן, המערער היה צריך להצביע על "טעמים מיוחדים" של ממש על מנת לקבל את בקשת הארכת המועד המבוקשת על ידו (ראו בש"א 8847/99 עדן נ' עדן (לא פורסם, 11.6.2000); יגאל מרזל דיני פסלות שופט 340 (2006)). מהטעמים שפורטו על ידי הרשמת, נראה כי אין בנסיבות עליהן עמד המערער, כדי לשמש טעם מיוחד להארכת המועד. יתרה מכך, גם אם אקבל את טיעוני המערער בדבר רצונו לפנות בשנית לכבוד השופטת, לא הוברר מדוע בקשת הארכת המועד לא הוגשה בתוך המועד הקבוע בתקנות, וזאת אף למען הזהירות. אשר על כן, אין מקום להתערב בהחלטה של הרשמת, שכן המערער לא ביסס כל טעם מיוחד להארכת המועד.

אשר על כן, הערעור נדחה. משלא התבקשה תגובת המשיב, אין צו להוצאות בהליך זה.
