זוהי עתירה למתן צו על-תנאי המופנה אל המשיבים ומורה להם למנוע מתושבים פלסטינאים לעבד את השטח המסומן בתצלום אוויר הנספח לעתירה (להלן: המקרקעין), ומצוי בסביבת היישוב עלי.

1.לטענת העותר, הוא מעבד את המקרקעין במשך כעשור והחל מינואר 2005 הוא אף מתגורר בהם. לשיטתו מדובר במקרקעין שאינם בבעלות פלסטינאית. אף על פי כן, כך טוען העותר, נודע לו שהמשיבים מתכוונים לארגן את תושבי הכפר קריות המרוחק כ- 2 קילומטרים מהמקרקעין ולהביא אותם לחרוש את המקרקעין. על-פי העותר, מהלך זה נוגד את חזקתו במקרקעין וצפוי לגרום להשחתת העצים שנטע והבית שהקים. העותר מוסיף וטוען כי לא קיבל הודעה רשמית על כניסת התושבים הפלסטינאים למקרקעין, וכי כשהגיע למשרדי המינהל האזרחי לבירור העניין נמסר לו כי הגורם האמון על הטיפול בפנייתו אינו נמצא.

2.המשיבים מצידם טוענים כי העותר לא צירף ולו בדל ראיה לטענותיו בדבר הקשר שלו למקרקעין, ובפרט לא הבהיר מהו המקור החוקי לכניסתו הנטענת אליהם. בנוסף טוענים המשיבים כי טענת העותר כי הגיע למשרדי המינהל האזרחי אינה עולה כדי מיצוי ההליכים הנדרש לפני פניה לבית משפט זה והם מוסיפים וטוענים כי בניגוד לטענות העותר, מדובר במקרקעין בבעלות פלסטינית פרטית וכי בשל כך מתאמים המשיבים פעמיים בשנה את כניסת בעלי הקרקע למקרקעין. כמו כן טוענים המשיבים כי המקרקעין עובדו עוד בטרם כניסתו הנטענת של העותר אליהם, והיא מצרפת לצורך כך לתגובתה תצלום אוויר של המקרקעין משנת 2003. לבסוף טוענים המשיבים כי ככל שהעותר סבור כי קיימת עילה משפטית למנוע מתושבים פלסטינים להיכנס למקרקעין, הרשות בידו לפנות לבית המשפט המוסמך בתביעה מתאימה.

3.דין העתירה להידחות על הסף.

מכתבי הטענות שהגישו הצדדים עולה כי קיימים ביניהם חילוקי דעות בדבר זהות בעלי המקרקעין. לשיטת המשיבים, מדובר במקרקעין בבעלות פלסטינאית פרטית, ומכאן שהחלטתם לאפשר לבעלי הקרקע לעבד את אדמתם היא סבירה ואף מתבקשת. העותר, מצידו, אינו מגבה בראיה כלשהי את טענתו כי המקרקעין אינם בבעלות פלסטינאית, ולכן הוא לא עמד בנטל הנדרש להראות כי קיימת סיבה להניח שרישומי המשיבים בדבר הבעלות במקרקעין שגויים. על כל פנים, ככל שסבור העותר כי רכש זכויות כלשהן במקרקעין מכוח חזקתו הנטענת בהם, הרי שיש בידו סעד חלופי על דרך של פניה בהליך מתאים לערכאה המוסמכת.

אשר על כן, העתירה נדחית על הסף. העותר ישלם למשיבים שכר טרחת עורך-דין בסך של 5,000 ש"ח.
