עניינה של העתירה בבקשת העותר מס' 2 (להלן: העותר) להורות למשיבים ליתן טעם מדוע לא יעניקו לו אזרחות או רישיון לישיבת קבע בישראל או אשרת תושב ארעי. במסגרת העתירה, נתבקש צו ביניים המחייב את המשיבים לאשר לעותר להמשיך לשהות בתחומי הקו הירוק עד למועד מתן החלטת ועדת מאויימים או עד למתן פסק דין.

נציין כי עתירות קודמות שהגיש העותר ל בית משפט זה נדחו (בג"ץ 8124/02 מיום 11.12.02; בג"ץ 7923/03 מיום 9.2.04).

דין העתירה להידחות על הסף. מהעתירה עולה כי העורר לא פנה כלל למשרד הפנים, לאחר דחיית העתירות הקודמות, בבקשה להעניק לו אזרחות ישראלית או רשיון לישיבת קבע או ישיבת ארעי בישראל. בנוסף, דין העתירה להידחות מחמת אי מיצוי הליכים והיותה מוקדמת, באשר העותר פנה ביום 16.12.09 לועדת המאויימים בבקשה להיתר לישיבת קבע או לישיבת ארעי, אך הגיש עתירתו זו טרם נתקבלה תשובת הועדה. כל עוד לא דנה ועדת המאויימים בעניינו של העורר אין מקום להידרש לעתירה זו.

בשולי הדברים נציין, כי מתשובת המשיבים עולה שועדת המאויימים מוסמכת להעניק סעד ביניים עד למתן החלטתה, כך שגם מטעם זה, אין מקום ליתן צו ביניים כבקשתו של העותר.

אשר על כן, העתירה נדחית על הסף. משכך, אין מקום לקבוע העתירה לדיון בפני הרכב כאמור בהחלטתי מיום 3.1.10.
