בפני ערעור על החלטתו של כבוד השופט י' מרזל, רשם בבית משפט זה, שבה נקבע כי ההליך המתאים לבירור השגותיה של המערערת הוא במסגרת בקשת רשות ערעור.

המשיב הוא חוקר פרטי במקצועו, ובמסגרת הסכם בינו לבין המערערת, הוא חקר עבורה שימוש בחשבוניות מס פיקטיביות והעלמת מס. בין הצדדים נטושה מחלוקת לעניין שכרו. המשיב פנה לבית המשפט המחוזי בתובענה למתן חשבונות ולסעד כספי. בהחלטה מיום 8.12.2002 (להלן: ההחלטה הראשונה) נקבע כי על המערערת להעביר למשיב פירוט חשבונות ביחס לחמישים ושלושה נישומים. כעבור כשלוש שנים פנה המשיב לבית המשפט המחוזי בבקשה להשלמת הדיון ולמתן הוראות. המשיב טען כי במסגרת חקירתו נבדקו נישומים נוספים, וגם ביחס אליהם ביקש שהמערערת תמסור לידיו פירוט חשבונות. בתאריך 8.1.2006 קבע בית המשפט המחוזי (להלן: ההחלטה השנייה) כי ההחלטה הראשונה איננה בגדר פסק-דין סופי, כיוון שהיא עוסקת רק במסירת חשבונות, ולא בשאלת התשלום בגינם. בית-המשפט הוסיף וקבע – בהחלטת הבהרה - כי המערערת תמסור למשיב פירוט חשבונות נוספים מעבר לחמישים ושלושה הנישומים שנדונו בהחלטתו הקודמת. על החלטה זו הגישה המערערת ערעור בזכות לבית משפט זה. עיקר המחלוקת שהובאה בפני כבוד הרשם היא בשאלה אם החלטתו הראשונה של בית המשפט המחוזי היא פסק דין סופי או שמא החלטה אחרת. מההכרעה בשאלה זו נגזרת התשובה לשאלה מהו ההליך הראוי בבית-משפט זה - ערעור בזכות או שמא בקשת רשות ערעור.

כבוד הרשם קבע כי יש לראות בהחלטה הראשונה כהחלטה אחרת. "כך הדבר לא רק בשל מהותו של הליך מתן חשבונות הכולל ממילא בירור דו-שלבי שטרם נסתיים בעת הגשת ההליך לבית משפט זה" – כך כתב – "ולא רק נוכח העובדה כי בפי המשיב טענות הנוגעות לא רק לחשבונות עצמם אלא לחיוב כספי מטעם המבקשת. אכן, ניכר מכלל הסכסוך בין הצדדים כי סיומו יהא מצוי בפסק דין הקובע את חבותה הכספית של המבקשת". עם זאת, ציין כבוד הרשם את נסיבותיו המיוחדות של המקרה דנן, ועמד על-כך ש"הצדדים ראו בינם לבין עצמם את המחלוקת כמסויימת במידת מה לאחר שהועברו חשבונות לגבי חמישים ושלושה נישומים וסכום שהעבירה המבקשת למשיב בגין כך". הרשם החרה והחזיק אחר קביעתו של בית-המשפט המחוזי כי "אין בנמצא ראיה או הסכמה של המשיב לפיה הסכסוך הכספי נסתיים". לאור הדברים הללו, החליט כבוד הרשם כי ההליך העיקרי כולו טרם הסתיים, ולכן, הדרך הנכונה להשיג על ההחלטה השנייה, ולברר את מלוא טענותיה של המערערת, היא במסגרת בקשת רשות לערער.

החלטתו של כבוד הרשם היא נשוא הערעור הזה. בפני חזרו הצדדים על עיקר טענותיהם. המערערת ביקשה להדגיש את ייחודם של ההליכים שהתרחשו במקרה זה. לשיטתה, מההחלטה הראשונה עולה בבירור כי מ דובר בפסק דין סופי, זאת בין היתר, לאור העובדה שבית-המשפט המחוזי קבע מפורשות כי על המערערת לפרט את גמולו של המשיב, לרבות הפרשי ריבית. עוד הטעימה כי גם בית המשפט המחוזי, בשתי החלטות שקדמו להחלטה השנייה, ראה בהחלטתו הראשונה משום פסק דין: בהחלטתו מיום 3.3.2003 הורה למערערת לערוך השלמות, אך הדגיש – כך לטענתה – כי הרשימה תתייחס לחמישים ושלושה הנישומים ולא מעבר לכך. בהחלטה נוספת מיום 6.3.2006 דחה את בקשתו של המשיב לתיקון ההחלטה הראשונה בדרך של הוספת שני נישומים, וקיבל את עמדתה של המערערת, כי הוספת הנישומים תהווה שינוי של פסק הדין. המערערת מדגישה כי הצדדים ראו בהחלטה הראשונה כסוף פסוק לסכסוך שביניהם. המשיב, מצידו, חזר וטען כי משלא פסק בית המשפט המחוזי לעניין התשלומים והוצאות משפט, טרם סיים את מלאכתו. לפיכך, כל ההחלטות שניתנו עד כה הן בבחינת "החלטות אחרות" שעליהן ניתן לערער ברשות בלבד.

לאחר שעיינתי בטענות הצדדים הגעתי לכלל מסקנה כי דין הערעור להדחות. אכן, משך התנהלות ההליכים, אופן ניהולם וכן התשלומים שכבר הועברו בין הצדדים, מקשים על סיווג ההחלטות במקרה שלפני. יחד עם זאת, ההליך המ דובר הוא הליך למתן חשבונות, וכבר נפסק כי בתביעה למתן חשבונות, ההתדיינות מגיעה לסיומה בהכרעתו של בית המשפט במחלוקת לגופם של דברים, היינו, במקרה זה, בשאלת חבותה הכספית הכוללת של המערערת (ראו ע"א 654/88 אליהו נ' דגן, תק-על 90(2) 546 (1990); י' זוסמן, סדרי הדין האזרחי 524 (מהדורה שביעית, ש' לוין עורך, 1995). בנסיבות העניין, נמצא כי ההחלטה הראשונה עוסקת בהעברת חשבונות למשיב, ואינה מכריעה, בהכרח, בכל היבטיה של המחלוקת בין הצדדים.

לא ראיתי להתערב בהחלטת כבוד הרשם כי האכסניה הראויה לברר את השגותיה של המערערת היא בדרך של הגשת בקשת רשות ערעור.

הערעור נדחה. בנסיבות העניין אין צו להוצאות.
