החלטה ופסק-דין

1.בשתי העתירות שבפנינו מלינים העותרים בעיקר על כך שהיועץ המשפטי לממשלה (הוא המשיב 1) אינו מעמיד לדין בגין עבירות שונות את אלה שכתבו שני חיבורים ואחראים לפרסומם. מ דובר בספר "תורת המלך – חלק ראשון: דיני נפשות בין ישראל לעמם" (להלן – הספר) שנכתב על ידי המשיבים 7-6 (בשתי העתירות) ומאמר בשם "ערבות הדדית – האסטרטגיה" (להלן – המאמר), שנכתב על ידי המשיב 7 (למעשה, העתירה בבג"ץ 2688/12 עוסקת אך בספר). בכל הנוגע לספר, החליט המשיב 1 שאין מקום להעמדה לדין בשל כך שאין די ראיות להעמדה לדין וכי אין מקום לנקיטה של צעדים אחרים (נגד המשיב 9). בכל הנוגע למאמר, טרם נתקבלה החלטה האם להעמיד לדין את המשיב 7. החקירה בעניין הייתה חלק מחקירה רחבה יותר, לגבי עורכים ואחראים לאתר אינטרנט כלשהו בו נכללו פרסומים שונים. בעניינם של העורכים והאחראים לאתר (ואשר אינם בעלי דין בעתירות) הוחלט להגיש כתב אישום, בכפוף לעריכת שימוע. יצוין, כי המשיבים שאינם מיוצגים על ידי פרקליטות המדינה לא התייצבו לדיון, אף שהוזמנו. הם אף לא הגישו תגובות לעתירות.

2.לאחר עיון בחומר ושמיעה של בעלי הדין שהתייצבו ושל הגוף המבקש להצטרף כ"ידיד בית המשפט", אנו מחליטים לעניין הספר –

(א) להוציא צו על תנאי כמבוקש.

(ב) תשובות לעתירות תוגשנה עד ליום 6.2.2014.

(ג) הגוף המבקש להצטרף רשאי להגיש חומר נוסף ובלבד שיעשה כן עד ליום 31.12.2013 (בלא שנחליט לעת הזו האם לצרף את הגוף כ"ידיד בית המשפט").

3.ככל שמ דובר במאמר, הרי העתירה בבג"ץ 2684/12 נמחקת באופן חלקי. זאת, שכן לעת הזו טרם נתקבלה החלטה האם להעמיד לדין את המשיב 7. אנו מניחים שהחלטה בעניין תתקבל בהקדם. כמובן, שלעותרים עומדת הזכות להגיש עתירה חדשה ככל שמ דובר במאמר.

הארגון הבינלאומי של עורכי דין ומשפטנים יהודים

על יסוד עתירות אלה שהובאו היום לפני בית משפט זה, מצווה בית המשפט כי ייצא מלפניו צו על תנאי המכוון אל המשיבים בבג"ץ 2684/12 ובבג"ץ 2688/12 והמורה להם להתייצב וליתן טעם:

1.מדוע לא יועמדו המשיבים 9-5 בבג"ץ 2684/12 ובבג"ץ 2688/12 לדין בעבירות לפי סעיפים 133, 134, 144ב, 144ד, 144ד2, 144ד3 לחוק העונשין, תשל"ז-1977 בגין פרסום הספר "תורת המלך" המכיל ביטויים המהווים הסתה גזענית, הסתה לאלימות והמרדה;

2.מדוע לא יתפסו ויוחזקו עותקים של הספר "תורת המלך" על ידי המשיבה 4 (משטרת ישראל), וזאת עד להחלטת שופט לחילוטם, לפי פקודת סדר דין פלילי (מעצר וחיפוש) [נוסח חדש], תשכ"ט-1969;

3.מדוע לא יועמד המשיב 9 (הרב דב ליאור) לדין משמעתי בגין מעשים והתבטאויות המהווים לכאורה עבירות לפי סעיף 12א לחוק שירותי הדת היהודיים [נוסח משולב], התשל"א-1971;

4.מדוע לא יושעה המשיב 9 לאלתר מתפקידו הציבורי עד לגמר הבדיקה וההליכים הפליליים והמשמעתיים.

המשיבים בבג"ץ 2684/12 ובבג"ץ 2688/12 יגישו תשובתם לעתירות עד ליום 6.2.2014 לבית המשפט ובעלי הדין ישירות.
