השופט ח' מלצר:

1.בפנינו עתירה למתן צו על תנאי וצו ביניים הנוגעת להחלטה לפטר את העותר מן המשטרה. במסגרת העתירה מבקש העותר צו ביניים לפיו ימנעו המשיבים מפיטוריו עד להכרעה בעתירה.

2.עניינה של העתירה נסוב על החלטת ראש אגף משאבי אנוש ב משטרת ישראל, ניצב עמיחי שי, מתאריך 6.4.2011, בדבר פיטוריו של העותר מן המשטרה. בהודעת הפיטורין נכתב כי בעקבות הרשעתו של העותר ב בית הדין למשמעת בביצוע עבירות של התנהגות שאינה הולמת שוטר ואי נקיטת אמצעים סבירים למניעת עבירה או לגילוי עבירה, נשקל המשך שירותו של העותר בחייל, ולאחר עיון בקביעות בית-הדין, בטיעוני העותר שהועלו בשימוע, ובהמלצות הגורמים הצריכים לענין – הוחלט לפטרו.

העותר טוען כי ההחלטה על פיטוריו איננה סבירה ואיננה מידתית בשים לב למעשים שבגינם הורשע ב בית הדין למשמעת. כן הוא משיג על כך שלא הובאו בחשבון כל השיקולים הרלבנטיים ולא נערך כל איזון בין ותק השירות שלו וטיבו, סוג התפקידים שמילא, עברו המשמעתי ומידת יושרו לבין הכשל המבצעי שאירע.

3.עניינה של העתירה נופל בגדרי העניינים המצויים בסמכותו של בית המשפט לעניינים מינהליים. בתוספת הראשונה ל חוק בתי משפט לעניינים מינהליים, התש"ס-2000 מפורטת רשימת העניינים המצויים בסמכות בתי המשפט לעניינים מינהליים וביניהם, מנויה בסעיף 37(1) לתוספת "החלטה בעניין המנוי בסעיף 93א ל פקודת המשטרה [נוסח חדש], התשל"א-1971". סעיף 93א ל פקודת המשטרה (נוסח חדש), התשל"א-1971 מונה עניינים שונים ובכללם פיטורי שוטר מן החייל – נושא העתירה שלפנינו.

נוכח האמור לעיל, דין העתירה להימחק על הסף נוכח העובדה שראוי כי הנושא יתברר בפני בית המשפט לעניינים מינהליים, היה והעותר יבקש להמשיך ולעמוד על עתירתו (ראו: בג"ץ 8421/ 10 פקד דנינו נ' משטרת ישראל (לא פורסם, 16.11.2010) מפי השופטת ע' ארבל). כאן המקום להעיר כי ניתנה לעותר הזדמנות למחוק את עתירתו לאחר שהופנה להוראות החיקוקים הרלבנטיים הנ"ל ואולם בהודעתו מתאריך 30.5.2011 הוא עמד על עתירתו, מבלי שהסביר מדוע לגישתו הסמכות מצויה בידי בית משפט זה.

4.לא נעלמה מעינינו טענת העותר לפיה הפיטורין צפויים להיכנס לתוקף בתאריך 2.6.2011. יחד עם זאת יש לציין כי הודעת הפיטורין ניתנה בתאריך 6.4.2011 (לטענת העותר היא התקבלה אצלו רק בתאריך 3.5.2011). על אף הדחיפות הנטענת, העותר הגיש את עתירתו זו רק בתאריך 26.5.2011, שבוע בלבד לפני מועד כניסת הפיטורין לתוקף, מבלי שניתן כל הסבר לכך. ועדיין, בידי העותר לפנות ל בית המשפט לעניינים מינהליים טרם כניסת הפיטורין לתוקף, על פי המועד שהוא טוען לו.

5.נוכח כל האמור לעיל – העתירה נמחקת. בנסיבות העניין אין צו להוצאות.
