ערעור על החלטתו של כבוד רשם בית המשפט העליון ג' שני מיום 22.7.2014 ברע"א 1224/14

ערעור על החלטתו של הרשם ג' שני (רע"א 1224/14 – ה') מיום 22.7.2014 בגדרה הורה על רישומה לדחייה של בקשת רשות הערעור שהגישו המערערים כיוון שלא הפקידו את העירבון שנקבע לה.

1.המערערים הגישו בקשת רשות ערעור לבית משפט זה ביום 17.2.2014. במקביל ביקשו המערערים ארכה להפקדת העירבון בתיק. אחרי מימוש התקופה המבוקשת, הגישו בקשה לארכה נוספת, שהתקבלה בחלקה. לבסוף ביקשו המערערים פטור מהפקדת עירבון. בהחלטתו מיום 27.4.2014 (רע"א 1224/14 – ג') דחה הרשם ג' שני את הבקשה לפטור אך הפחית את סכומו של העירבון לסך של 15,000 ש"ח. על החלטה זו ערערו המערערים, וביום 22.6.2014 (בש"א 3197/14) דחיתי את ער עורם, אך לנוכח טענותיהם שבכוחם להמציא אסמכתאות מתאימות שיש בידיהם, אפשרתי להם "להגיש לרשם תצהיר מפורט על אודות מצבו[ם] הכלכלי, בליווי כל האסמכתאות הרלוונטיות לתמיכה בטענותיו[הם]" תוך 15 יום ממועד המצאת פסק דיני לידיהם. המערערים פנו בעקבות פסק דיני בבש"א 3197/14 ל רשם ג' שני ביום 20.7.2014, אך מהחלטתו מושא ערעור זה עולה כי בקשתם החדשה כללה את אותו תצהיר שכבר הוגש בבקשתם הראשונה ואסמכתה יחידה שהוגשה אף היא. לפיכך, וכיוון שהמערערים לא הפקידו את העירבון, הורה למזכירות לרשום את ההליך לדחייה.

2.מכאן הערעור שלפניי, בו חוזר המערער 1 על טענותיו מהערעור הקודם (בש"א 3197/14) וטוען כי הוא בן 69, אין לו חשבונות בנק ואינו משלם את חשבונות החשמל והמים. כמו כן טוען שנפתחו נגדו תיקי הוצאה לפועל וכי הוא אינו מיוצג על ידי עורך-דין כיוון שאינו יכול לשאת בתשלומי שכר הטרחה. עוד טוען המערער 1 כי אין לו רכוש, כספים או חשבונות, ואף שניסה לגייס את הסכומים שנדרש לשלם מסביבתו הקרובה לא הצליח, כיוון שאין בידו להשיב את הכספים היות שאינו עובד.

3.דין הערעור להידחות. לא מצאתי הצדקה להתערב בשיקול דעתו של הרשם (לתכלית והצדקות לשיקול דעתו הרחב של הרשם בעניינים מסוג זה ראו: בשג"ץ 4934/14 גורנשטיין נ' הכנסת, פסקה 13 לפסק דיני (21.7.2014) (להלן: עניין גורנשטיין)). למערערים ניתנו הזדמנויות רבות להפקיד את העירבון, גם אחרי שסכומו הופחת, והם לא עשו כן. מטרת העירבון היא להבטיח את הוצאותיו של המשיב בהליך. הצורך בו גובר ככל שסיכויי ההליך נמוכים יותר. הרשם בהחלטתו ואני בפסק דיני הטעמנו כי בקשות רשות ערעור, על דרך הכלל, הינן הליכים שסיכוייהם נמוכים באופן יחסי, ולכן יש מקום להבטיח ביתר שאת את הוצאות המשיבים בהם (וראו גם: עניין גורנשטיין, בפסקה 8 לפסק דיני). השיקול הנוסף שיש לשקול בהקשר זה הוא מצבו הכלכלי של מי שאמור להפקיד את העירבון. לעניין זה, על אף החלטות בית משפט זה, המערערים לא הביאו הוכחות כנדרש ולכן לא ניתן לקבוע ממצאים כלשהם. אף שליבי עם המערערים נוכח מצבם האישי הקשה ותחושתם הקשה מהעניין שבמרכזו של ההליך העיקרי, הרי שבנסיבות האמורות, מבלי הפקדת העירבון לא ניתן לאפשר להליך להתנהל.

4.סוף דבר, הערעור נדחה.
