ערעור על החלטת הרשם ג' שני (ע"א 3333/14 – א') מיום 22.5.2014, במסגרתה דחה את בקשת המערער לפטור מעירבון, אך הפחיתו מסך של 30,000 ש"ח לסך של 15,000 ש"ח לנוכח נסיבותיו האישיות, מצבו הרפואי ומעמדם היחסי של הצדדים.

1.בהחלטתו ציין הרשם כי למערער פיקדונות בסכום העולה על 65,000 ש"ח, ומלבד זאת יש תיעוד להוראות קבע לחסכון ולמכירת ניירות ערך בחשבון בנק נוסף אשר בבעלותו. כמו כן, ציין כי המערער לא פירט ולא תמך במסמכים את טענתו שאינו יכול להסתייע בסביבתו הקרובה לשם תשלום העירבון. עם זאת, כאמור ברישה, הפחית הרשם את העירבון שנקבע במחצית.

2.מכאן הערעור שלפניי, במסגרתו טוען המערער כי אין ביכולתו לשלם אף את סכום העירבון המופחת. לטענתו, מצבו הבריאותי חמור, הוא סובל ממוגבלויות קשות, ומתקיים מקצבת זקנה וקצבה לנפגעי גזזת. עוד טוען הוא כי כל משפחתו חווה קשיים כלכליים ואינה יכולה לסייע לו, וכי הפיקדונות בחשבונותיו נועדו לממן את טיפוליו הרפואיים והוצאות בלתי צפויות אחרות.

3.דין הערעור להידחות. לא מצאתי פגם המצדיק התערבות בהחלטת הרשם. כידוע, שיקול דעתו של הרשם רחב, ולא בנקל תתערב בו ערכאת הערעור (ראו: בש"א 5814/12 ליברוב נ' בית חולים אלישע (14.8.2012); בשג"ץ 8760/12 ואן קול נ' גנות (5.5.2013)).

4.במסגרת בקשה לפטור מהפקדת עירבון, על המבקש הנטל להוכיח שני תנאים מצטברים: היעדר מסוגלות כלכלית וסיכויי ההצלחה בערעור (ראו: בש"א 1528/06 ורנר נ' כונס הנכסים הרשמי, פסקה 7 (17.10.2007)). המערער אינו עומד בתנאי הראשון. למערער פיקדונות בסכומים לא נמוכים, ודי בכך כדי לדחות את הבקשה (ראו: החלטת הרשם י' מרזל בע"א 4591/07 סוויד נ' רושרוש (6.8.2007); החלטת הרשם ג' שני בעע"ם 2109/12 זאהי נ' הוועדה המחוזית לתכנון ובנייה מחוז חיפה (22.4.2012)). באשר לאי יכולתו להסתייע בסביבתו הקרובה לשם הפקדת העירבון, המערער לא סיפק נימוק מספק גם בערעורו לעניין זה ולא די בציון קשיים כלכליים בכלליות (ראו: בש"א 6411/11 שני נ' עו"ד ארז חבר, נאמן לנכסי החייב (3.10.2011); בש"א 57/14 גלעדי נ' ברג (7.1.2014)). במצב עניינים זה, ומהטעמים שמנה הרשם בהחלטתו, ההחלטה לדחות את הבקשה לפטור תוך הפחתת סכום העירבון, מאזנת לדעתי נכונה בין השיקולים השונים.

5.סוף דבר, הערעור נדחה. המערער יפקיד את העירבון עד ליום 27.7.2014. לא יעשה כן, יירשם ההליך לדחייה ללא כל הודעה נוספת.
