העותרים מבקשים לקיים את מצוות הקרבת קורבן פסח וקיום סדר פסח כהלכתו על הר הבית מחר (2.4.2007). בקשה שהוגשה בעניין זה למפקד מחוז ירושלים במשטרת ישראל נדחתה מטעמים של שמירה על הסדר הציבורי ומניעת פגיעה חמורה בשלום הציבור. פניה לראש הממשלה שנעשתה בעניין בראש חודש סיוון – לא נענתה.

העותרים טוענים כי הקרבת קורבן הפסח היא מצווה ייחודית שיש לה מקום וזמן מסויימים. הם מבקשים למלא מצווה זו כחובה דתית וזאת בתום לב ואמונה. לדבריהם הממשלה כלל לא התייחסה לפנייתם מראש חודש סיוון וממילא לא שקלה את הדברים ולא נעשה כל איזון על ידה. האיזון המתבקש בעניין זכות הפולחן שונה, לטענתם, מהאיזון בעניין זכות העליה להר הבית וזכות התפילה. העותרים מוסיפים כי השאלה הנשאלת בענייננו היא עד כמה צריכה הזכות לחופש פולחן לסגת מפני איומי אלימות. לדעת העותרים במדינת חוק אין להיכנע לאיומי אלימות ובוודאי לא כאשר על הכף מונחת הזכות לחופש פולחן.

המשיבים מבקשים כי נדחה את העתירה. הם מציינים כי התשובה לעותרים אכן ניתנה על ידי המשטרה בלבד, וזאת בשים לב למועד המאוחר בו נעשתה הפניה לראש הממשלה. המשיבים טוענים כי מול זכויותיהם של העותרים עומדים אינטרסים אחרים כמו שמירה על הסדר הציבורי, על שלום הציבור וביטחונו וכי על זכויות העותרים לסגת אם קיים חשש ברמה של קרבה לוודאות לפגיעה ממשית באינטרס הציבורי. המשיבים מדגישים כי בנוסחת האיזון יש ליתן משקל לרגישות המיוחדת של הר הבית ולמטען שהוא נושא. המשיבים מתארים כיצד בעבר בנסיבות שונות פרצו מהומות קשות בהר הבית שהובילו לפגיעה של אזרחים ושוטרים. בענייננו הגיע מפקד המחוז למסקנה כי קיום הטקסים כבקשת העותרים יביא, ברמה קרובה לוודאות, לפגיעה ממשית וקשה בסדר הציבורי ובשלום הציבור. הערכתו של מפקד המחוז התבססה על רגישותו של הר הבית בכלל אך גם על הרגישות המיוחדת בתקופה הנוכחית נוכח אירועי "שער המוגרבים" שאירעו לאחרונה, וכן על הערכות מודיעין לפיהן קיום הטקסים על הר הבית יגרור, ברמה הקרובה לוודאות, מהומות קשות ביותר ושפיכות דמים. המשיבים טוענים כי החלטתו של מפקד המחוז בנסיבות אלה היא החלטה סבירה שניתנה בסמכות על ידי הגורם שעל כתפיו מוטלת האחריות לביטחון ולסדר הציבורי ואין עילה להתערב בה.

עיינו בעתירה ובתגובה ושמענו את טיעוני הצדדים על פה והגענו לכלל מסקנה כי דין העתירה להדחות ואין מקום להתערבותנו בהחלטת מפקד המחוז. אכן, "ירושלים אינה כשאר ערים שבעולם, והר הבית אינו כשאר מקומות שבירושלים" (בג"ץ 2431/95 סלומון נ' משטרת ישראל, פ"ד נא (5) 781, 786). וכפי שכבר נקבע על ידי הנשיאה ביניש:

"נוכח מרכזיותו וחשיבותו הרבה של הר הבית גם לבני דתות אחרות, הסכנה הנובעת מהתלקחות האלימות שם אינה בגדר סכנה מקומית בלבד והיא עלולה להוביל להתלקחות שאופיה יסכן את הביטחון גם מחוץ לגבולות המדינה והאזור. לכך יש להוסיף כי למתרחש בהר הבית השפעה על שיקולים מדיניים ועל יחסי החוץ של המדינה. בהתחשב בכל אלה, מהווה הר-הבית מקום בעל רגישות ייחודית ויוצאת-דופן, ולפיכך השמירה על הסדר הציבורי בו מחייבת זהירות מרבית." אכן, אין ליתן וטו לקהל עוין המבקש לפגוע, בדרכי אלימות בזכויותיהם של אחרים. בצדק טוענים העותרים כי לא ניתן לממש את בקשתם אלא במקום מסויים ובזמן מסויים. לא ניתן (כמו בפרשת משי זהב) להפנותם למקום אחר ולזמן אחר. ואולם – היא הנותנת שלאור האינפורמציה שבידי מפקד המחוז לא ניתן, לעת הזו, להיענות לבקשת העותרים. בכך - אין מקום להתערבותנו.

העתירה נדחית.

מצרף אני דעתי לדעתם של חברתי השופטת נאור וחברי השופט פוגלמן, ואכן אין בידינו להיעתר לעתירה. העותרים ושכמותם מבטאים תסכול מתמשך, שניתן להבין ללב החשים בו, באשר לזכויות יהודים בהר הבית – במיוחד זכויות תפילה, או כנטען עתה גם זכויות פולחן כאלה או אחרות – במיוחד אל מול הכחשתן של זכויות יהודים בו מכל וכל על-ידי צדדים עוינים. בנוסף לכך שנושא העתירה לא הובא לפני הממשלה, כפי שציינה חברתי, איננו יכולים להביע דעה באשר לתקפותה ההלכתית של המשאלה להקרבת קרבן פסח, שלא הועלתה על-ידי העותרים בפני הגורמים ההלכתיים הממלכתיים, כגון הרבנות הראשית (ראו גם – בהקשר אחר של תקנות – בג"צ 33/92 בן יוסף נ' השר לענייני דתות, פ"ד מו(1) 855, 857). אך נודה על האמת: מעבר לשאלות ההלכתיות, ובמידה רבה אף אל מול שאלת הזכויות, עמדתן החוזרות ונשנות של ממשלות ישראל יסודה במישור הביטחוני. אין בידינו כלים לומר, כי חשש זה מבוטל. לא הרי סיטואציה זו – והדבר נהיר גם לעותרים – כהרי החששות לפגיעה בסדר הציבורי שהועלו בבג"צ 3358/95 הופמן נ' מנכ"ל משרד ראש הממשלה, פ"ד נד(2) 345 (ראו דברי השופט – כתארו אז – מצא בעמ' 365); וראו הכרעת בית המשפט בדנג"צ 4128/00 מנכ"ל משרד ראש הממשלה נ' הופמן, פ"ד נז(3) 289, בעניין נשות הכותל. עוצמת הקושי גדולה משמעותית, וקשה להלום השוואה בין השניים. לא קשה להניח, כי החששות הביטחוניים הכרוכים בצעד החדשני – אחרי 2000 שנה – שמבקשים העותרים לעשות, ושוב, בלא שאביע כל דעה באשר לפן ההלכתי, אינם נטולי יסוד.

סוף דבר, כאז כעתה במקומם עומדים דברי השופט א' גולדברג בבג"צ 7128/96 תנועת נאמני הר הבית נ' ממשלת ישראל, פ"ד נא(2) 509, 528 שנאמרו לפני עשור: "על הדרג המדיני, ולא על בית המשפט, לתת תוכן ומשמעות לקריאה ההיסטורית, 'הר הבית בידינו'".
