עניינה של העתירה שבפנינו, היא בבקשת העותר, מורה לשעבר באחד מבתי הספר שבבעלות המשיבה, כי נורה למשיבה – ויצ"ו – הסתדרות עולמית לנשים ציוניות – לשלם לו את תוספת הוותק וגמול תעודת ההוראה, להם לדבריו הוא זכאי.

דין העתירה להידחות על הסף, בהיעדר עילה להתערבותו של בית המשפט הגבוה לצדק. נימוקי העותר לתביעתו אינם מסודרים ומבוררים די הצורך ואולם, מן המסמכים שצורפו לעתירה עולה, כי במסגרת בירור ההליך בבית הדין הארצי לעבודה (ע"ע 1059/00), הושגה הסכמה בין העותר ונציג המשיבה בנושא התביעה. בית הדין העניק להסכמה זו תוקף של פסק דין והפנה את הצדדים למומחים מטעמו, כדי להעריך ולקבוע את התשלום המגיע לעותר. מסקנות המומחה אינן מקובלות על העותר, לדבריו הן אינן מבוססות ומקורן בטעות, ומכאן העתירה שבפנינו.

גם אם קיימת לעותר זכות כלשהי למרכיבי השכר השונים, ואין אני מביע דעתי בעניין, הרי שהעתירה אינה עוסקת כלל בהפעלת סמכויות מנהליות או ציבוריות כלשהן המצויות בתחום סמכותו של בית משפט זה. תביעתו של העותר למרכיבי השכר צריכה להתברר ככל שיעלה בכך צורך, בבית הדין לעבודה, במסגרת הסמכויות המוקנות לו.

אשר-על-כן, דין העתירה להידחות על הסף.
