ערעור על החלטת הרשם ג' לובינסקי (ע"א 6103/13 – ו') מיום 20.7.2014 במסגרתה הורה למזכירות בית משפט זה להשיב לידי המערער את הסיכומים ותיק המוצגים שהגיש בהליך וקבע כי המערער יגיש סיכומים מתוקנים ותיק מוצגים ערוך כדין, ללא התייחסות למוצגים שצורפו שלא כדין.

1.המערער הגיש לבית משפט זה ביום 8.9.2013 ערעור על פסק דינו של בית המשפט המחוזי בירושלים. ביום 26.11.2013 הגיש המערער בקשה להוספת ראיות בערעור. ביום 27.11.2013 החליט הרשם ג' שני כי הבקשה להוספת ראיות תובא בפני ההרכב שידון בערעור וכי המשיב יוכל להגיש תשובה לבקשה זו של המערער במועד הקבוע להגשת סיכומים מטעמו. למרות שההרכב לא הכריע בבקשה האמורה, בסיכומים ובתיק המוצגים שהגיש המערער בתיק ביום 1.4.2014 הוא התייחס לראיות הנוספות ואף צירף אותן, אף כי ציין בסיכומים כי מדובר בראיות חדשות שהבקשה להוסיפן טרם הוכרעה. ביום 17.6.2014 הגיש המערער בקשה לצירוף ראיות נוספות, מעבר לראיות שכבר ביקש לצרף. ביום 18.6.2014 נתן הרשם ג' שני החלטה דומה להחלטה מיום 27.11.2013 גם בעניין בקשה זו. ביום 7.7.2014 הגיש המשיב בקשה למחוק את אותו חלק מסיכומי המערער שמתייחס לראיות שלא אושרה הוספתן וכן להוצאת הראיות האמורות מתיק המוצגים. המערער התנגד לבקשה.

2.ההחלטה מושא ערעור זה קיבלה את בקשת המשיב, והרשם ג' לובינסקי הורה כאמור ברישה, בכדי למנוע את הכללת הראיות שטרם אושרה הוספתן בסיכומי ומוצגי המערער. בשל התנהלותו של המערער, חייב אותו הרשם בהחלטתו גם בהוצאות בסך 2,000 ש"ח.

3.מכאן הערעור שלפניי. המערער טוען כי עניינו כולל שאלה משפטית עקרונית שיש להכריע בה והיא נוהל הטיפול בבקשה להוספת ראיות בערעור בבית המשפט העליון. לטענתו, נוהל זה שגוי ופוגע בצדדים וביעילות הערעור, כיוון שהוא מונע את בירור המחלוקות, ויוצר מצב בו למרות שהוגשה בקשה להוספת ראיות, הסיכומים בערעור מוגשים בהיעדר התייחסות אליה, כך שבית המשפט לא מיודע על מלוא המחלוקות בין הצדדים. המערער טוען עוד טענות ותתי טענות רבות בהקשר זה ומבקש להציע גישה חדשה לטיפול בבקשה להוספת ראיות, תוך שהוא מסתמך על החלטת בית משפט זה בע"פ 8080/12 מדינת ישראל נ' אולמרט (6.7.2014) בה החליט מותב מורחב לעיין בראיות חדשות אשר המדינה ביקשה לגבות. לטענתו החלטה זו הביאה לאיזון חדש שמחייב את שינוי הנוהל האמור, ומחייב כי הטיפול בבקשה להוספת ראיה יהיה טרם הגשת הסיכומים. באשר לעניינו הפרטני, טוען המערער כי הראיות שהוא מבקש להוסיף משנות מהותית את הדיון בעניינו ומחייבות התייחסות, וכי טענותיו ממילא נכללו בהודעת הערעור.

4.דין הערעור להידחות. טענותיו הכלליות והפרטניות של המערער מופנות למעשה כלפי החלטות הרשם ג' שני שהמועד לערעור עליהן כבר חלף, ולכן דינן להידחות. למעשה, המערער לא מכחיש שפעל בניגוד לתקנות סדר הדין האזרחי, התשמ"ד-1984 ובניגוד להנחיות נשיאת בית המשפט העליון מסיום 1.11.2010. כידוע, ככלל, ערכאת הערעור בוחנת את פסק הדין של הערכאה הדיונית על פי הראיות שהיו בפניה. הוספת ראיות חדשות בערעור היא החריג לכלל. המערער החליט על דעת עצמו כי תקנות סדר הדין האזרחי והנחיות הנשיאה אינן מחייבות אותו וכן לא מחייבים אותו כללים בסיסיים אלה של ההליך הערעורי, ועשה דין לעצמו. לפיכך, לא נפלה כל טעות בהפעלת שיקול דעתו של הרשם ג' לובינסקי ואין כל מקום לשנות מהחלטתו. עוד יוער כי טוב עשה המערער שהגיש את הסיכומים ותיק המוצגים המתוקנים ולא המתין עד הכרעה בערעור זה.

5.סוף דבר, הערעור נדחה.
