ערעור על החלטתה של כבוד רשמת בית המשפט העליון ל' בנמלך מיום 11.6.2014 בע"א 195/14

פסק-דין

ערעור על החלטת הרשמת ל' בנמלך (ע"א 195/14) מיום 11.6.2014, במסגרתה דחתה את בקשת המערער ל"הבהרת החלטה" מיום 27.5.2014.

דין הערעור להידחות. זוהי הפעם השנייה שעניינו של העירבון בע"א 195/14 מובא בפניי (לפעם הראשונה ראו: בש"א 2351/14 מיום 11.5.2014). למעשה, אף שהבקשה לגביה ניתנה ההחלטה מושא הערעור הוכתרה כ"בקשה להבהרת החלטה", בפועל היא בקשה רביעית לעניין סכום העירבון ופטור מהפקדתו. הרשמת נתנה את החלטתה הראשונה בעניין העירבון ביום 22.1.2014. את החלטה זו תקף המערער מספר פעמים ובדרכים שונות כאמור, זוהי עוד דרך מיני דרכים אלו.

לגופו של עניין, בערעורו חוזר המערער על טענותיו בשאלת הפטור מהפקדת עירבון ומפנה להחלטה מיום 22.1.2014. כפי שכתבתי בבש"א 2351/14, המועד לערעור על החלטה זו חלף, ועת הדבר הוזכר כבר בפסק דיני האמור, לא היה מקום לשוב ולטעון נגד ההחלטה האמורה, אף אם תילקח בחשבון העובדה שהמערער אינו מיוצג. דומני כי לא ניתן להתעלם מהתחשבותה הרבה של הרשמת בבקשות המערער, ומהפעלת שיקול דעתה במטרה לסייע למערער אך גם לקדם את ההליך הדיוני, גם באמצעות דחיות במועדים להפקדת העירבון, ולראיה, כשישה חודשים חלפו מפתיחת התיק העיקרי, וטרם הופקד עירבון כנדרש. לסיכום, לא מצאתי שיש כל פגם המצדיק את התערבותי בהחלטת הרשמת.

סוף דבר, הערעור נדחה. המערער יפקיד את העירבון תוך 21 יום מהמצאת החלטה זו לידיו. לא יעשה כן, יירשם ההליך לדחייה או יימחק ללא הודעה נוספת.
