העותר יליד 1938 יוצא אתיופיה מבקש כי יינתן לו להעלות לישראל את ילדיו הבוגרים מנישואיו הקודמים ואת נכדיו, כדי שיינתן להם מעמד בישראל, לאחר שהם ממתינים שנים רבות לעלייה. המשיב מסרב להיעתר לבקשה בטענה כי על פי רישומיו, העותר עלה לישראל כנכד של יהודי ועבר בארץ גיור, כיוון שהוריו שאכן נולדו כיהודים התנצרו בהיותם באתיופיה. לפיכך, כך טוען המשיב, ילדיו של העותר מנישואיו הראשוניים לאשה נוצריה, הם נינים של יהודי ואינם זכאים לעלות לישראל.

בפנינו טענה באת-כוח העותר כי העובדות הנטענות בתגובת המדינה הודעו לה רק מתוך התגובה עצמה, כי מרשה כופר בעובדות הנטענות על ידי המשיב וכי יש בידו להוכיח כי אינו בן להורים שהתנצרו. בין היתר, טוענת באת-כוח העותר כי בידו להוכיח את היותו בן של יהודים, ולו רק משום שגם אחיו וילדיו קיבלו מעמד בישראל והכרה כיהודים. כן טוענת היא שיש עדים המוכנים למסור עדות על כך במשרד הפנים.

בנסיבות אלה ועל פי הראיות המינהליות שהציג בא-כוח המשיב, לא נוכל להתערב במסקנתו אף על פי שלפניו היו רק ראיות מינהליות ללא ראיה מכלי ראשון וכן תרשומת של ראיון שנערך לעותר בשנת 2000. לעת הזו על פי הנתונים שבידי משרד הפנים וללא חומר ראייתי נוסף, לא נוכל לקבוע כי טעה המשיב במסקנתו לגבי היותו של העותר נכד של יהודי. עם זאת הדרך פתוחה בפני העותר להביא ראיותיו בפני המשיב, אשר יוכל לבחון מחדש את עמדתו לאחר שימוע נוסף, שמיעת עדים אחרים כמוצע על ידי העותר ובדיקה נוספת של עניין אחיו ומשפחתו. אנו ממליצים כי תיערך בחינה כזו כמתבקש מהטענות. אם יתקיים הליך כאמור, ולא יצלח, טענותיו של העותר שמורות לו, להבאתן בפני בית המשפט המוסמך.

בכפיפות לאמור בסיפא של פסק דיננו זה העתירה נדחית.
