1.עניינן של העתירות שבפנינו בתחנת דלק שהקים העותר בבג"ץ 2500/11 (להלן – המחזיק) על קרקע שבבעלותו בכפר ענאתא. תחנת הדלק נבנתה ללא היתר בניה כדין. ביום 31.3.2011 הוצא לגביה צו הריסה סופי. בעתירתו מבקש המחזיק כי בית משפט זה יורה על ביטול ההחלטה להרוס את תחנת הדלק, ויחייב את המשיבים המיוצגים על ידי פרקליטות המדינה (להלן – המשיבים) לקדם את הסדרתה התכנונית. מנגד, העותרים בבג"ץ 5133/12 (להלן – רגבים) מבקשים כי ימומש צו ההריסה שהוצא למבנה. בהחלטה מיום 29.3.2011 (השופטת א' חיות), שניתנה בגדרי בג"ץ 2500/11, נקבע כי "עד למתן החלטה אחרת יימנעו המשיבים מהריסת המבנה נשוא העתירה". החלטה זו עומדת בתוקפה אף כיום. בקשת רגבים בבג"ץ 5133/12 למתן צו ביניים שימנע את המשך הפעלת התחנה נדחתה ביום 8.1.2014 (הנשיא א' גרוניס והשופטים נ' הנדל וע' פוגלמן).

2.בתגובתם המקדמית במסגרת בג"ץ 2500/11, שהוגשה בחודש נובמבר 2011, טענו המשיבים כי יש לדחות את העתירה על הסף מחמת אי-מיצוי הליכים ובשל היותה עתירה מוקדמת. זאת, הואיל והמחזיק לא מיצה את אפיקי ההסדרה מול רשויות התכנון והגורמים הרלוונטיים הנוספים במינהל האזרחי ביהודה ושומרון. עוד טענו המשיבים כי יש לדחות את העתירה לגופה, בהיעדר עילה להתערבות שיפוטית בהחלטה להוציא צו הריסה לתחנת דלק שנבנתה בלא היתר. בהמשך, בתגובתם המקדמית בבג"ץ 5133/12, שהוגשה בחודש ינואר 2013, הסבירו המשיבים כי מתקיימים הליכים להסדרת המבנה, אותם יזם המחזיק עוד בחודש אוקטובר 2010. המשיבים ציינו כי בכוונתם להציע למחזיק למחוק את העתירה בבג"ץ 2500/11, תוך התחייבות כי לא יפעלו למימוש צו ההריסה שהוצא לתחנת הדלק עד להחלטת מוסדות התכנון בעניינה. על רקע זה, טענו המשיבים כי יש לדחות את עתירת רגבים על הסף, כיוון שלא הושלם הטיפול המינהלי בסוגיית הסדרת התחנה.

3.שתי העתירות נשמעו בפנינו במאוחד ביום 2.6.2014. בעקבות הדיון, בו עלה כי הליכי ההסדרה התכנונית של תחנת הדלק מתקדמים, ניתנה שהות נוספת למיצויָם. ביום 13.7.2014 הוגשה הודעה מעדכנת מטעם המחזיק אשר תיארה את התקדמות ההליכים מול מוסדות התכנון. המחזיק ציין כי הוא מוכן למחוק את עתירתו בבג"ץ 2500/11, בתנאי שהמשיבים יתחייבו לשמור על הסטטוס קוו לפיו הוא יוכל להמשיך להפעיל את תחנת הדלק, ולא תבוצענה פעולות הריסה עד להשלמת הליכי ההסדרה התכנונית. ביום 8.10.2014 הודיעו המשיבים כי הליכי ההסדרה מתקדמים, אך טרם הוגשה תכנית בינוי המותאמת לפתרון התחבורתי שאושר עבור תחנת הדלק. המשיבים ציינו כי הם מסכימים להעניק למחזיק שהות בת חודשיים לצורך הגשת תכנית הבינוי המותאמת. הם הוסיפו, כי אם תוגש תכנית כאמור, ישובו ויבחנו את הצעת המחזיק להסכים למחיקת העתירה בבג"ץ 2500/11, בכפוף להתחייבות מצדם שלא לנקוט צעדי אכיפה נגד תחנת הדלק. בהמשך, ביום 18.12.2014 הודיע המחזיק כי תכנית הבינוי הוגשה, וכי ביום 30.11.2014 התקיים דיון לגביה בוועדת המשנה לתכנון ורישוי של מועצת התכנון העליונה ביהודה ושומרון. פרוטוקול הדיון צורף להודעה, ועולה ממנו כי התכנית אושרה להפקדה בתנאים.

4.לאור השלב המתקדם בו מצויים הליכי ההסדרה התכנונית של תחנת הדלק מושא העתירות, אנו סבורים כי עתירת המחזיק בבג"ץ 2500/11 מיצתה עצמה לעת הזו. כזכור, בעתירתו ביקש המחזיק, בעיקרו של דבר, להורות למשיבים לקדם את הסדרת התחנה ולהימנע מהריסתה. לכל אורך ההליכים הסכימו המשיבים לאפשר את קידומם של הליכי ההסדרה התכנונית, ועתה, עם הגשת תכנית הבינוי ואישורה להפקדה בתנאים, הושלם השלב החסר לפי הודעתם מיום 8.10.2014. ממילא, נראה שאין בכוונת המשיבים לפעול למימוש צו ההריסה בעת הנוכחית. המחזיק קיבל, איפוא, את מבוקשו. לפיכך, אנו מורים על מחיקת העתירה, בכפוף לכך שהמשיבים מטעם המדינה יימנעו משינוי הסטטוס קוו ביחס לתחנת הדלק עד להשלמת ההליכים במוסדות התכנון. מובן שטענות בעלי הדין שמורות להם, אם מסיבה כלשהי לא יינתן בסופו של דבר היתר לתחנת הדלק.

5.נוכח האמור, מתייתרת אף העתירה בבג"ץ 5133/12, שביקשה כזכור לחייב את המשיבים לממש את צו ההריסה שהוצא למבנה. דין עתירה זו להידחות אף לגופה. אין מחלוקת כי תחנת הדלק נבנתה באופן בלתי חוקי. יחד עם זאת, כלל ידוע הוא כי בית משפט זה נוקט ריסון רב בהתערבות בסדרי העדיפויות לאכיפת דיני התכנון והבנייה שקבעה הרשות המבצעת (ראו, למשל, בג"ץ 1161/06 תנועת "אנחנו על המפה" נ' שר הביטחון, פיסקאות 11-9 (14.10.2007); בג"ץ 5790/10 רגבים נ' שר הביטחון, פיסקה 5 (11.5.2014); בג"ץ 6203/12 תנועת רגבים נ' שר הבטחון (3.9.2014)). הואיל ותחנת הדלק בנויה על קרקע פרטית בבעלות המחזיק, ובעיקר נוכח השלב המתקדם בו מצויים הליכי ההסדרה, אין האכיפה במקרה דנא ממוקמת בסדר עדיפויות גבוה. על כן, אין הצדקה להתערבות בית המשפט בשלב זה על דרך הוראה על הריסת תחנת הדלק לאלתר. על כן, אנו דוחים את העתירה בבג"ץ 5133/12.

6.סיכומו של דבר, העתירה בבג"ץ 2500/11 נמחקת, והכל כמפורט לעיל. העתירה בבג"ץ 5133/12 נדחית. מיותר לומר שכל הטענות שמורות לבעלי הדין היה והבנייה לא תוכשר סופית תוך זמן סביר. בשתי העתירות לא ייעשה צו להוצאות.
